(hereinafter "Applicant") has applied to Pitkin County for a 1041 �.

'� Hazard Review and Ridgeline Review approval for a water line and ff."

� water tank replacement within a mapped wildlife area pursuar�t to
Section 5-404.2 of the Land Use Code; and

� WIIEREAS, the property is located north of the East Sopris '

�Y Creek Road and adjacent to the Little Elk Creek Subdivision more
� specifically described in Exhibit "A"; and � ; - �
,� WHEREAS, the Applicant proposes to replace three buried water I
� tanks and a four inch water line with a twenty foot high and thirty

,ti,� three foot in diameter, 100,000 gallon surface tank and under
'� ground eight inch water line; and
WHEREAB, the Applicant is also proposing an extension of the
`� water line to permit Mr. Kendall Smith�s property, more '
. ;�;.� specifically described in Exhibit "B", to tap onto the water line;

WHEREAS, the application was heard before the Planhing and
r'� Zoning Commission (hereinafter "Commission") at a public meeting ���

� ' noticed public hearing on September 10, 1991, at which time �';4

-'a evidence and testimony was presented with respect to this

� AHEREAB, the Board finds that the application complies with ,
�.;s the criteria of the Land Use Code for 1041 Hazard Review, Ridgeline

� - �; Review and Logical Extension of Utilities. i
� � NOA, THEREFORE, BE IT RESOLVED by the Board that it hereby I
� Igrants approval of the 1041 Hazard Review and Ridgeline Review to
' , � the Little Elk Creek Homeowner's Association subject to the
following conditions: '

1. The applicant shall submit a detailed revegetation plan
and landscaping plan identifying the number and species i ,
of plants to be replaced, for approval by the Planning
Office, prior to issuance of an excavation permit. The �
applicant shall provide financial assurances to l, ;.`
` :;•� accommodate the proposed landscaping plan with the
County, prior to issuance of an excavation permit. i`
�
� 2. The applicant shall receive Environmental Health
� Department approval for the water tank, prior to building
vapermit issuance. �
�
t 3. No further extensions of the water line are permitted
- without County Land Use approval. No service beyond
`"� existing contract committments will be allowed without
- ! BoCC review. �
