WHEREAB, A1 Droste, owner of the Brush Creek Ranch and Dennis
Grieves, the leasee (hereinafter "Applicants") of the Brush Creek
; Ranch located on Brush Creek Road more specifically described in j {��

, ' Exhibit "A" have applied to Pitkin County for annual review ;.�-�

( approval to a Special Review permit; and

AH&REAS, the Applicants have received County approval to

operate a commercial snowmobile operation pursuant to Resolution r
,.e 90-145 which stipulates that the Applicants must receive annual i�
� review approval prior to commencing operations for another year; -'r

1 ABEREAS, on October 8, 1991 the Planning and Zoning Commission
. i (hereinafter "Commission") considexed the Applicants request at a �i:

� WHEREAB, the Board considered the Applicants request at a duly °
' noticed public hearing on November 26, 1991 at which time the Board -

1. The applicant shall comply with recommendations made by
the Colorado Division of Wildlife. They are as follows:
a. Hours of operation shall not exceed 9 a.m. to 4 �' r ..,
p.m., or as determined otherwise by the Division of �
' Wildlife.

b. All snowmobile trips shall have an experienced guide �
:� employed by the ranch.
i c. Snowmobiling activities shall be restricted to the
� one agreed upon trail and turnaround as determined �,
by the Division of Wildlife and depicted on the site

- � d. The meadows on Brush Creek shall not be used until ""•
the elk use ceases, as determined by the Division
'� of Wildlife. '

' e. No operation of snowmobiles shall be permitted on (
the North side of Brush Creek. �:
' f. This snowmobiling use shall be reviewed yearly to +,
�,� insure compliance and compatibility with county and �
DOW conditions. Monthly monitoring by the DOW shall
_ � occur for review by the County.
� � g. The DOW will evaluate the effects of use on a �
� monthly basis and inform the applicant when to start
and cease snowmobile operations.
. � 2. The applicant shall provide the Planning Office with an
annual report on the number of employees and woYking i
� hours so that the inforntation can be reviewed by the
Housing Authority to determine employee generation. All
+ employee generated by the Brush Creek Outfitters must be
adequately mitigated.
� .
' 3. The applicant shall store snowmobiles and related
+ equipment, outside of the public view on Brush Creek Road
� :� on a year-round basis.
f 4. Wildlife mitigation conditions which apply to the parcel y�'
are:

a. Dogs shall be prohibited with the snowmobile � ��
