WHEREAe, T-Lazy Seven CoYp. (hereinafter "Applicant��) the jj
owner of T-Lazy Seven Ranch (more specifically described in Exhibit �:' ,

"A") has applied to Pitkin County for aa exemption to reconstruct �

; the main lodge structure, which was destroyed by fire in March � �"�
�
1991, and
WHEREAS, the lodge building is considered to be a "Use by
Speoial Review as Non-COnforming" under Section 7-1.1, as the use
and structure existed prior to the adoption of the AF-1 zone " !
district for the ranch; and
. , WHEREAS, the Applicant asserts that the criteria of Sections
7-1.1(a) and 7-1.7 of the Code are too harsh, due to the time '�
. constraints, submission requirements and monetary constraints, and
- has applied pursuant to Section 7-1.20 "Exemption of Limitation on ���
Repairs, Alterations and Restoration" oE the Code; and

WHEREAS, the application was heard by the Planninq and Zoning

Commission (hereinafter "Commission") at a duly noticed public �
� �' meeting on July 30, 1991 and recommended approval to the Board oE

1� WHBREAS, the Board finds that the Applicant shall not be
' required to obtain a setback variance because the lodge is a
' replacement and that the height increase of up to ten feet over the

� destroyed building is necessary Eor life, health and safety

� AHEREAS, the Board finds that the inventory of uses and �
s structures for the ranch is a requirement of the Land Use Code, and
, � that the County has given the applicant one year from occupancy to

� Commissioners that it hereby grants a

berm facing Maroon Creek Road. The revegetation shall �( '
be completed within one growing season of lodge

� submitted and accepted by the Planning Director, prior �,;
to issuance of the Certificate of Occupancy.
