� WHEREAS, Arthur O. Pfister, (hereinafter ^Applicant") has � ..' '

wildlife, wildfire and geologic hazard area pursuant to Section 5-

- 2; and
�� WHEREAS, the Application was considered by the Planning and
, Zoning Commission (hereinafter "Commission"} at a duly noticed �

public hearing on August 20, 1991, at which time the Commission ;.

allotment to the Board of County Commissioners (hereinafter i:

WHEREAS, the Board considered the Applicant's request at a '

- WHEREAS, the Board finds that the application has complied �' '

with the criteria of the Land Use Code for 1041 Hazard Review and
General Submission regulations.
r NOW, THEREFORE, BE IT RESOLVED by the Board of County -
� Commissioners that it hereby grants 1041 Hazard Review and General � r
! Submission approval to Art Pfister, subject to the following
! conditions: �

� 1. The following wildlife mitigation measures shall be }
adhered to by the applicant: ��
j a. Dogs shall be kenneled.
b. Native vegetation shall be maintained outside of the .�"
J building envelope.
i c. All fencing shaZl be 42" or less, 4 strand or iess �
� with a 12" kick space between the top 2 strands. �
i �
2. The GMQS residential unit allotment shall be canditioned •
upon the commitments made in the West Buttermilk Pfister
i Tract 2 GMQS application.
� 3. Prior to issuance of any building permits, the County •,•,�.: �
Enqineer shall approve the driveway design to meet safety
standards and the desire of the Fire Marshall. ���
, 4. The applicant shall place all utilities under existing �{: '' -

Disclaimer shall be noted on the Plan: ` ?

approved mitigation measures will guaYantee the
safety of any property."
7. The applicant shall adhere to the recommendations of The
Colorado State Forest Service Wildfire Safet�Guidelines , �
For Rural Homeowners handbook, as recommended by the
State Forest Service and Sheriff's Office. The applicant
shall provide residential sprinkler systems for both
. residences on the property. A 2,000 gallan cistern shall
� i be shared by the two residences for fire mitigation �,;
- purposes.
' 8. The recommendations of Consulting Geologist Nicholas '��
1 Lampiris's report dated April 29, 1991 and Dean Gordon'S ',��
. report dated May 17, 1991 shall be adhered to by the
applicant. ��
9. The following canditions recommended by the Housing i
Authority shall be adhered to by the applicant:
a. Prior to issuance of a building permit for the free
market residence on Tract 2, the applicant shall
file for approval a deed restriction for the •
, Category �1 detached two-bedroom sinqle-family
residence with the APCHA office. The deed
restriction shall be recorded by the applicant with "; ,
the Pitkin County Clerk and Recorder's Office. ;��
b. Prior to approval of the above mentioned deed �Y'�Y'
restriation, the applicant shall provide a copy of !;1:
plans for the two bedroom Category #1 rental unit � ,
verifying the net livable square footaqe of 501 - ;f�•j
