WHEREAS, the Board considered the Applicant's request at a
� duly noticed public hearing on October 29, 1991 at which time ,�.
. evidence and testimony was considered with respect to the subject �'i,-:..

WIiEREAS, the Board finds that the application has complied
with the criteria of the Land Use Code for 1041 Hazard Review and �,

General Submission regulations.
, NOW, TAEREFORE, BE IT RESOLVED by the Board of ,County
Commissioners that it hereby grants 1041 Hazard Review and General
Submission approval to Art Pfister, subject to the following
conditions:
. •1,.`.
1. The following wildlife mitigation measures shall be
adhered to by the applicant:
a. Dogs shall be kenneled.
b. Native vegetation shall be maintained outside of the .
building envelope.
c. All fencing shall be 42" or less, 4 strand or less _
with a 12" kick space between the top 2 strands. .
� �! 2. The GMQS residential unit allotment shall be conditioned k� �
• upon the commitments made in the West Hutterntilk Pfister ���`
Tract 5 GMQS application.

3. Prior to issuance of any building permits, the County =�� i

Engineer shall approve the driveway design to meet safety 1';
' standards and the desire of the Fire Marshall. ;

4. The applicant shall place all utilities under existing '`�
roads and driveways. .i'.
5. Prior to issuance of a building permit, the Applicant
shall provide a 1041 Aazard Review Plan which meets .�,�,,.

Disclaimer shall be noted on the Plan:
: "The provisions of these regulations do not in any �
way assure or imply that areas outside of designated �
hazard areas will be free from hazards, or that �
approved mitigation measures will guarantee the �
safety of any property.° ��
6. The applicant shall adhere to the recommendations of The
�= Colorado State Forest Service Wildfire Safety Guidelines
` For Rural Homeowners handbook, as recommended by the
• State Forest Service and Sheriff's Office. The applicant
shall provide residential sprinkler systems for both
residences on the property. A 2,00o gallon cistern shall
be shared by the two residences for fire mitigation
:�
purposes. �,
-' 7. The recommendations of Consulting Geologist Nicholas
Lampiris's report dated April 29, 1991 and Dean Gordon's �
report dated May 17, 1991 shaTl be adhered to by the
• applicant.
� 8. The following conditions recommended by the Housing �
Authority shall be adhered to by the applicant:
a. Prior to issuance of a building permit for the free �
� market residence on Tract 5, the applicant shall �
, file for approval a deed restriction for the
+ Category #1 detached two-bedroom single-family
residence with the APCHA office. The deed
+ restriction shall be recorded by the applicant with ' •
the Pitkin County Clerk and Recorder's Office.

� ; b. Prior to approval of the above mentioned deed
'; restriction, the applicant shall provide a copy of
; plans for the two bedroom Category #1 rental unit
verifying the net livable square footage of 501 - . �
750 square feet. '
9. With respect to the West Buttermilk Road, the following I� i
