WHEREAB, on December 17, 1991, the Pitkin County Board of . ;

County Commissioners (hereinafter referred to as the "Board") �= '`�

reviewed a request by the Pitkin County open Space and Trails
Board, on behalf of Wyland Kittle (hereinafter "Applicant'�), for
a Subdivision Exemption; and
WHEREAB, the Open Space Board proposes to purchase and ,
convert il aares of the Arbaney/Kittle Subdivision to publicly-
owned open space for development of trailhead facilities; and
WHEREAB, specifically, the Open Space Board proposes
development of a public parking area, a picnic area and trail

, access to publicly owned Forest Service and BLM property located ��'
immediately east of the purchased parcel; and

WHERSAB, said property is located immediately west of Holland

Hills on the north side of Highway 82, more specif.ically described

with the policies of the Board relative to open space and public

NOW, THEREFORE, BE IT RESOLVED by the Pitkin County Board of ` ,' " �

; County Commissioners that it hereby grants the Arbaney/Kittle +;
� Subdivision Exemption for a Community Facility subject to the .' ..

following conditions: R ` ' .
1) The applicant shall provide an amended subdivision plat for �� {,
' the Arbaney Ranch Subdivision which meets the approvaZ of the
County Attorney, the County Engineer and the Planninq of£ice �i •,=.
prior to recording. The Plat shall reflect subdivision of the
11 acre parcel from Lot 3. Subdivision covenants shall be
amended to reference the Management Plan which will govern the
use of the newly created public parcel.
2) Prior to Board Chairman's signature of the Plat, the applicant
shall provide documentation of legal access to the site to be +
approved by the County Attorney;

3) The open space parcel shall be used exclusively as a natural '�
- park for picnicking, parking (within a designated gravel
. surfaced parking area) and trailhead purposes. Potential
' developments may include a toilet facility approved by the =}
j Environmental Health Department, informational signing, a �
; hitching rail for horses, landscaping and "minor" road j�
, improvements as approved by the County Sngineer. Said ;��
development may occur within a development envelope as ti`
designated on the plat amendment. The proposed trail and
access road may be excepted from the envelope.

4) The site shall be deed restricted against any future
residential, commercial or industrial development. � � �
5) County Zoning regulations require the following:
� a. Signs shall comply with County Land Use Code sign
regulations. ,,�;.=
b. All fences more than six feet in height shall require a ���
building permit. (
c. , AlI structures shall be located outside of all setbacks. ��i ` -
Required setbacks are 100 feet for the front yard and 30 y
feet for the side and rear yards. ,!

7) Prior to issuance of an excavation permit, the applicant shall '-r �
submit a geologic report from a professional engineer `
recommending specific location of the parking area and %� :
� mitigation measures, such as berming, if necessary. The report ��� !
shall address debris flow and avalanche hazard. Development =w, ':`.
on slopes exceeding 30� in grade shall be prohibited. : :�i;,:�,
8) To mitigate potential wildfire hazard, the following shall

a. Any structure shall be designed to meet State Forest
Service guidelines for wildfire mitigation (if
applicable). '`!� ,
b. The management plan shall specify that no sources of
combustion shall be developed on-site, that campfires ;� '
and/or cooking fires shall be prohibited and use areas, :;-N;
such as picnic tables or parking lots shall be located :�;:,
away from trees or other flammable materials. � �

9) Upon completion of engineering and design of the proposed old '-.,��t�
Snowmass to Basalt trail, the applicant shall submit an :.'��r
application to the County for 1041 review of the trai2 ;;. �
aZignment (if necessary) and for a subdivision plat amendment
to reflect the new trail easement. ,

lOj Responsibility fox maintenance and improvements for the
facility shall be specifically addressed in the Management ,
, Plan.
11} The Management Plan shall provide a means of dust control for M
the parking area and aacess drive. Traffic shall be '�,, �
monitored by the applicant or an assigned party for the first
year of use. In the event that traffic becomes congested in �,��
the access/parking area, a traffic management plan may be .�
required. Parking for the facility shall be prohibited in the �� "" --
public right-of-way. `! �'
