EAST SOPRIS CREER ROAD VACATION - Mary Lackner, representing the
. Planning Office, summarized this item as a request by John P. ��
- McBride and Leo Ray Light, to vacate a portion oF East Sopris Creek i'
„ Road which traversed their properties along the East Sopris Creek w'' t'.
_ drainage for approximately 6. 1 miles to the United States Forest ^' ��
Service boundary. • �'•:`-•
Lackner proceeded to review a site map of the boundaries with
Commission members.
Lackner proceeded to review the issues of the request as follows:

1. The Planning and Zoning Commission finds that the roadway ' �
- - should be vacated to preserve the ranching operations and wildlife
, resources in the East Sopris Creek Valley.
2. The applicants are concerned that a roadway is detrimental �'. �
ta the cattle ranching operations and erildlife in the valley. The "•
� applicants are also against a public trail through the properties �j
' i as conflicts between trail users and ranchinq would become a '� . ,
problem. �
� 3. The Planning and Zoning Coxrtmission has recognized
� environmental hazards on both the East Sopris Creak Road and Maurin
� Easement would need to be addressed prior to development of either
' road. ReferraZ agencies, the Planning Commission and the Planning ` `
! Office feel that the East Sopris Creek Road should not be for
� vehicular use. �' , ' •
4. If the roadway is vacated, the Planninq office is � .
� concerned that the County is losing a public access goint to publia ',.. '
lands. County staff believes a public trail can be adequately
managed to iimit potential impacts to cattle ranching and wildlife.

Ethridge opened the hearing to public comment.
Sam Caudill proceeded to give a brief history of the East Sopris
'; ' Creek Road. He said he believes it would be a mistake to allow : �
any use on the East Sopris Creek Road because it is a very
sensitive wildlife habitat; mainly a winter range situation. Also, -
there are several ranchexs in the area that depend on their
livelihood, and a road through that area would disturb the cattle -=
, operations in that area. Ae encouraged approval of the request by °
the applicants to vacate the road. �.�
Tim McFlynn, stated, that he is an attorney in town and also 2ives � ,':.�"`�
near the valley where the proposed vacation of the old East Sopris r• .
' Creek Road exists. He said he has been in favor of access to `" �
' public 2ands since he came here four years ago. He said in ;� �
; reviewing the petition, the opposition, the planning and zoning - ,�
commission's remarks and the planning office's memoranduta there was .
the access to public land issue. He encouraged approval of the ;y�ti
` request adopting the recommendation of the Planning and Zoning : �"�
' Commission and vacate the road but do it with the condition ':*; ;.
recommended by the planning office, that a public access trail
r � easement be dedicate@ to the public. ���'''�`�

j Ethridge asked if there were no further pub2ic comment, if there :5
'i was a motion to continue the public hearing on the East Sopzis
Creek Vacation request until November 19, 1991 at 2:00 p.m in the +
afternoon.

iCommissioner crowley moved to continue the hearing to November 19, '" + •
i 1J91. With a second by Commissioner True, the motion passed
' unanimously.
