Reid Haughey, County Manager, stated he was asked by Tom Smith, �?
Special Counsel for the EPA matters, to relay that there is s
provision within the State Superfund Contract that requires that
there be an agreement among all four parties before any remediation
� takes place. Therefore, EPA has had some discussions about doing
limited work this summer, and the point of that is that regardless �,, �
of the current action the Board is considering for the
; Institutional Controls, if the Znstitutional Controls were left in _�y
place, no remediation could forward based on the understandings �.r
� that the parties of come to in the SSC that prohibits the EPA from �'
• ' proceeding unless there is agreement from the City, County, State '�� �
and EPA. However, this does not preclude the EPA from taking some '�'•
other administrative action outside of any current agreements or ; �
former agreements but it does specifically prevent them from going ? '� .

has adopted the institutional controls at this point in time, has �"�
not affeot until the City acts on them.
A discussion ensued with regard to this matter. ` '
Commissionex Tuite moved approval of first readinq and set for V� � '
public hearinq on Auqust 7, 1991 at 5:3o p.m.. With a second by
, ; Commissioner Croaley, the motion passed with four yea votes by .. ,
Commissioners Ethridqe, Crowley, Tuite and True, and one nay vote
by Commiasioaer Ross.
