This year, they have decided that they want to double that amount and increase their releases to 20,000 acre feet. He said this is without benefit of environmental review, and without benefit of several leqal technical issues or approvals that would give them a full right to do this. Plus it threatens the recreational use of the reservoir by drawing it down to the point where it is basically � unusable for many recreational purposes over the next several :;��' , weeks, Therefore, the Ruedi Water and Power Authority is �t� , protesting this, and at their last meeting, they voted to file suit �'' against the Bureau with regard to the release of the second 10,000 .��: acre feet based on their fai2ure to comply with the National � j Environmental Policy Act. That suit has been put on hold pending :�'�,��'� � � an appeal to the Colorado Water Conservation Board which is the _ same agency that would be empowered to approve an arrangement �''�. between the Aivision of Fish and Wildlife and the Bureau of �� � Reclamation to reduce the water. Also, the City of Aspen and Pitkin County have been assigned decrees for the purpose of hydro �; i� . power, and that means legally, the Bureau needs to get the City and �;: . However, she thinks it is the club that needs to be hung over their heads. She said all the City Council . members agree that it is a big issue now of fairness, and feel that � Ruedi should not be emptied in the name of endangered species. ." � • Musick continued by stating, that the City and the County have an option of another lawsuit which challenges the lease entered into by the Bureau of Reclamation with the Water Conservation Board. The City and the County have a siqned agreement which gives them � - a right to the decrees out of Ruedi; that case was enforced in an � :':.y ;� existing piece of litigation. The City and the County won the case in the Supreme Court of Colorado, and stipulated in that case, that •,•.-r: , a number of concessions; one of which gave them the right of �� 1 •�a decrees out of Ruedi. Therefore, the County would be enforcing � something that was bargained for and won. He said those are the .�•i - two lawsuits, one an environmental lawsuit, and the other a lawsuit � to enforce the ternts of the decree. �:.p .• Musick said the environmental lawsuit is not the stronger of the '.d two in terms of the ability to win, and is definitely more ; expensive. The lawsuit on the contract is the stronger lawsuit, �!�. : but it attacks the wrong party. The Bureau maintains, that whether : �.,; . � there is a lease or not, they are going to release the water. He � ; said this lawsuit attacks friends on the Water Conservation Board, and stops them from doing something. The weaker lawsuit on the environmental issues could stop the Bureau of Reclamation, although it possibly could not. In order to avoid litigation, he made a suggestion to the Council ; � , on Monday night, and at this time would like to offer the County a suggestion. He presented a memorandum from him to the Authority and to the City and the County with an attached letter from �`� Commissioner Underwood with this regard. A copy of this document :�!`•� . and the attached letter is made a part of this record as ExSIBIT '� ��A��. Musick said this is the basis under which the two entities ���' could proceed with litigation. He proceeded to review the plan ` � with Commission members. ."�'�"� A discussion ensued with regard to this plan. ���'�, t` i Fuller continued by stating, that the original plans, and the main reason that this became such a big issue, is that the original plan � ,� is for drawing down the 20,000 acre feet, and calls for them to � start the release of the first 10,000 acre feet and over lap that , , with the second 10,000 acre feet from mid August to mid September, and then follow up with the last part of the second 10,000 acre ,.� feet in the latter part of September. So their original plan, • � which they announced last June, would have most of the draw-down �� of Ruedi complete by this time, and the impacts would have been more significant than they were. So the immediate impacts of this year's releases are somewhat mitigated by chance. + •. �.. Another point, if the County gets into a major lawsuit on this . • • � issue, which is one such as John described regarding the decrees • in the reservoir, would affect the validity of the Bureau's whole . _ second round water sales program; which they are just now starting to put together. That is a program whereby they sale water out of . - Ruedi and it is used in downstream mostly by municipalities and . water districts to augment domestic water supplies. One of the �'i points that was made at a meeting last week of the Authority, was that if a monkey wrench is thrown into the second round sales, it : •,�,-��. . would keep the municipalities and other districts from buying i . � • second round sales. For that reason, the Water and Power Authority �. . � decided to attach the second 10,000 acre feet as opposed to taking ;•i - a more broad gauge approach which could have undermined the whole second round sales program and hurt one or more of the members in :i the process. Therefore, this needs to be taken into consideration � when litigation alternative is being thought about. : 2 Musick addressed the issue by stating, that if the Board passes on !� �� litigation involving the first and second round sales, then the �'i;,:: first 10,000 in his judgement, if it is not dead already, would be i ; � killed once and for all, and therefore, it will not be able to challenge those sales and water marketing. And that would mean, that 51,500 acre feet of water of Reudi Reservoir half of that capacity could be released in every year for oil shale, and the ' reservoir from April through September would be no more than half full, and principally during the period of August and September it � � would be down to half full. That in accordance with the replacement releases of 28,000, could mean that the reservoir could be down 20,000 acre feet of water remaining, and if they make the two 10,000 acre foot releases for endangered species, it could be . � dry and the entire habitat lost. And the studies by the Bureau of Reclamation show that could occur a couple of times back to back ,� in 20 years. He said there is a very effective weapon against that .� happening, and that weapon is not litigation, but rather • negotiation with the federal official at the highest level to allow that water to be leased to the City the County water and power � authority as opposed to being used to being drained for oil shale. � ' A discussion ensued. � . i::,. ' ' Konchan said the issues related to this site were primarily ' - � wildlife and floodplain, and they were resolved at the Planning and ' Zoning Coaunission level. The primary portion of the application � '� focuses on a code interpretation that was done by staff in June of 1990. It is her understanding, that at that point in time, staff �..,i����```� was not bringing code interpretations to the Board for endorsement, :• and therefore, she has shown it as an attachment in staff's memo. She said the issue on the code interpretation is whether or - .f not a resort cabin, which is a use that requires special review . , approval, is required to meet density provisions for each cabin on +,s site. Tim Whitsitt, County Attorney, stated that it is his opinion that resort cabins are defined in the code as a temporary use, they are distinct from a dwelling or a unit for continual habitation by a � family or under lease. He thinks they would come closer to ' � something like to a commercial use or a lodge use. .'�. Konchan continued that it is her understanding, that guests will '��,}/ ' come to the site for physical therapy of sorts for arthritic �':Y condition, they utilize facilities on site, i.e, thermal pools, _'!'� etc., and receive treatment for their arthritic conditions. The `�. �� proposal before the Board tonight is to construct new resort cabins ;:` �� . . for the use of these visitors to the facility, and it is a total �,�: of five new cabins, three two bedroom units for a total size of ""� 1100 square feet at their maximum and two one bedroom units will ' � be 550 square feet, and will all be kept to the 12 foot height :. . requirement of accessory structures under the land use code. `` C �. Another part of the application at this point, includes conversion of an existing caretaker's unit on the site to a deed restricted ' Category 2 employee dwelling unit that would offset their employee generation from the facility which was estimated to be 1.6 � employees. With regard to the food service question, the cabins will have ` > �.��� kitchenettes consisting of a sink and a microwave, but not a full �; . . kitchen. Also, some of the meals will be with him and his wife. ;:j There will also be a van service to take people to Redstone, Avalanche Creek or Carbondale if they choose to do so. :� Konchan summarized that it is staff's opinion, that all of the !� issues have been satisfied � i � �; i' Ethridge opened the hearing to public comment. As part of the 1041 1-� Hazard Review there is a request to extend the water line to an 4'� existing nearby residence on a metes and boUnds tract. The � 'j application is being reactivated from 1989, as the Homeowners � '� . Association postponed the request to search for a better site for �+ the water tank. The search was not fruitful, therefore, the F'� t, applicant is proceeding with the original request. The Planning � and Zoning Commission considered the applicant's request on July 16, 1991 and recommends approval. In 1982, Reclamation marketed 7,s350 acre-feet of municipal and industrial water from Ruedi under long-term contracts to western Colorado water users. We are now preparing to market Ruedi's � , , remaining 38,650 acre-feet of marketable water supply in ?�' ! accordance with the preferred alternative developed for the proposed Ruedi Reservoir Round IT (ROUnd ZI) water marketing � program. Ruedi will be approximately 90 percent full with � +: • 93 percent of the maximum surface area available and all public recreation facilities can be used. Although the additional releases may impact private recreational facilities such as the Aspen Yacht Club, the releases will be within the operational criteria defined in the FSES. , w In developing the preferred marketinq alternative with a conservation measures, it was recognized that release of the - 10,000 acre-feet required by the biological opinion may cause some negative impacts to the Fryingpan River and Ruedi. To " • mitiqate those impacts, and any impacts associated with the ' additional 10,000 acre-feet, we will coordinate the operation of i ' G;een Mountain Reservoir with_Ruedi.
