OF PITKIN COUNTY, COLARADO,
RESCINDING AND REPEALING �RDIIQANCE NO. 91-�5� ��
AMENDING TITLE VII, BUILDING REGULATIONS, BY
ADDING A NEW SECTION 7016, PERTAINING TO .
EXCAVATYON AND DEVELOPMENT WITHIN THE �
SMUGGLER MOUNTAIN HAZARDOUS WASTE SITE.

WHEREAS, the Board of County Commissioners has previously

: '''K entered into a Consent Decree with the United States of America in
' �+ connection with United States District Court Case No. 89 Z 1802;

- WHEREAS, the Consent Decree specifically retained for the
� Board of County Commissioners it legislative prerogative with
� respect to the adoption of institutional controls; and
WHEREAS, Ordinance No. 91-05 was originally adopted to
•'=' implement institutional controls through the amendment of Title VII .
of the County Code of Pitkin County; and

WHEREAS, a committee of physicians associated with Aspen
. ;-_Y
�_ a Valley Hospital has recently issued a statement relating to the
;�.s"�� possible dangers of implementation of the institutional controls
as cantained in Ordinance 91-05 ; and

� WHEREAS, the implementation of institutional controls is �
1.,.� contingent upon an agreement to be reached between the United ••
_:.:, States of America and the City of Aspen and those parties have not
•';�
" ! agreed upon a method of remediation of the Smugqler Mountain site.
NOW, THEREFORE, be it ordained by the Board of County ;
- Commissioners of Pitkin County, Colorado, as follows:

Board of County Commissioners is hereby repealed and rescinded and

Section 7016 of Title VII of the County Code o£ Pitkin County,
created and added by Ordinance No. 91-05, is repealed and deleted
from the County Code of Pitkin County.
