Recorder's OCfice. If the approval to renovate and expand the lodge as set forth in said Agteement �•;. , .
I ea�pires and is not extended by Pitkin County,the obligation to grant the Public Trail Easement herein '�
. is null and void and the Public Trail Easement herein shall be vacated by Pitkin County. �� '

. t 4, No Easement For Access. Nothing herein shall be construed to grant an Access or Trail ,t!,

Easement across other propeRy of Grantor in order for individuats to gain access ro the Public Trait � �
Easement. Grantee shall provide and maintain access and trailhead points in order to minimize �
opportunities for entering or leaving the Public Trail Easement. � � .
5. Maintenance.Hold Harmless and Insurance, The parties expressly acknowiedge that the

Public Trail Easement is granted for "recreational porposes", and Grantor is entilled to the benefits, `r`�

protection and limitations on liability afforded by Colorado Law governing recreationa( easements, .�1i , �

including,but not limited to,Colorado Revised Statutes 33-4t-101,et.�eq.,as amended. By granting ��
