' WHEREAS, Pitkin County, Colorado as owner, sponsor an8
operator of the Aspen-Pit}.in County (Sardy Fieldy Airport
1 (hereinafter the "Airport"), does provide various spaces and areas .
� Eor the use of the public and £rom time to time does and shall ' �,
license or permit the exclusive and non-exclusive use oE parts of
these areas to various individua2s, firms or corporations to serve
- the users of the Airport; a»d

� WHEREAS, Pitkin County has the authority to Yegulate
� commercial activities, to license space at the AiYport, and to
; enforce these regulations and to set and collect fees for these �
commercial activities pursuant to, 'ni ter alia, 1973 C.R.S. 30-35-
' 202, 41-4-101 et se ., Title IV of the Pitkin County Code, Section
� 8.7 of the Pitkin County Home-Rule Charter; and

WHEREAS, "off-Airport" rental car companies/operators are
+ defined as those companies/operators located off-airport and not .
; leasing space from the Airport, and engaged in for-profit :
commercial rental of motor vehicles to passengers arriving at the ,
� Airport by air or other ground transportation; and �
� .�
� WHEREAS, in determining the total amount of fees to be charged �
to "Off-Airport" rental car companies the County intends to recover F.; � `
' its costs in the administration, operation, maintenance, and -
� improvement oE the Airport from such commercial activities, and has � ''
� attempted to set fees based on a balance of use of the Airport and .
� convenience to the travelling public as a whole; and ;- �

�� WHEREAS, the County finds that there is ample state and s' � �
� federal legal precedent indicating the legality of the imposition j
. ! of regulations and fees on off-airport car rental companies; and �f

NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY �'.
COMMISSIONERS OF PITKIN COUNTY, COLORADO:
Section 1. All off-airpoYt car rental companies engaging in !,I`
commercial car rental operations through the Airport shall hereby .
be required to enter a Use and License Agreement with the County. � ,
° Section 2� That the fees and charges for entry and use of the
Airport £rom January l, 1991 to December 31, 1992, or for any part I`�.,
thereof, for off^airport car rental companies (hereinafter the �
,-A "Companies"), shall be seven and one-half percent (7 1/2�) of the
' gross revenues or gross receipts to the Companies, or which the �
� Companies are entitled to receive, for the rental of motor vehicles
- to airport customers who enter a rental contract with the Companies
.:,� within fourty-eight (48) hours of arriving at the Airport by means " �,,�., .
( of scheduled cotnmercial airline, scheduled or non-scheduled charter
,.1 aircraft, privately owned general aviation aircraft, commercial
bus, limovsine, or taxi. ,
5ection 3. All off-airport car rental companies engaging in
commercial car rental operations through the Airport shall hereby
be required to comply with the Airport Title V Regulations of the '
Pitkin County Code, and Ground Transportation Rules and
?°� Regulations, and as may be amended from time to time. "
(� Section 4. That the License and Use Agreements between Pitkin
� County, and respectivel.y, Alamo Rent-A-Car, Inc., Colorado Rent-A-
1-; Car, Inc. (Thrify Licensee), and Mountain Express Rent-A-Car, Inc.
which are attached hereto as Exhibits "A", "B", and "C", and �
;� incorporated herein by this reference, are hereby approved and �
� .� adopted according to their terms and conditions.
''� Section 5. That the Chairman (or Vice-Chairman) of the Board �
of County Commissioners is hereby authorized and directed to �
1 execute this ordinance, and the subject Agreements on behalf of the {
County and any other documents nacessary to accomplish the �
transaction, which documents haVe been approved as to fo1-sn by the (
County Manager, Director of Aviation and County Attorney. r. .
