�''�� 1. Currently Section 6-2.1 of the Home Ru3e Charter provides that all �•
prospective candidates for elective office file their petitions with the County Clerk not
�} more than sixty(60)days nor fewer than forty-�ve(45)days before the primary election. �

2. Ctirrently Section 6-4 of the Home Rule Charter provides that all issues to
�� be piaced on the primary ballot or a special election ballot be submitted to the County
Clerk at least thirty (30) days prior to a primary or special election and all issues to be
placed on the general ballot shall be submitted to the Clerk at least fifty (50)days prior �
- to the general election. �;

3. Colorado Revised Statutes Section 1-6-2Q1 and 1-6-202 state that the :
� Secretary of State shall give notice to each County Clerk at least fifty(50)days before the `:
- primary and general elections of ali offices for nomination. r .

4. Colorado Revised Statutes Section 1-8-113 requires that the County Clerk =
make absentee ballots available at least thirty(30)days before all congressional elections,
" - primary or general elections.

5. Colorado Revised 5tatutes Section 1-&118.7 requires that the County Gerk
� ' provide a list to citizens outside the United 5tates of ali candidates who have quali�ed for
�' the baIlot by the 60th day before the election and a 3ist of all measures which are to be

�,� 6. The requirements of the Home Rule Charter and State statutes upon the
County Clerk are divergent and conflicting. ��

7. To ailow the Clerk to more easily comply with C.R.S. Section 1-6-201, 1-
� 6-202 and 1-8-113 and realistically comply with Section 1-&118.7,it is necessary to amend � ,
Sections 6-2.1 and 6-4 of the Home Ru1e Charter to require earlier submission of petitions �
for candidacy and election issues to the Clerk and Recorder. � ` ;�

� changes that the State legislature may promulgate.

� NOW,TF�REFORE,BE TT RESOLVED by the Board of County Commissioners
of Pitkin County that the following question shall be placed on the ballot for the primary � '
election to be held on August 11, 1992: i':

- - REPEALING AND REENACTING SECTIONS 6-2.1 AND 6-4 OF THE
PITKIN COUNTY HOME RULE CHARTER . i

� � Shall Section 6-2.1 and Section 6-4 of the Pitkin County Home Rule Charter
' ! - be repealed and reenacted as provided in this Resoluiion No. 92 - to �

� . provide for earlier submission to the County Clerk of candidate petitions

4 4 BE 1T F[JRTHER RESOLVED, that if a majority of the registered qualified
+�`y.� electors voting thereon vote for the purposed amendment,the Pitkin County Home Rule
Charter shall be immediately amended as follows:
Section 6-2.1. All candidates for elected of�ice must file petitions with the
.,,��; Clerk and Recorder for such office not earlier than twenty (20) days nor
' later than five (5) days before the deadline established by state statute for
_ the Secretary of State to transmit to each county clerk and recorder the
notice of primary election.

Section 6-4 Other Election Issues. The deadiine for submission to the Pitkin
County Clerk and Recorder of all issues to be placed n a primary, general, or �
��� congressional vacancy election ballot shall coincide with the corresponding deadline
