pursuant to Section 4-4 of the Land Use Code; and
�, �¢SERSAS, the roadway heing considered for vacation is shown
� �t as Fir Drive on the Xistler Subdivision Plat recorded in Plat Book

' WHEREAB, the Planninq and Zoning Commission (hereinafter

`� "Commission") considered the applicant's petition at a regular
, meeting on March 3, 1992 and recommend approval of the vacation to ?`
�.� the Board of County Commissioners (hereinafter "Board"); and

� WHEREAB, the Board considered the applicant's request at a
�� duly noticed public hearing on March 31, 1992 at which time heard �

evidence and testimony regarding the applicant's petition; and
ASEREAB, the Board has found that Fir Drive has never been
� $� developed as a public access and therefore public ingress and

egress along Fir Drive will not be effected; and

,�; WHERF.AS, the Redstone Master Plan identified Fir Drive as the � �.
location of vertical trail access from Redstone Boulevard to Yhe
�':� Crystal River. There was public concerns that if Fir Arive is

� 4, vacated there would be no ability to obtain public trail access to i
At . the river. The Applicant stated on the record in the puhlic �

�:? hearing that he is willing to give a trail easement along Elm ` )j
