:� 1. Grant of PedestrianlBi�cle Trail Easement. Grantors hereby erant '{,
e;t to Grantee, a perpetual, non-exclusive, non-vehicular pedestrianlbicycle trail
easement and right-of-way being twenty feet (20') in width in either of the
�.�$ approximate locations (Desi�nated "Road" and "Ditch" trail alionments on the
�� attached Exhibit "A"), or some combination of those locations, as shown on � '
Exhibit "A". It is understood by the parties that there will only be one final ' �
easement alianment, and that the alternatives shown on Exhibit "A" will be ��tr .
�� etiminated upon the mutual determination of a final easement alignment. This _

3. Grant of River Access Easement: Grantors hereby grant to Grantee

hereby also grants a river access easement on the South Side of the Roaring Fork ;;•

� 4. Grant of In-River Fishing and Boatin� Easement. Grantors hereby �.7_..'_

described above, upon their completion, Grantee will be responsible for r �
construction and maintenance of the above described facilities in accordance with

- � wi11 be responsible for constructing facilities in a safe, stable and aesthetically-
�• acceptable manner. Facilities will include vegetative screenin;,fencing, gates and `
'�_- signage to the extent necessary to direct use and shield facifity impacts from
-'� adjacent uses and residences. Any and all liability associated with the construction
� and use of the above-described facilities will be borne by the Grantee. - `�•
