partnecship, hereinafte� refecLed to as "GLantors" and THE

� WHEREAS, the Gcantors have developed the Altamira Ranch

! Low-Impact Subdivision and the Final Plat for said Subdivision g.,

� ;.� WHEREAS, by said Final Plat the Grantors cLeated a Recrea-
+�!�'{ tional Easement five feet in width alonq the Roaring Fotk Rzver
,.:� within said Subdivision designed to allow fishecmen to qo up
�.� and down the Roacing Fock Rivec; and,

WHEREAS, the establishment of said Fishinq Easement was ene -
of the conditions of the cesolution of the County appLOVinq
said Subdivision; and,
�;i WHEREAS, in exchange foL said Fishinq Easement the County
has aqteed to indemnify and save the Grantocs hacmless fcom any S
� and all liability by reason of the publics use thereof. 4,

3. LIABILTY AND MAINTENRNCE. The parties expressly
acknowledqe that the Grantor is entitled to the benefit, pro- . -

i WHEREAS, the Ownets have developed the Alttamita Ranch Low `'�
Impact Subdivision and the final plat for the Subdivision has
been apptoved by the County; and,
�' WHEREAS, by [esolution of the County dated DecembeL 4,
1990, one of the conditions of such app=oval required that the
applicant ptovide access foc purposes of flood contLOl and bank I
_ stabilization alonq the Roatinq Eotk Rivec accoss and thcough

� WHEREAS, such flood control and bank stabilization is �'
incotpotated in the Basalt Rivec Stabilization Plan which has
w x�, � been developed putsuant to a qoveLnmental aqteement between
Eagle County, Pitkin County, and the Town of Basalt, which plan
is based upon a plat on file in the Pitkin County Enqineers '
Office; and,

WHEREAS, to implement such plan it will be necessary to qo
accoss portions of Lot 1 of said Subdivision and use the btidqe
accoss the Roacinq Fock River from State Hiqhway 82 as shown on
