RECITALS

�� 1. WHEREAS, at the time disciplinary action was taken by the County '';'�;
Manager against Gary Lyman, Lyman was employed with Pitkin County and entitled to '
the bene6ts and protections contained within the Pitkin County Personne] Policies and �=�
• Ptocedures Manual; and
2. WHEREAS, Gary Lyman �vas subject to action taken against him in a �'
Memorandum dated November 24, 2992, sent to him from Reid Haughey and Amy `
�':=;�
Margerum; and :�*;.
3. WHEREAS, following this action, Gary Lyman filed a notice of appea] and
� was accorded a hearing before the Personnel Review Board Appeal Committee pursuant
to the requirements of the Pitkin County Personnel Policies and Procedures Manual as
( adopted by the Board of County Commissioners; and
�
� 4. WHEREAS, after a hearing Uefore the Personnel Review Board Appeal
� Committee, the finding and recommendation of that committee was to uphold the action "
� of November 24, 1992; and
,i 5. WHEREAS, the Board of County Commissioners has reviewed the record
�� � of proceedings before the Personnel Review Board Appeal Committee including a
-� � transcript of the hearing and exhibits submitted therein and the Board of County �
i Commissioners has rec�uested and received additional information from the County
', Manager and Gary Lyman in the form of a ietter from Thomas Smith dated February 19, �
� 1993 and a )etter from Jerre Dixon dated February 22, 1993; and ,°�'

� NOW TI-IEREFORE, Ue it resolved by the Board of County Commissioners of �,� � �=
Pitkin County,Color�do th�t it hereby rejects the decision of the Personnel Review Board � j
