RECITALS '�,
' 1. WHEREAS,The Brush Creek Water District is a Colorado special district
created pursuant to Tide 32,Article 1,Part 2,Colorado Revised Statutes for water service

purposes; and ' �

2. WHEREAS, the Brush Creek Water District desires to convert to a
metropolitan district,which invotves a modification to the existing Service Plan to provide ' �
� � to the DistricY services of parks and recreation, sanitary sewer and road maintenance in
iaddition to existing water service; and ,�
: 3. WHEREAS,the Brush Creek Water District has submitted a petition to the i,,,,�
' Board of County Commissioners seeking apprava] of a modification to the Service Plan ':�""=
; of the District to include these additional services; and
� 4. WHEREAS,pursuant to Colorado Revised Statutes,§32-1-207(2),the Service
� Plan for the District may not be materially modified without the approval of the Board ,q.
� of County Commissioners of Pitkin County; and
. � Y
5. WHEREAS, modification to the Service Plan is required to allow the
__� conversion of the Brush Creek Water District to a metropolitan district; and
� G. WHEREAS,in accordance with the provisions of Co]orado Revised Statutes,
•� §32-1-207, the Brush Creek Water District has satisFied the processing fee for the
� modification of the Service Plan.

NOW, TH�REI'ORE BE TT RESOLVED, that the Board of County
Commissioners of Pitkin County, Colorado,does hereby approve the$rush Creek ViHage ��
Water District's modification oE its Service Plan to provide services of parks and �(',
recreation, sanitary sewer and road maintenance in addition to water services for the ''�:� ,
purpose of converting to a Metropolitan District. �}' �^'`
