� NoW, THEREFORE, HE IT RESOLVED by the Pitkin County Board of �..� '
iCounty Commissioners that it hereby grants a five year Special Use
Permit with annual reviews subject to the following conditions:

� � 1. Prior to commencement of prospecting on Site 2 of the White
� Banks mining claim, the applicant shall submit a revi'sed
application for a prospecting permit. The application shall
. be submitted upon completion of design concepts for access to
� the site. `

; 2. This special review use permit approves an operating plan for
' Site 1 of the White Banks mining claim, through the end of the '�
' 1996 operating season; The mining operation shall be subject ;'��
� to an annual review for compliance with original conditions
' of the special use permit, as contained within this
- resolution, and for any additional conditions which may be
required as a result of the annual review. The first annual
,� review before the Pitkin County Hoard of County Commissioners
shall occur one year from the date of signature of this
' resolution by the Board Chairman, and annually thereafter �
r through the end of the 1996 operating season.

_ 3. Mining operations shall be limited to the period from May 1
to November 14, annually. ;,
� 4. By October lo, 1993, the applicant shall complete surface
�� operations in order to minimize noise and visual impacts
_:� associated with the mining activity; The applicant shall •
complete electric line installation (for the purpose of
providing power for mining equipment which will initially be
powered by a gas powered generator) , perimeter landscaping
for screening purposes (as required by the Forest Service) and �
� allowed fencing (as required for safety by the Forest Service �`
� �;�;;
and other State or Federal regulating agencies) . �1, r�

5. No more than 50 tons of product shall be stored on site and �r' , -
1 no more than 25 tons of Alabaster shall be produced daily �;'� . I

hauling of ore or waste material shall be the equivalent to "-
a Ford F-350 6.9 liter diesel, utilized at times with a 26
foot fifth-wheel trailer. This vehicle shall not carry more ��'�T �
than 8 tons of ore or waste material. '�'::: �'.

6. This permit allows use of the following equipment for mining 'T':`' :
operations: a skid loader, gas powered generator, diamond and �,�:`-:
carbide chip chainsaw, hydraulic hose, water line, an 800 and
300 gallon portable plastic water tank (capacity may be varied
at the request of the Carbondale Fire Chief), storage shed,
I shovels, rakes, pry bars, winches, jacks, hammers, and various
� hydraulic tools. �"�

� i 7. The settling pond shall be no larger than 6' x 6� x 3' (unless
enlarged on the recommendation of the Environmental Health ,�,�,
Department) and shall be lined with concrete and grout. The i
pond shall be covered with a hard surface capable of
supporting an adult person's weight. In the event that the r:
pond freezes, no operations engaging the saw shall proceed. �;
In the alternative, the applicant may provide a pond heater
;- to heat the pond to prevent freezing. �.s,

� 8. All equipment, except for the water tanks, shall be stored
after working hours in a locked shed.

�' 9. There shall be no temporary or permanent residential use of
the premises.

10. Hours of operation shall be as follows: 8:00 a.m. to 6:00 p.m.
Monday thru Friday; No mining shall occur after 5:00 p.m. on �
� Friday, however blocks of alabaster may be stacked, loaded �a
_� and moved until 7:00 p.m.; operation on Saturdays shall be
� restricted to stacking and loadinq of alabaster, and to five
� round vehicle trips per day, with no mining activities
� allowed. During the period from June 15th to September 15th
� � annually, Saturday operations shall be limited to the stacking
:` and loading of alabaster. No mining shall occur and no •
! transportation to and/or from the mine shall occur, except as
'! required to transport employees to stack and load alabaster.
� No work of any kind shall occur on Sundays or on Holidays or ,�
� Holiday weekends from noon Friday to 8:00 a.m. the following �j
.� Tuesday. ,

11. There shall be no more than 5 employees operating the mine �. ,m,,

14. The Environmental Health Department shall monitor the mining ��r:,

� regulations regarding water provision and quality and health �
j and safety issues. The applicant shall modify operations to -'�`
;: comply with regulations if necessary, as recommended by the '`�
� Environmental Health Department and the U.S. Forest Service- �.�f

!; 15. Prior to commencement of mining activities the applicant shall
obtain an air pollution emissions permit from the Colorado Air �:i,���
Pollution Control Division, if required by the State. The
r applicant shall use maqnesium chloride to control road dust
� to the extent it is deemed necessary by the USFS and/or the �:�.
County. "
`'� 16. Burning of construction materials and/or downed trees shall t:✓;�a

� 17. The operation shall comply with the County Noise Abatement
Ordinance, as amended, during the life of the operation.
' is. The applicant shall supply a water storage tank with a minimum f
capacity of 300 gallons for structure protection. The water �, �

_j 19. The shed shall incorporate landscaping with wildfire `

r • a. Brush, debris and non-ornamental vegetation shall be

trimmed and branches removed within 15' of the chimney.
c. Non-combustible roof material including, but not limited �r'�

21. Any utilities shall be buried. The address shall be clearly
marked and visible with min. 2" letters.
22. The following zoning regulations shall be complied with:
a. To the maximum extent possible, all signs shall comply '`�Y�
with Section 5-500 of the Land Use Code except as they ��"� �.
conflict with USFS or OSHA standards. '

b. All structures shall receive building permits, or
building permit exemptions, as required by the County. ; .
c. Any fencing six feet in height or greater shall require �� �j,
- a building permit and shall meet setbacks.
d. With the exception of the quarry, excavating permits
shall be required when 50 cubic yards or more of fill or
excavated material is to be removed. � `,1

a. The working face of the mine shall be stained a brown
color at the end of the construction phase to blend with the �4
