WHEREAS,Grantor is the owner of certain real property in Pitkin County, �`�
Colorado,more fully described in the attached Exhibit A,which property is traversed by � • .
� the Roaring Fork River{hereinafter referred to as"the Proparty"); °'

NOW,THEREFORE,for Ten Dollars($10.00)and other good and valuable �y `
consideration,the receipt and offering of which is acknowledged,and in consideration of D
mutual covenants and conditions contained herein,Grantor agrees as fo►(ows: „

1. � Graator hereby grants to Grantee a non-exclusive easemeni r�
for tl�e purpose of public fishing in the Roaring Fork River where the same traverses
_ property owned by the Grantor. This easement shall extend to five feet{S')above the °
high water mark oii the Property along the bank of the said river. ?

" 2. No Easement for Accesc Nothing contained herein shal!be construed �
`I� to grant an easement across any of tlie remainder of the Property owned by the Grantor
for ingress and egress to the Roaring Fork River or for access to or from any other � �'�
property or otherwise. This easement is solely for fishing by the public along the course �
of the Roaring Fork River and shalt be strictly construed. ?
3. No interfeXence The exercise of rights granted hereunder shall not �
�q' unreasonably interfere with the use of the property burdened thereby.

4. Maintenance Hold Harmle s and In urance The parties expressly
ac[cnow(edge that Grantor is entitled to the benefits,protections and limitations on
liability affarded by Colorado law governing recreational easements,Section 33-41-101,
�t se�.,C,R.S. $y granting the easement hereunder,Grantor shall have no additional
obligation to regair,clear or otherwise maintain the area within the easement,including
without(imitation the river and banks along the river witl�in five feet(5')above the high
water mark,or to insure or indemnify the County for any injury,claim or damage to any "
parson or property,whether alleged to have occurred while using the easement for fishing '
purposes or otherwise and due to tlie condition of the river or its banks or otherwise.
By accepting the easement granted hereunder,the County agrees to add Grantor as
a co-insured on any policy or[iability insurance carried by the County and inswing �
against claims or losses for injury to any third person using or occupying the easement, � �
