. The parties entered into a contract dated July 1, 1995, more fully described below.
This contract is being amended to shorten the end date of the contract from June 30, 1996
to April 26, 1946 and to decrease the maximum amount payable to (SIX THOUSAND
BOLLARS)$6,000.00.
NOW THEREFORE, it is hereby agreed that for and ia consideration of their
mutual promises to each other, hereinafter stated,the parties hereto agree as follows:
1. It is expressly agread by the parties that this contract is supp(emental to the Original
Contract Number AIR 11 Rou�ng Number 1 I dated July 1. 199� referred to as the
"Original Contract"which is by this reference,incoiporated,made a part hereof as Exhibit 1,and
ail terms,condifions and prowsior�s thereof, unless s�ecifically modified herein,are to apply to
this Amendment as though they were expressly re-wntten, incorporated and included herem,
2. It is agrced that the Original Contract is and shatl be modified,altered,and changed
in the following respect only:
a. Delete in paragnph 4 of the original contract"June 30, 1996"and substitute
"April 26, 1996" m its place.
b. Delete in paragraph 2 of the original contract"(NINETEEN THOUSAND
DOLLARS} $19,000.00" and substitute "(SIX THOUSAND DOLLARS)
$6,000.00"in its place.
c. Both parties agree that the Contractor has provided the following deliverables
for the dme period of July 1, 1995 through April 26, 1996 and that the
amended contract amount of$6,000 is adequate compensation for the work
performed by Contractor:

5. Except for the "Special Provisions," in the event of any conflict, inconsistency,
variance or contradicUon between the provisions of this Amendment or any of its attachments or
exhibits, and any of the provisions of the Original Contract, the provisions of this Amendment
shall in all respects supersede, govem, and control. The "Speciat Provisions" shatl aiways be
' wnirolling over other provisions m the contract or amendments. The factual representations in i,. .
the Special Provisions conceming tha absence of bribery or corrupt influences and personal :
interest of State employees are presently reaffirmed. '
6. FINANCIAL OBLIGATIONS OF THE STATE PAYABLE AFTER THE
CURRENT FISCAL YEAR ARE CONTINGENT UPON FUNDS FOR THAT PURPOSE BEING
APPROPRIATED, BUDGETED, AND OTHERWISE MADE AVAILABLE.
7. THIS AMENDMENT SHALL NOT BE DEEMED VAL[D UNTIL IT SHALL
HAVE BEEN APPROVED BY THE CONTROLLER OF THE STATE OF COLORADG OR

the use and benefit of the Department of Public Health and Environment, Air Pollution Control i
Division (APCD), 4300 Cherry Creek Drive South, Mail Code APCD-ADM-$l, Denver,
Colorado 80222-1530,hereinafter referred to as the State,and Board of County Commissioners, F

"Contractor".
WHEREAS, aathority exists in the Law and Funds have been budgeted, appropriated and
otherwise made available and a sufficient uncommitted balance thereof remains available for
encumbering and subsequent payment of this contract under Encumbrance iVumber,�-R9694t5- �"'

WHEREAS,the required approval clearance and coordination has been accomplished from and
with appropriate agencies; and
, WHEREAS, the State, Air Pollution Control Division, has avai(ab[e funds to maintain an
Automobile Inspection and Readjustmeni(AIR)Prognm;and
WHEREAS,a need was indica[ed for an AIR Program serving the residents of Pitkin County
in that the local health officials identified an increasing air pollution problem associated with
mo[or vehicles. Pitkin County elected to adopt an A[R Program as part of its commitment to
improve air quality;and
WHEREAS, the State, Air Pollution Control Division must provide support for AIR Program �
activities.
NOW THEREFORE,it is hereby agreeci that,for and in consideration oE their mutual promises
to each other, hereinafter stated, the parties herero agree as follows:

1. The Contractor shall provide to the State the services and products as set fonh in the Scope
of Work, the Policy and Procedures Manual and Air Quality Control Commission (AQCC) � �'
Regulation No. 11, by this reference made part hereof as Attachments "A", "B", and "C", .'`:

2. The State shall, in consideration of said services and producu provided by the Contractor,
outlined in Attachment"A",Scope of Work, Attachment"B", Policy and Procedures Manual,
and Attachment"C",AQCC Regulation No. I1,cause to be paid to the Contractor a sum not �'°

3. Reimbursement shall be made upon receipE by the State of signed statements requesting

1. INTRODUCTTON

Zn that a need was identified £or AIR Proqram impleme»tation , �';:
and maintenance serving the residents of Pitkin County, the -
Pitkin County Commissioners, and the Colorado Department of .- ':
Public Health & Environment, Air Pollution Control Division, ;
are entering into this agreement in support �f such a proqram. s. .
Due to the remote nature of the area covered by this
agreement, it is most cost effective for Pitkin County
Commissioners (or designate) to administer local asgects of
the program. �Y' �
2. SCOPE OF WORK �
The Contractor shall conduct ,all AIR Program activities in �
accordanae with the Policy and Procedures Manual, Attachment �
"B", and in accordance with the Requlation No. 11 of the AQCC,
Attachment "C". These services would include, but not
necessarily be limited to:
The Contractor shall honor all requests for
. courtesy AIR emissions tests.
The Contractor shall be available for
consultation with licensed stations and
mechanics with regard to
- emissions system verifications
- engine ohange verifications �
- determination of applicable idle test, �
emissions control equipment and visible
smoke requirements
- repair analysis .
- lead in gasoline determination
� In facilitating these activities, the
Contractor shall make use of established
technical centers at the Roaring Forks
Technical Center and Pitkin County Public
Works Fleet Management Section.
The Contractor shall submit quarterly reports
with respect to services rendered, persons or
agencies contacted and related expenditures
for that quarter. •
The Contractor shall employ no person who is
employed as a licensed emissions mechanic or
who is employed by a facility licensed to
conduct inspections. �

The Contractor shall administer AIR Proqram
Mechanic Certification tests as necessary. ��-
The Contractor shall be reimbursed at the rate 9: �-"
of $8.00 per test adrainistered to a maximum of
$400.00 for the term of this Contract. In ���r .�
order to expedite grading, the tests will be ;�'
transmitted to the West Denver Emissions �: - �
Teahnical Center via FAX machine, followed by �` .

the automated mechanics' test grading system.
The person or persons performing AIR Proqram
support functions are to be trained and,.
recognized by the Colorado Department of

the security of the test analyzer system (TAS) t
access codes such that this informatzon is �
available to only the Contractor and designee. �
The identity of the Contractor's designee is �
to be provided to the Colorado Department of
Public Health & Environment and updated when "
possible.
The Contractor shall provide for the services
outlined in the Policy and Procedures Manual
• and noted in this Scope of Work utilizing the �
available funding for the duration of the t
Contract, such time to be split between areas ;
based on demand. No coverage is expected on �•
