SUMMARY OF REQUEST: The Applicant has requested approval of an Activity Envelope to
accommodate a single family residence.
The BOCC conducted a site visit on September 24, 2012.
Staff has opted to forward this application to the BCC for consideration and decision, since it is one of
four applications submitted for adjacent parcels in the Lenado area that are all being reviewed
concurrently.

ZONING/LOT SIZE: RS-20/35.249 acres
BACKGROUND: The Applicant recorded a 35+ acre subdivision exemption plat for the Hidden Treasure
Parcel in Plat Book 99 at Page 73 (4/3/201 ' ). The parcel contains the remains of a cabin built in the l 890s,
which is referred to at the Herron Cabin.
ACCESS: The proposed Activity Envelope is accessed from Larkspur Mountain Road on an existing
driveway that serves Parcel One of the Silver Creek Subdivision. 1'he initial portion of the driveway from
Larkspur Mountain Road to the Hidden Treasure Parcel crosses USFS land, the Applicant has not provided
documentation of legal access across the USES S land.
REFERRAL COMMENTS: The Woody Creek Caucus [district Planning Commission states, "We have
no objections to the subject applications for activity envelopes I including the Hidden Treasure Parcel
application], as long as there is compliance with all applicable code provisions." Suzannah Reid, Historic
Preservation Officer, submitted comments that are addressed below. Comments are attached for reference.
GMQS EXEMPTION: The 35+ acre parcel is nem. ly and legally created under the State's Subdivision
Exemption provision. A newly created parcel must either compete in the Growth Management Quota
System (GMQS) to obtain a floor area allotment for the parcel.. or demonstrate that the parcel is exempt
from GMQS.

The Applicant asserts that the 1 Ierron Cabin on the parcel was built in the 1890 s, and, therefore, is an
"existing, pre -zoning, pre -building permit. pre-GMQS regulations legal cabin on a 35 acre parcel. County
policy allows for a Building Right of 5,750 square feet exempted from G M ."
Staff agrees with the premise that the existence of a residential structure that was built prior to June 12,
1978 (adoption of growth management regulations) would confer a development right that would potentially
allow a replacement residence of up to 5,750 square feet on a new 3 5 + acre parcel in the R - 0 zone
district. However, in this case, the Herron Cabin is a complete ruin, as shown in the photographs in the
application. The GMQS exemption for replacement in the Code allows replacement of a "legally created
structure." While the Herron Cabin may have been legally created* it no longer complies with the Code
definition of a "structure."' Staff cannot support the request to utilize a ruin to establish a development right
exempt from GM.
ACTIVITY ENVELOPE REVIEW: The property includes steep slopes to the north of Larkspur
Mountain Road and steep slopes to the south of Woody Creek Road. with an area in the middle along
Woody Creek. The proposed Activity 1 }nr elope is sited in a meadow below Larkspur Mountain Road and
the driveway to the Silver Creek Subdiv isioii and above woody Creek. The Aeti‘ it\ I An), elope Review
establishes where development )-nay occur on the property in compliance vs ith the Code and in conformity
with the applicable Comprehensive Plan. After an Activity Envelope is approved, the Applicant is required
to apply for and obtain approval of a Site Plan, prior to submission of a building, pen -nit application.
Wildfire: The Activity Envelope is within a low wildfire hazard area in a meadow. The Applicant shall
comply with the applicable wildfire hazard mitigation standards of the Code,
Slopes: The Activity Envelope is comprised of slopes of less than 30%.
Wildlife: The parcel is within elk and mule deer summer ranges, where development is permitted by the
Code. Development of the parcel will have minimal impacts on wildlife.
Floodplain: The floodplain for Woody Creek is not delineated. I he application stares, "To the best
knowledge of the applicant. the ActiN its' Envelope lies outside of an) mapped 100 year floodplain," Where
the floodplain has not been established, the Code requires that development avoid all lands within an area
20 horizontal or five vertical feet from the existing high water line, %\ h ichev er land area is greater. The
proposed envelope is more than 20 horizontal feet and 5 vertical feet from Wood, Creek.
Geologic Hazards: The Count'' s geologic hazard maps show potential avalanche areas on the steep slopes
on the north and south portions of the parcel. There is also a mapped alluvial tan in the middle of the
property. The application states, ..The 1041 Geologic Maps do not show and geologic hazards that impact
the Activity Envelope or existing driveway,- The Applicant does not specifically address the potential
avalanche and alluvial fan hazards. without further information, stair cannot determine (1) if the Activity
Envelope complies with Sec. 7 20 50(a) of the Code, N.N hieh prohibits development in high/red hazard
avalanche zones and only permits development ire moderate/blue hazard as. alanchc zones if there is no
alternative location that avoids the moderate hazard zone, or (2) it'theActiv it) 1 yn, elope complies with Sec.
7-20-50(d) of the Code, Which only pen -nits development within an alluvial tan if there is no area on the
property that avoids the alluvial fan.
River and Stream Corridors: Woody Creek runs through the parcel. The Activity Envelope maintains a
100' setback from the Woody Creek, as required by Sec. 7-20-80 of the Code.
Historic Resources: The Applicant states that the Herron Cabin on the parcel was built in the 1 90s. The
Applicant has not proposed to list the cabin on the Historic Inventory or designate it to the Historic Register.
Suzannah Reid, Historic Preservation Officer, states that the "cabin is a complete ruin and has no historic
significance or integrity remaining. The remains of the Herron Cabin are not eligible for designation to
either the Register or the Inventory.,} She adds that the proposed Activity Envelope does not have a
negative impact on historic buildings.
RECOMMENDATION: ATION: Staff recommends that the ROCC deny the Hidden Treasure Activity Envelope
and GMQS Exemption, subject to the attached Resolution.

RECITALS
I. Lenado Twelve, LLC ("Applicants") has applied to the Board of County Commissioners of Pitkin
County, Colorado ("BOCC") to establish an Activity Envelope and obtain a (IroiNth Management
Quota System (GMQS) Exemption to construct single-family residence.
. The property is located off of Larkspur Mountain Road, is referred to as the 1 Iidden Treasure Parcels,
and is more specifically described in Exhibit A
3, The parcel contains 35.25 acres and is a contrrrking size lot in the IDS-0 zone district.
4. The Applicant recorded a 35+ acre subdivision exemption plat for the l lidden Treasure Parcel in Plat
Book 99 at Page 73 (4/3/2012). The parcel contains the remains of a cabin built in the 1890s, which is
referred to as the Herron Cabin,
5. The Applicant asserts that the Herron Cabin establishes a development right of up to 5,750 square feet
of Boor area on the parcel because it iN.as built in the 1890s. prior to the adoption of coning, building
and GMQS regulations.
6. The BOCC considered the proposed application at a duly notieed public hearing on October 10, 2012.
7. The BOCC finds that the Herron Cabin is a complete ruin that does not comply \ ith the Land Use Code
definition of a "structure,- and, therefore. is not eligible for a GMQS exemption for replacement of a
"legally created structure.- Since the parcel is not eligible for an exemption t'rom GMQS, then the
Applicant must compete through the GMQS for a floor arca allotment for a residence on the parcel.
8. The BOCC further finds that an Acti\ ity hnvelope cannot be established on the parcel until a
development right is obtained.
NOW, THEREFORE, BE IT RESOLVED by the 13OCC that it hereby denies the Hidden
Treasure Parcel Activity Env elope and CAWS Exemption.

The town site of Lenado is unquestionably an important historic site in the County. It provides a unique
challenge in terms of what and how to preserve the important characteristics of the development in this
area.
In 2011, all of the existing buildings in Lenado were reviewed, and an overview of each structure was
created. When looked at as a whole, three general historical trends were identified. Those are: Mining
(1881-1917), Sawmill Era (1937-1975), and the Hippie Era (1970 -1975). The Sawmill Era is a trend
unique to Lenado, The Hippie Era is not unique to Lenado, but this is the highest concentration of that type
in the County. A small number new buildings have been built after 1975, but were not made part of the
historical investigation. While the initial investigation is a cursory one, there is no doubt that the Town site
of Lenado has historical significance.
The proposed Hidden Treasure Activity Envelope contains the remains of the Herron Cabin from the 1880s
and related to the Mining Era. This cabin is a complete ruin and has no historic significance or integrity
remaining. The remains of the Herron Cabin are not eligible for designation to either the Register or the
Inventory.
The proposed activity envelope does not have a negative impact on historic buildings.

The property is located in Pitkin County in the unincorporated town of Lenado, near the
end of Woody Creek Road, is approximately 35.25 acres, platted in Plat Book 99 at
Page 73 at Reception #587938, and is zoned RS-20. The property has one existing, pre -
zoning, pre -building permit, pre-GMQS regulations legal cabin, i.e. The Herron Cabin
as shown on the maps. Based on the Affidavits in Exhibit 2 by Daniel Delano and
Frank S. Peters, owners of the property, The Herron Cabin was built around the 1890's
as the cabin is identified on an 1893 USGS topographic map as shown in Exhibit 2.
Zoning and Building Permits in Lenado were first adopted by Pitkin County in 1975
based on BOCC Resolutions & Zoning Maps provided by Joanna Schaffer. GMQS
regulations were adopted in 1978. Based on adopted County policy, an existing, pre -
zoning, pre -building permit, pre-GMQS regulations legal cabin on a 35+ acre parcel
has Building Right of 5,750 square feet exempted from GMQS. This County policy is
referenced on Page 2 of the BOCC Memo, June 23, 2010 by Cindy Houben,
Community Development Director, given in Exhibit 3. Based on this adopted County
policy, applicant requests a Building Right of 5,750 square feet exempted from GMQS.
The property includes three distinct zones with different physical characteristics: valley
floor riverbed, low slope valley floor, and steep hillside. Woody Creek passes through
the middle of the parcel. Woody Creek is a year round mountain stream that occupies a
primary channel within the riverbed. The riverbed is separated from the rest of the
valley floor by small banks. The valley floor consists of relatively moderately sloped
areas of meadow and forest. Beyond the valley floor areas are steep hillsides. Where
these hillsides are predominately south facing they are largely vegetated with dry
grasses, shrubs and scattered areas of Aspen and Evergreen trees. Where these
hillsides are predominately north facing they are largely vegetated with Evergreen trees
with limited undergrowth. This parcel includes both sides of the valley, and thus
includes both exposures.

The Activity Envelope is on the valley floor between the riverbed zone and the steep
hillside zone. The driveway is an existing driveway that provides access to two other
parcels. It connects from Larkspur Mountain Road, just past the Woody Creek Bridge.

The applicant is applying for Activity Envelope approval under the County's
administrative review procedures of the Code for a lot conforming to the zoning criteria
for the RS-20 zone district.
2. Section 6-30-110, GMOS Exemption
Herron Cabin is an existing, pre -zoning, pre -building permit, pre-GMQS regulations
legal cabin located on a 35+ acre parcel. County policy allows for a Building Right of
5,750 square feet exempted from GMQS.

The Activity Envelope occupies a gently sloping meadow located on the valley floor
between the river bottom area and the steep hillsides. Most of the slopes are between
15% and 29% as shown on the Slope Diagram.
4. Section 7-20-10, Site Preparation and Grading
The Activity Envelope is located on gently sloping ground and is accessed by an
existing driveway. Site preparation and grading will be determined by the location of
structures within the Activity Envelope and plans will be submitted at Site Plan
Review.
5. Section 7-20 20, Steen and Potentially Unstable Slopes
A large portion of the parcel includes slopes in excess of 30% characterized by the
steep hillsides that form the Woody Creek Valley. The Activity Envelope and existing
driveway are located to avoid the steep slopes and potentially unstable slopes. There is
no known slope instability in the area where the Activity Envelope and driveway are
located.
6. Section 7-20-30 & 80, Water Courses and Drainage,
River and Stream Corridors and Wetlands
Woody Creek crosses the property. The Activity Envelope and existing driveway are
setback 100' from Woody Creek. A drainage plan will be submitted at Site Plan Review
based on the location of structures and improvements, including any improvements to
the existing driveway.
7. Section 7-20-40, Floodplain Hazard
To the best knowledge of the applicant, the Activity Envelope lies outside of any
mapped 100-year floodplain.
8. Section 7-20-50, Geologic Hazard
The 1041 Geologic Maps do not show any geologic hazards that impact the Activity
Envelope or existing driveway.
9. Section 7-20-60, Wildfire Hazard
The 1041 Wildfire Map delineates the overall property as including areas of low
wildfire hazard areas, severe hazard areas and extreme hazard areas. The Activity
Envelope is located in an area designated as low hazard.

10. Section 7-20-70, Wildlife Habitat
The 1041 Wildlife Maps delineate the entire parcel and the surrounding area as Deer
and Elk Summer Range. There are no specific migration corridors identified on the
parcel.
11. Section 7-20-90. Irrigated Lands for Food or Cron Production
There are no irrigated lands or lands used for crop production on the parcel.
12. Section 7-20-100, Historic Preservation
It is the applicant's understanding that most of the structures in Lenado have been
inventoried, but that none have been formally designated as Historical on the Pitkin
County Historical Register.
13. Section 7-20-110, Archeological Resources
To the best knowledge of the applicant, no archeological resources have been identified
on the parcel.
15. Section 7-20-120, Scenic View Protection
The Activity Envelope is visible from Woody Creek Road, a corridor designated as a
Scenic View Protection Area. Proposed structures and improvements shall conform to
the standards of the Scenic View section of the Code and plans will be submitted for
review at the time of Site Plan Review.

Landscaping and Vegetation Protection plans for structures and improvements will be
submitted at Site Plan Review,

certified mail) to all owners within 300' of the property and mineral estate owners with the return address of the
Community Development Department (form of notice to be obtained from the Community Development
Department). The names and addresses shall be those on the current tax records of Pitkin County, as they
appear no more than 60 days prior to the date of the public hearing. A property owner receiving the public
notice shall have 2 weeks from the date the notice was postmarked to submit comments or objections to the
Community Development Department.

company or attorney licensed to practice law in the State of Colorado, listing the names of all owners of the
property and all mortgagees, judgments, liens, easements, contracts and agreements affecting use and
development of the parcel and proof of the owner's right to use the land for the purposes identified in the
development application.

RE: Delano Activity Envelope and Site Plan Review
SUMMARY: The Applicant is requesting to establish an Activity Envelope and obtain Site Plan review
approval to construct an approximately 1,700 square foot addition to the existing single-family residence.
The Community Development Director has opted to forward this application to the BOCC for consideration,
since staff and the Applicant disagree as to the growth management status of the parcel, as described below.
APPLICANT: Daniel Delano
LOCATION: 8000 Woody Creek Road
ZONING/LOT SIZE: RS-20; 222 acres
BACKGROUND: The Applicant owns an undivided one -sixth interest in the property as a tenant in
common with five other owners (referred to as the "Lenado Six"). The owners entered into a Co -Tenancy
Agreement recorded in February of 1996 as Reception # 389817; the co -tenants lease from themselves,
collectively, the homes located on the property. The parcel is subject to a Grant Deed of Conservation
Easement (originally granted to the Trust for Public Lands, then later transferred to the Aspen Valley
Land Trust), which is recorded in Book 360 at Page 622. The Conservation Easement encumbers the
majority of the parcel, with the exception of approximately 4 acres where the existing dwellings and
improvements are located. The Articles of Incorporation and Bylaws of the Lenado Six Association, the
Co -Tenancy Agreement, Lease Agreement and the Deed of Conservation Easement are included in the
application. The Applicant obtained permits and built his existing residence in 1985; the residence
contains approximately 1,700 square feet.
The Applicant conducted a preapplication conference with staff in December of 2008 for Site Plan
Review for an expansion of the residence. Staff prepared a preapplication summary that was then
updated in January of 2010 as the Applicant prepared to submit an application. Staff did not contemplate
at that time the growth management implications of the expansion, given the multiple dwellings on the
property. Staff only recognized growth management as an issue when our review of the application was
nearing completion.
REFERRAL COMMENTS: The application was referred to the Woody Creek Caucus and the Aspen Fire
Marshal, but comments were not provided.
STAFF COMMENTS: The application is subject to a finding of compliance with the following provisions
of Land Use Code.

GMQS EXEMPTIONISEC. 6-30-1Q01: The Code provides a growth management exemption of up to
5,750 square feet of floor area for any parcel that was legally created before June 12, 1978. The Code
provision specifies that ifthere are existing structures on the parcel that contain floor area greater than 5,750
square feet, "then the applicant cannot obtain additional floor area via this exemption. The applicant may
obtain additional floor area by utilizing transferable development rights to obtain an exemption from GMQS
or by competing for an allotment in the residential GMQS."
Staffdoes not know the exact floor area of the existing structures, but is confident that the floor area exceeds
5,750 square feet, based on the Assessor's information.
All of the dwellings were built before building permits were required, with the exception of Mr. Delano's
house that was permitted and constructed in 1985. Mr. Delano notes that the parcel previously contained
more dwelling units, but that some units were removed over time, so the parcel has less total floor area and
less density now than in the past. While the dwellings are legal, since they were established prior to the
imposition of zoning and building regulations, the parcel is considered nonconforming, since it contains more
than "one principal residential use." [Sec. 4-10-20]
The issue is — what right does each individual owner have to expand his/her existing dwelling?
The parcel is large enough to accommodate division into six 35+ acre parcels, so each dwelling would be on
a separate parcel; however, the Conservation Easement prohibits subdivision of the parcel. This limitation
drove the decision to convey the property to the "Lenado Six" as undivided one -sixth interests. The
Applicant asserts that each un-divided interest should be treated as a separate parcel and recognized as having
its own development right, which would potentially allow expansion of up to 5,750 square feet of floor area
without the use of TDRs or competition for growth management allotments. The Applicant has proposed to
expand his dwelling up to approximately 3,500 square feet. The Applicant believes that it is not feasible for
the other dwellings to be expanded up to 5,750 square feet, given the constraints, particularly the 100' setback
from Woody Creek.
Staff agrees with the argument that IF 35+ acre parcels could be created around each dwelling, then each
parcel would have a development right that would potentially allow up to 5,750 square feet. In a similar
circumstance in the Little Annie Basin, staff made the determination that the existence of a dwelling that was
built prior to June 12, 1978 (adoption of growth management regulations) would confer a development right,
such that if a 35+ acre parcel was created around the dwelling, then the parcel would have a development
right. Since that parcel was in the Rural/Remote zone district, the development was limited to 1,000 square
feet.
However, in this case, given the terms of the Conservation Easement, 35+ acre parcels cannot be created
around the dwellings. Therefore, it is staffs position that the Code treats the parcel as one fathering parcel.
The parcel is subject to the provisions of Sec. 6-30-100, which only provide a growth management
exemption for the existing floor area, since the total floor area on the parcel already exceeds 5,750 square
feet. Additional floor area could be obtained via growth management competition or the use of TDRs. The
Applicant notes that this interpretation treats the Lenado Six unfairly since an adjacent 2 acre parcel has the
potential to expand up to 5,750 square feet exempt from growth management, while the dwellings on a 222
acre parcel would be limited to their existing size, which in some cases is less than 1,000 square feet.
Staff would note that in 1996, when the parcel was conveyed to the Lenado Six, the Code provided a growth
management exemption for up to 15,000 square feet of floor area on a parcel that was legally created before
June 12, 1978. The exemption was reduced to 5,750 square feet in 2000 when the Code was amended. After
2000 and prior to the adoption of the new Code in 2006, it is staffs recollection that ifthere was more than

one legal dwelling on a parcel, we would allow one unit to expand up to 5,750 square feet, while the
additional dwelling(s) would be limited to their existing size.
SITE PLAN REVIEW (LUC Sec. 7-10-501: A request for Site Plan Review approval must comply with
the provisions and policies of Chapter 7. The proposed site plan and activity envelope comply with the
Code, as explained below.
SITE PREPARATION AND GRADING: All grading and fill placement, clearing, grubbing and vegetation
removal will occur within the Activity Envelope. The Applicant does not anticipate that any trees of 6" or
larger DBH will be removed. The Applicant agrees to revegetate disturbed areas, to store topsoil on -site, and
to manage weeds.
SLOPES: The activity envelope primarily contains slopes of less than 30%. Small areas of slopes in
excess of 30% are included in the envelope; these areas are minor anomalies and are not affected by the
proposed development.
WATER COURSES AND DRAINAGE: No encroachment or channeling activities are proposed; no irrigated
areas will be affected; and no activities are proposed that would interfere with groundwater recharge or
pollute groundwater. The Applicant will utilize best management practices to ensure that drainage is retained
on -site and that erosion will be controlled.
GEOLOGIC HAZARDS: The activity envelope is outside of any potential debris flow or avalanche hazard
areas.
WILDFIRE: The wildfire hazard is mapped as low. The Applicant will comply with the standard mitigation
measures in the Code.
WILDLIFE: The parcel is adjacent to mapped elk winter range. Expansion of the existing single family
residence will not create additional impacts on wildlife.
STREAM SETBACK: The addition to the residence will be located outside of the 100' setback from Wilbur
Creek. A portion of the activity envelope extends into the 100' setback to encompass the existing well,
waterline and propane tank.
SCENIC VIEW PROTECTION REVIEW: The parcel is within the mapped Scenic View Protection Area as
seen from Woody Creek Road. The addition will be built behind the existing residence to the northeast,
which will lessen its visibility from the road. The addition is broken down in scale and mass and steps up
the hillside. The addition will not break a ridgeline. The proposed development otherwise complies with
the standards of Sec. 7-20-120 of the Code.
LANDSCAPING AND VEGETATION PROTECTION: Other than revegetation of disturbed areas with native
grasses, no other landscaping is proposed in order to preserve the existing rural character. Disturbed areas
will be revegetated.
LIGHTING: Exterior lighting shall be consistent with the Code. The Applicant will be required to submit a
lighting plan with the building permit application.
ACCESS: No improvements to the existing driveway are proposed. The house is accessed directly off of
Woody Creek Road.

SEWER AND WATER: There is an existing well and on -site wastewater treatment system ("OWTS") that
serve the residence. No additional bedrooms are proposed, therefore, the existing OWTS should be adequate.
RECOMMENDATION: Staff recommends that the Board of County Commissions make a motion to
approve the Delano Activity Envelope and Site Plan Review, subject to the attached Resolution, which
includes a condition requiring the Applicant to compete in growth management or obtain special review
approval to utilize a TDR for the additional floor area that is proposed.

2. APPLICANT understands and agrees that Pitkin County Ordinance No. 030-2009 establishes a
fee structure for land use applications and the payment of all processing fees is a condition precedent to a
determination of application completeness. The fee structure is based on the County's policy that development
shall pay, in full, the cost of development review in Pitkin County. Fees have been set to be consistent and fair
to the public and to reflect the expense incurred in providing such services to the public.
3. APPLICANT and COUNTY agree that because of the size, nature or scope of the proposed
project, it may not be possible at the time of application to ascertain the full extent of the costs involved in
processing the application.
4. APPLICANT and COUNTY agree that fees charged for the processing of land use applications
shall accumulate if an application includes more than one type of land use review.
5. COUNTY and APPLICANT further agree that it is impracticable for COUNTY staff to complete
processing or present sufficient information to the Planning Commission and/or Board of County
Commissioners to enable the Planning Commission and/or Board of County Commissioners to make legally
required findings for project approval, unless current billings are paid in full prior to decision.
6. Therefore, APPLICANT agrees that in consideration of the COUNTY's waiver of its right to
collect full fees prior to a determination of application completeness, APPLICANT shall pay a base fee in the
amount of $ which is based on _ hours of staff time, and if actual time spent by staff to process the
application exceeds the average number of hours by more than 20%, then the COUNTY will bill the
APPLICANT quarterly for the additional time spent. Such periodic payments shall be made within 30 days of
