The Uniform Administrative Code Provisions is a companion document to the � Nationai Electrical Code(NECj and is not included in Ordinance No.95-5,Series 1995, which adopted the National Etectrical Code(NEC). 7 3. Coordination of development-reiated codes is critical to the public and staff to reduce confusion and error. ^ � 4. The Uniform Administrative Code Provisions provides the Chief Building Official the appropriate enforcement aut6ority between the NEC and other development codes. In order to hear and decide appeals of orders,decisions or : determinations made by the building officia]relative to the application and interpretation of this code,there shall be and is hereby created a board of appeals _ . consisting of inembers who are qualified by experience and training to pass on matters pertaining to buiiding construction and who are not employees of the jurisdiction. The buitding official shall be an ex officio member of and shail act as secretary to said board but shail have no vote on any matter before the board. The board of appeals shall be appointed by the governing body and shall hold office at its pleasure. The board sfiatl adopt rules of procedure for conducting its business,and shall render a1!decisions and findings in wr'rtittg to the appellant with a duplicate copy to the building official. Chapter 2 Section 203(c) At the time of perfecting an appeal to the boazd of appeals,the appellant shall be required to pay an appeal fee of seventy-five dollars($75.00},which fee may be retumed to the appellant at the discretion of the Board of Appeats if the appellant is substantially sustained. � Chapter 3 5ection 301(b)Exempt Work The following shall be deleted as exemptions for electrical permits: 12.Electricai wiring,devices,appliances,apparatus or equipment operating at less than 25 volts and not capable oF supplying more than 50 watts of energy. 13.Low-energy power,control and signa]circuits of Classes II.and III.as defined in this code. The purpose of this Agreement is to outline the cooperative relationship between the Forest Service and Pitkin County for the following services and ,� . activities during the summer months: 1) controlling access on Maroon Creek Road; 2) providing public mass transporLation to the Maroon Lake area; and 3) ! providing interpretive inEormation for outdoor recreational and educational r activities to persons utilizinq the public mass transportation system. II. Statemant of Mutua2 2atereata and Senefits � . During the 1970's visitorship to the Maroon Valley area had increased to a point where resource damage, traffic congestion, and accident potential were •; not acceptable. To minimize the environmental impacts on the Valley and to .. educate the forest visitore about fozest resources, natural phenomena, local 'y'• � history, and partnerships, a shuttle bus system was instituted. Pitkin County and the Forest Service have interest or responsibility in the operation. Pitkin County will provide for public mass transportatton from an off-FOrest � staging area to Maroon Lake in order to reduce environmental impacts from motor vehicles in Maroon Val2ey and reduce air pollution in tha county. Pitkin Count�c will also maintain jurisdiction and control of Mar.00n Creek Road, a � counGy road. Asaist the Forest Service by providing for eavironmental education and interpretive infozmation about fozest resources, natural phenomena, local history, partnerships and similar matters through the use of the bus service. ' C. Obtain Forest Service approval for all publications related to this , program and acknowledge Forest Service support in such publications. D. Provide for signing related to the bus service from the point of origination to Aspen Highlands. E. Insure that news releases are distributed to the local media relating to the bus service information after approval by the Forest Service, F. Prior to May lst of the year following the transportation sexvice, furnish the Fosest Service a report and analysis showing a summary of the past year's ridership. G. Execute a road c2osure for Maroon Creek Road. Maroon Creek Road will be closed to vehicle traffic (other than public mass transportation service vehicles and/or vehicles with a valid car pass) during the dates and times set forth in the current Annual Operating Plan, which � becomes part oE this agreement. - H. Pxovide adequate Zaw enforcement, as determined by Pitkin County, to . . � ' en£orce the Maroon Creek Road closure. T. Approve location of Forest Service-owned structures within the Maroon Creek Road's right-of-way for the purposea of operating an entrance station. J. Assist and coordinate in the wording and placement of all roadway signs. K. Pay to the Forest Service, USDA, a sum o£ money as agreed in the current Annual Operating Plan, which becomes part of this agreement. These funds are to be applied toward actual personnel and associated . expensea incurred by the Forest Service in staffing the entrance • station on Maroon Creek Raad and will not be assessed an overhead charge by the Forest Service. Assist Pitkin County in developing environmental education and interpretive programs about the forest resources, natural phenomena, local history, partnerships and similar matters to be used on the ehuttle bus talks. F, Approve all publications developed by, or through, Fitkin County related to this pxogram. G. Approve news releases developed by, or through, Pitkin County relating to the bus service. H. Issue a Bill £or Collection for funds receivable from Pitkin County as agreed to in the current Annual Operating Plan, which becomes part of � this agreement. Funds are to be applied toward actual personnel and . associated expenses incurred in running this program and will not be assessed an overhead charge by the Forest Service. Provide Pitkin County a detailed list of charges incurred upon request. Rny excess funds not used for the agreed costs shall be ' refunded to the cooperator upon expiration of this Agreement. - V. IT iS MATIIALLY AGREED AND IINDEASTOOD SY 11N8 S&TWEEN THfi PARTIES THAT: A. Specific indirect cost rates are approved in the initial agreement. If the rates change at any time during the perPormance period, the proposed adjustmenCS sha11 be resubmitted to the Forest Service for verification, consideration, and approval, prior to the adjusted rates � being bil2ed. Appzoved rates shall be incorporated hy written modification. B. The Forest Service is not obligated to fund any changes not properZy appzoved in advance. � E. RFTA shall give to the Forest Service or Comptroller General, through any authorized representative, access to and the right to examine all books, papers, or documents related to this agreement. �� F. Either party(s), in writing, may terminate the agreement in whole, or in part, at any time before the date of expiratian. Neither party(s) shall incur any new obligations for the terminated portion of the agreement after the effective date and shall cancel as many obligations as is possible. Full credit shall be allowed for each parties expenses and all noncancellable obligations properly incurred up to the effective date of tezmination, G. The cooperator shall comply with all Federal Statutes relating to nondiscrimination and all applicable requirements of all other Federal Laws, executive orders, regulations and policies. These include but are not limited to: (a) Title VI of the Civil Rights Act of 2464 (42 U.S.C. 2000d), which prohibits discrimination on the basis o£ race, color, handicap, or national origin; (b) Title IX of the Education amendments of 1972, as amended (20 U.S.C. 1681-1683, and 1685-1686), ' - which prohibits discrimination on the basis of sex_ X. DATES AND TIMES OF ROAD CLOSURE S Maroon Creek Road will be ciosed to vehicle traffic (other than public mass transportation service vehicles and/or vehicles with a valid car pass� aC a point near the National Forest boundary between the hours of B:30 a.m. and S:oO p.m. on the following dates: 1) daily, beginning on June i4 and ending on September 2; and 2) on September 7, 8, 14, 15, 21, 22, 28, and . . 29. � 2. PUBLIC MASS TRANSPORTATION SERVICE � The transportation service (buses) will be operated from 9:OD a.m, to 5:00 p.m. daily from June 14 to September 2, and on September 7, e, 14, 15, 21, j:� . 22, 28, and 29. � - suses will depart from the Rubey Park Bus Station in the City of Aspen. Buses of at least 36 passenger capacities will depart for Maroon Lake every 2D to 30 minutes. Three departures per hour will be scheduled during peak periods, Or, capacities and timing of bus departures will be sufficient to ' adequately* meet pub2ic demand £or transportation to the Maroon Lake area during road closure hours. 3. TR7INSFER OF FUNDS Pitkin County shall pay to the Forest Service, USDA, a sum of $24,300 (twenty four thousand three hundred dollars). The $24,300 will be payable in two payments of $12,150 (twelve thousand one hundred fifty dollars) each after receipt of Hills for Collection from the Forest Service. First payment will be due approximately on August 1, 1996 and the second payment , will be due approximately September 1, 1996.
