WHEREAS,the Board of County Comenissioners of Pitkin and Eagle County
� entered into an[ntergovernntental Agreettient dated March S1,1988 for the�urpose of -
� acquiring lands in Eagle County described as part of tracts 43,44,45 and 46 of
5ecfions 3 and 4,Township 9 South,Razige 89 West of the Sixth Pcincipal Meridian,
commonly known as the Mount Sopris Tree Nuisery;and
WHEHEAS, the Intergovernmental Agreement pmvides that the Counties deed
various mining ctaiuis to the United States Forest Service in exchange for the Mount
Sopris Tree Nursery piroperty. The Aga�eement a[so requires Pitkin County to deed its
interest in the property to Eagle County upon completion of a long-term management
plan for the property;and
. WHEREAS,Eagle County has recently coenpleted its development plan for the
Mount Sopris Tree Nursery which plan includes recreational,park,open space and
governmental offices.
NO W,THER£FORE,BE Tf OKDA[NED, that the Board of County Commissioners
of Pitkin County,Colorado hereby approves the transfer of its interest in the Mount
3opris Tree Nursery to£agte Cotmty pui�suant to the Intergovernmental Agreement
. • L�etween the Counties and authorizes the Chair to execute the attached deed.

described real estate situate,lying and being the County of Pitkin and State of Colorado,to wit
A parcel of land known as Tract A,a portian of Tracts 43,45 and
46 of Secrion 3,Township 8 South,Range 87 West of the Sixth
Principat Meridian,Eagle County,more particularly descrfbed in
the attached Exhibit A,and
all water rights associated with the five(S)existing Mount Sopris �
• Tree Nursery Wells as approximately located on the ground as
depicted on Exhibit A. Only Mount Sopris Tree Nursery Wells
Nos.1,Z,3 and 4 were decreed in the Interlocutory Decree for
the White River National Forest in Case No.W-467 in Water
Division No.5,dated October 2,1978.

Containing 128.03 acres,more or less.
Subject to the easements,rights of way,or encumbrances confained in the Quitclaim
Deed from the United States of America to khe County of Pitkin and the County of Eagle,as
recorded in Book 6S8 at Page 102,Keceprion Number 554133 of the records of the Fagle County
Clerk and Recorder.
TO HAVE AND TO HOLD the same,together with all and singular the appurtenances and
- privileges the��emito belonging,or in anywise thereuttto appertaining,and all the estate,right,
tide,interest,and claim whatsoever,of the Grantor,either in law,equity,to the only proper use,
benefit and behalf of the Grantee,its heirs and assigns forever.
