� 1. The Pitkin County Open Space and Trails Program and Pitkin County,hereinafter
"Applicants"have applied to the Board of County Commissioners of Pitkin County, ,
3 Colorado,hereinafter "Boazd",for approval of the rezoning of Elk Park from Village
� Commercial to Public.The ApplicanYs proposal also includes a master plan for the
� property.

2. The subject property is also known as the Lyon Property,and is more specifically .
described in Exhibit A,attached.

n 3. The Planning and Zoning Commission reviewed diis application on January 2,
.� � 1996 and found that this proposal complies with the criteria set forth in the Pitkin County
�J,, � Land Use Code. "
- \� 4. The Boazd heazd the lst Reading of this application at a regulaz meeting on May
�,� 8,1996,and the 2nd Reading at a duly noticed public hearing on]uly 24,1996,at
'�� which time evidence and testimony was presented with respect to this application.

� 5. The Board determined that the proposed master plan and rezoning meets the
� � criteria established in the Pitkin County Land Use Code.
r;��L' 1 6. The Board held that the cosu associated with the design,construction,and
��� maintenance of the new firehouse on the Elk Pazk propeRy shall be borne by the
Carbondale&Rural Fire Protection District.
NOW, THEREFORE, BE IT ORDAINED by the Board of County
Commissioners of Pitkin County,Colorado that it dces hereby grant appmval of the Elk Park
Master Plan and Rezoning application.
