Pitkin County owns and operates the Aspen/Pitkin County Airport, also known as Sardy Field (hereinafter the "Airport") and � the commercial terminal building (hereinafter the "Terminal" or the "Air Carrier Terminal") does maintain various spaces for the use of the public and from time to time does and shall license or permit the use of parts of these areas to various individual, firms or corporations to serve the users of the Airport; and, 2. The County has authority to regulate commerciai activities on � Airport property, to enforce these regulations and to set and collect fees for these commercial activities, pursuant to, inter alia, C.R.S 41-4-1o1, et seg., and the Pitkin County Airport Regulations (title TV, Pitkin County Code; and, 3. In determining the total amount for fees to be charged to commercial ground transportation operators, the Airport intends only to recover its costs in managing that segment of Air Carrier Terminal operations and, in distributing these total fees among the classes of operators, has attempted to set fees based on a balance of use of the Airport and convenience to the traveling public as a whole; THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY COMMIS3IONERS OF PITKIN COUNTY, COLORADO: � Section 1. That the fees for entry and use of the Airport commercial traffic circles for commercial ground transportation purposes shall be as follows: A. For each operating company, an administrative fee of $50.00 for filing and processing of the application (this fee shall not be prorated for a part of an annual period, but shall be the total amount regardless of when filed) ; /� � � . �, ' r e ..i' � -il.ti . -• � ... � . For each limousine/van operated, as defined in the ,. Airport Ground Transportation Rules and Regulations, a fee of 1, $400.00; .;' D. For each hotel/lodge/resort or other courtesy vehicle, a • fee dependent on the number of passengers that can be carried: 1-7 passengers - $200.00; 8-14 passengers - $400.00; �!'�' > 14 passengers - $800.00. i;;Y,. G. Vehicles operated by public transit agencies, on regularly-scheduled service, shall be exempt from these fees. i� H. These fee schedules may be adjusted and increased annually by the Inflation Escalator, to the nearest whole . dollar amount, at the sole discretion of the County with only notification of the operator in the next year's notification/ Application package. I. Fees paid by operators for the operating permit shall be paid to and received by the Airport no later than the first � day of January of the new year. Permits issued shall be valid �`�- for one calendar year, from the first day of January of that year until and including the 31st of December of that same year. It shall be the responsibility of the Director of Aviation or his/her designated representative to ensure that applications for the next calendar year are mailed in due time to ensure compliance with the aforementioned timeframe. Mailing by certified mail, return receipt requested is NOT required; applications will be mailed via regular US Postal service mail, or will be available for pick-up in the office of the Director of Aviation. Vehicles not disglaying the current year's operating permit by the first day of current year shall be cited appropriately by Airport staff or the Regulation Enforcement Officer (REO) on duty. J. For application after January lst of the current year, fees paid by operators operating that specific vehicle for " only a portion/fraction of the calendar year shall be required to pay only that fraction of the year's fee for that calendar year, i.e. a permit purchased under a current application in July of that year shall be required to pay only 6/12's (SOo) of the fee for that vehicle type. There will be no "seasonal fee", partial fee, or refund of fee if the vehicle for which application is made by the first of the year is then only used ' for only a fraction of that current year. � � � � , y � ,�,;.._ . . � � . e :i' ,i _ ., ,,,, � � ,. . , , , ,.:. - ,. . . ,... , �t''Y•i 1�`::. K. In application for vehicle permits, one permit will be issued to one vehicle only; the airport permit is non- •' transferable. The Airport reserves the right to issue - that permit as it sees fit, i.e. by type of permit, color, , 2tC. 't, L. If a ground transportation operator is authorized to ' ,'+,,. conduct two (2) or more types of service using the commercial � traffic circles at the airport, a vehicle may be issued more than one type of permit, i.e. a van might be issued a permit in ��on demand" type of service and that van might be used in courtesy vehicle service under contract/not for hire- compensation for a hotel/lodge/resort. The vehicle r�� operator/owner will not be required to purchase a second permit for said vehicle, but will be issued an additional type permit based on the requirements of the original application. ` However, the higher/highest fee under Section 1, paragraphs b. • through e. above, will be required in payment before the , additional permit is issued. Only the difference between the lower and higher cost permit will be required if the vehicle . was previously permitted for operation on the Airport. M. Zf the airport-issued vehicle permit is 1ost, stolen, or missing for any reason, that vehicle shall not be operated on I the airport until a replacement permit is obtained from the : Airport. The full permit cost for the reissuance/replacement ' of the vehicle permit shall be charged for the permit without . consideration as to reason for loss and/or time remaining on that permit issued in the application process. If a pexmit is destroyed due to accident or damage to the vehicle, windscreen, etc, the permit may be brought to the Airport in its damaged/destroyed condition, and a replacement permit wi11 be issued without cost. i N.
