CALL TO ORDER: Chairman True called the meeting to order at 12:00 p.m. in the
County CouRhouse BOCC Board Room.
COMMISSIONER MEMBERS PRESENT: Commissioners Michael Ireland, James �
True,Bill Tuite,and Leslie Lamont.
COMMISSIONER MEMSERS ABSENT: Commissioner Ethridge.
ORDINANCE AMENDING ARTICLE 3 OF THE PITKIN COUNTY LAND USE
REGULATIONS IN ORDER TO CREATE AN AFFORDABLE HOUSING ZONE
DISTRICT FOR THE ASPEN METRO AREA AND THE EXTENDED A3PEN
METRO AREA AS DEFINED BY THE ASPEN AREA COMMUNITY PLAN
(AND RESIDENT OCCUPTED RESTRICTIONSI - MOTION TO ADOPT RO
- GUIDELINES: Cindy Houben presented the issues as outtined in her January 23, 1996
Memorandum. A copy of the Memorandum is made a part of the record and attached
' hereto as Exhibit"A." Cindy stated in reviewing some of the materials,she said at one
time they were looking at a special review for a total 100 percent RO project. Right now,
it is not in the ordinance. Dave Tolen,with the Housing Authority,stated there is such a
level of review already. For instance, any project would go to the Housing Board for
referral and the Housing Board would make recommendations on whether the mix made
sense with the Aspen Area Community Plan or they even approve a rezoning. All the
criteria to be concerned about would have to be looked at. Even if it was a free market
project,the same would apply. The Board and Cindy Houben decided the Ordinance is
fine as it is with regard to the 100 percent RO project.
Commissioner Lamont commented with the intent and purpose of each of the zone
districts, maybe they should spell out the percentage mix between the unit and the
bedrooms.
Cindy Houben responded the percentage mix will be spelled out in the Ordinance. It is the
way the Code is set up. Suzanne Konchan wanted to make sure it was revised so the ,
format is consistent with the different districts.
Commissioner Lamont stated on page 10 of the draR ordinance where the language reads:
"However, only 40% of a projecYs bedrooms may be located within free market or
resident occupied units. Category housing or resident occupied housing must comprise at _

least 60% of the bedroom mix of the project," this langua�e is contradictory and ihe "
phrase"or Resident occupied units"needs to be deleted. ' �

John McBride asked how would they evafuate a project that had a mix of lots and units '
and they did not really know what was going to be on the lots? '_ ,
Cindy Houben stated it would have to be distinguished as a type of lot, a category or a.
RO. IF it was a cate�ory unit, it could go over three bedrooms. The free mazket units
cannot go over three or four bedrooms. t,'� �'

John McBride said the County's desire was to, even on affordable housing projects .
without subsidy,use the Housing Office priorities of sale of lots and units. The reason he � -
assomes a lot has a three-bedroom house on it is so they can say if they produce that lot or .
mitigation produces it,they wili prioritize it to a household for children. lf they assume it
has something less than a three-bedroom unit on it,then it changes the priority.
Commissioner True stated theoretically, they can still designate it as a three-bedroom
house and have the criteria. If a family who buys it has only one child,they qua(ify for it.
They might not want to build the secortd bedroom until and unless they have a second ,•
child. You do not want to force people to build more than they really need but you do
want to force them to be qualified under the minimum.
The Board is com£ortable with the 60/40 mix]anguage in the draft ordinance.
Commissioner Lamont commented that commerciai uses, which aze accessory to the
housing clevelopment, are also included as special review uses. Commissioner Lamont
asked if the commercial uses must be competed for and need aa allocation. Cindy Houben � �
said yes,they must be competed for, Commissioner Lamont aiso wanted to know what
the definition of the extended metro area is? Cindy Houben said the definition of the
extended metro area is described in the Aspen Area Community Plan. She suggesYs
inserting a definition into the Code for the extended metro area. The extended metro area
is defined as the area beyond the metro area down as far as the Aspen Village Mobile
Home Park. Cindy Hou6en will have to refer to maps to give a more exact definition.
She will include the definition for the final ordinance.
David 5choenberger,chairman of the homeowners' association for W/J,wanted to know
what is going on with the land adjacent to the W/J. Has it been designated PMH zoning,
and if so,is the County grandfathering what was done at that time or are they stating what
is being done right now is going to supersede what was done then?
Cindy Houben said she remembers it being zoned PMH. Also, this ordinance will noY
rezone that property. It is just an enabling ordinance in the Code sayin� anybody can
come in and rezone their property. If, in fact, the bench was part ef ihe ranch back in
1988, then it probably was rezoned to the permanent modem housing zone.
Commissioner Tuite stated back in 1988 if there were no houses on the property, it was
not rezoned. David Schoenberger wants a definite ctarification from Cindy Houben in -

writing on what the piece of property is zoned for. W/J is within the Aspen Metro �;.``••,�
Extended Area. At this time, the ordinanca wouid enable a rezoning of thaY parcel.
Commissioner True instructed Staff to clarify what the actual zonin� is there now. '� `" .
Commissioner Troe stated this ordinance does not supersede the current zoning of W/J. {.;�_ .�.

John suggested with regard to resale, he has a probiem with no escalation for the first :.��`• ���
three years and then adding a restrictor after that. He would like the Board to consider a � -
few things:
l. Being able to pick up the escalation in vatue after the three year period,especial(y if it
is not compounded a(1 the time. The Board responded it is atready set up this way. -
2. When the owner decides to sell his house,have as a protector a right of first refusal for
a fixed price for the Housing Authority to buy the house back from the Owner. This '":r
would help in instances of when the owner would sel!the house to somebody thai was •
questionable or the price was way out of line. Commissioner True stated this issue - -
shoutd be referred to the Housing Authority at their next meeting. Commissioner •
Ireland likes the idea of the Housing Authority would have a 90-day right to market ,.
the house aY a fixed cosi,and if they could not,then the owner is free to sell the house ,.
for what he can. Another suggestion was instead of trying to figure out the cost of the
home,cap the cost at$80,00 a square foot.
Jay Olton wanted a clari6cation on how the AH ordiaance affects lot owners. As he
• understands it, all lots will have the option af having three bedroom houses built on it.
The thinkin�is when you approve a project, the project, as approved, without potential '
additions,has to meet the 60/40 bedroom mix as approved.
Commissioner Lamont said with regard to the ailowable floor area,she feels a cap should
be put on the free market houses.

Commissioner Ireland stated he feels the right way to do it is to address it on a case-by-
case basis.
Commissioner Ireland moved to adopt the aftordable housing regutation AH2/PUD
and AH3/PUD on fourth reading. With a second by Commissioner Tuite, the
motion passed unanimously.
Commissioner True said there is a proposal to have a resident occupied discussion. He
noted that the Housing Authority already reviewed this and proposed a change to make it
consistent with the category restriction on property ownership. Dave Tolen said it is to
include the opportunity to hear it for special review of ownership of property in the
Roaring Fork Valley, including the tributaries(i.e.,Crystal River, Missouri Heights, and
Frying Pan). Dave Tolen also wanted to mention the language"subject to special review"
needs to be inserted into the existing language. If this language is not in there, the
Housing Board feels it does not have the ability to vary items in the guidelines withaut
going to the�ity. Chairman True said it is the intent of the Board to have the language
"special review"inserted.

Jamie Knowlton said he has a problem with the 4%cap. Chairman True responded this -
issue needs to be brought before the Housin�Authority first. Mr.Knowlton stated for the -
record he sees the 4%cap and the three year hiatus as a way to for the County to stop `,,
speculation. He is all for prevention of specuiation but he is not sure this is Yhe way to go . �`�
about it. He feels there would be a lot of people that would want to�o down to the River -'.r;
Ranch project where there are 10,000 squaze foot lots and open for sale at$150,000.00. �.
They are competing with his lots,which are substantia(ly smaller buc closer to town,and at �
a 4% cap. In addition, there is a limitation it can be the only residential unit. Mr.
Knowlton said if they are trying to sel)these lots, it is harder for them to sell a loi. He
also feels it goes against the Aspen Area Community Plan. The plan is to revitalize the
community by keeping the lacal workers here. Right now,the choice would be to move -Y
down valley where the investment can be taken advantage of. He feels the only limitation _
should be that the house be the primary residence. He thinks the way to keep the prices �
� down when reselling the house is to have the Housing Authority have the first right of �
refusal to purchase the property at a 4%gain.
Commissioner Tuite said he is willin�to listen to ideas concerning a better way to handle
this issue.
Commissioner True stated at this point, the Housing Authority Board suggested
proceeding with the existing document, in essence. He does feel discussions need to
" continue.
David 3choenber�er commented the more they drive people down valley,more of a traffic
problem is created. Housing and traffic are directly linked,
Commissioner Ireland responded tfie Board has consistently supported subsidies for RFTA •
- to provide additional measures of safety. The Boatd has also pushed for the project from
Buttermilk to Basalt because of the safety issue. He also stated he is wilting to listen to
altemative ideas on how to address the problem.
Cindy Houben stated if this issue is bounced back to the Housing Boazd,she wouid like
the joint P&Z's thoughts combined with the BOCC's thoughts forvvazded to the Housing
- Authority in looking at changes in ihe guidelines.
Commissioner Lamont suggested adopting the changes today and give the Housing
Authority the chance to look at their guidelines in total and changes wi11 come forwazd
after that. Commissioner Ireland concurred with Commissioner Lamont. Commissioner
Ireland also said if someone can come up with an alternative that addresses the problem,
he would be willing to look at that as a revision at a later date. He would like to propose
that #9 be revised. He wants only individuals to be able to owa the houses, not
corporations,trusts,entities or five people. He suggested the foilowing language: "Lots
and units may not be owned by other than individuals or in joint tenancy or tenants in
common."

7amie Knowlton asked the Board not to adopt this document as an interim measure. He '::;M
wants the current R�guidelines]eft in place until there is more discussion. He feels it is ��
unfair to penalize the working man and local here based on the abuses of a few individuals.
David Schoenber�er said for the Board's information and everybody involved, he is �
involved aatively in refinancing a lot of the homes on the W/J Ranch as well as doing the -
Aspen Village deal. He has come across a few instances where a trust is purchasing a r .
home because the income of the applicants is in the $15,600.00 range. One of the �
applicants is a divorced woman with a child. He said a sin�le,divorced woman raising a ' �
child should not be penalized in purchasing a home because of other abuses. He atso feels �
there should be more discussion regarding this issue before it is adopted.
Commissioner Lamont responded that the Board and the Housing Authority have been
looking at this issue for a long time. She feels they have talked about the guidelines before
them with enough comment and enough input. She acknowledges there will always be
individual situations where there is the abitity to appeat to the Housing Board. Every year
the Housittg Office goes into their guidelines and re-evaluates the guidelines, tweaks the .
� guidelines and chaages them based upon new programs and based upon problems that
have arisen over the year.
Commissioner True suggested with regard to entity ownership, maybe it would be
appropriate for tfiis to have special review in order to look at the situations.
Commissioners Ireland and Lamont concurred. �-
Commissioner Tnie stated he is not comfortable wiYh some of the provisions in the
guidelines.
Commissioner Ireland moved to adopt the resident occupied guidelines. This
includes special review provisions for paragraphs 7 and 9. WiYh a second by
Commissioner Lamont,the motion passed with Commissioners Lamont and Ireland
voting yes and Commissioner True voting no. The motion passed two to one.
