Grover retiring, the new board convened, with 1 J. R. Williams taking his place on the Board. Present, Reed, and Williams, as Commissioner., and Jennie li. Sanders, Clerk. Board proceeding with its re- organization. Upon motion of Williams, C. M. Reed was duly elected Chairman of the board. Upon motion Co. Clerk Jennie Iii. Sanders was chosen as the ?'archasing Arent for the County for to a ensuing; year. Robert S. Killey Co. Treasurer, reported to the '°oard that he had appointed Jno. V`J. Sande as The Deputy County `.Treasurer at a salary of 4`'80.00 per month. On motion the Board approved his actions. Jennie 1. Sanders, Corounty Clerk reported to the Board that she had appointed W. K. Hanson as '''epyty Clerk at a salary of 4'80.00 per month. Upon motion her actions were approved. iarl McPhee, County Assessor, reported that he had appointed lidgar Stallard as his Deputy, at a salary of 4'80.00 per month. Upon motion his actions were approved. J. M. Conner was duly appointed as janitor and jailer for the ansuing year at a salary of 5:75.00 per month. The application of .m. R. Shaw for the appointement of County Attorney, being considered by the Board, xpon motion he was dht.ly elected to serve as County Attorney, to advise the various County Officials, and to represent the county in any case in coxrt, at a salary of 50.00 per month, and to serve as such at the pleasure of the Board. Meeting called to order by Chairman Grover, and the following members were present. Grover Reed, Com. O'Yane absent. CQ. Attorney Shaw and Ulerk Jennie E. Sanders. Present. Minutes of the former meeting read and approved. Co. Attorney Shaw sent in his resignation as County Attorney, and same was accepted. The following letter was received from the State Highway department and the resolutions afixed adopted. ' Letter follows; - STATE HIGHWAY DEF:iR'i'I.1ENT MAID TENANCE DIVISI014. Denver, Colo Nov. 25, 1922. Board of County Com i , .loners 'itkin County, Aspen, Colorado. Gentlemen:- There has b en awarded ;our county, by the State Highway Department, the sum of 0,500.00 from State Highway Funds, for mai itenance of State Highways in your count,; for the year 1923, upon the followings conditions: - First- That your i o� . t°d will, by resolution, set aside a like amount from your 1923 road fund, t ez el p;r m ^icing a combined total of State and County funds, for _naintenance of y 15, 000 Second.- That the expenditure of this joint maintenance fund, on State Highways -in your county, 'shall be made by your board, and regular monthly bills ( on Form 12) rendered against the State Highway Department for all monies so expended. The State Highway Depart - ment agrees to reimburse your county to the extent of one -half of all such bills rendered, up to the amount awarded your county from State funds, i.e. 0,500.00. Third- That all bills are to be rendered not later than the pith. of the month following the month in which work was done. Bills to be made in triplicate showing each road sep- arately and a recapitulation of all money spent during month -( on Form 12 furnished by State Highway Department) and all three copies forwarded promptly to Chas. E. Baker. Assistant Superintendent of Maintenance at Glenwood $rings for his approval, who after ap_Kxoving same will forward to this office for payment of the State's share. Fourth- That your county is to fmrnish all equpment for maintenance of btate Highways in yout county, without charge to the btate Highway Department. The cost of any additional equpment required for proper maintenance, of said State Highways; shall come from county funds other than the amount appropriated by your Board to meet the amount awarded your county, by the State Higway Department. In other words, equipment cannot be charged to this joint State and "ounty Maintenance fund. Fifth- That your Boare shall furnish all labor, supplies, material and repairs to equipment, used in properly maintaining State Highways in your county and all such items charged to the joint State and county maintenance fund. Sixth- That all maintenance work on State Highways in your county, shall be subject to the ;; supervision and suggestions of the maintenance representative of the State Highway Depart- i' 1.,t :Went. i Seventh- That a portion of the salaries and expensed of the maintenance representative of the '''tate Highway Department ( for your District Division) and the `'ounty Road Superintend- ent( of your county) are to be charged to the joint State and County Maintenance fund of your count:. The arolzOrtion to be charged to this joint fund by the maintenance representative of the State Highway Department will be based on thepercentage that the State Highway mileage in your county bears to the total State aighway mileage in the Division or Listrict over which such maintenance representative of th e State Highway Department has jurisdiction. The proportion to be charged to this joint fund, account of salary and expenses of the 1 County road ° Superintendent of your County, shall be double the amount charged your county for salary and expenses of the 'Mate Highway Maintenance representative. For example; If '',. the Maintenace representative of the Highway Department charges your county $40.00 as yourc ounty's share of his salary and expenses, for eaeh month, then you will include on Form 12, monthly, the sum of y80.00 for salary and expense$ of your General County 1 ' ad Superintendent. Then you will receive back from the tate 's share of this joint fund ;40.00 the s - me as charged the county by the State Iiaintengnce representative. Thus equalizing the charges made for supervision by both the Mate and county. Eight;- That your Board agrees to keep maintenace patrol crews regularly and continously employed on 'the following sections of the different State Highways in your county as desig- nated below:' Road. SECTION OF ROAD TO BE PATROLED No. Miles to be Patrolled. 1 25 Eagle County to Independence Pass 30 Ninth- That the number of months during the year 1923 that these patrol crews shall work and the number, size and character of said patrol crews to be regularly employed, as well as the maintenance work to be done on all State Highways in your county, shall be such as shall ne mutually agreed to by your oard or representative and the maintenance representat- ive of the ''tate "ighway Department. Tenth- All disagreements or disputes between the Board of County Commissioners and the 'Fain tenance representative,,of the Highway Department shall be referred by the Superintendent of Maintenance of the tate Highway Department, to the State Highway Engineer, for settle- j ment and his decision shall be final. Eleventh- The money awarded your county by the "'tate 'Highway department for 1923 is not to be arbitrarily divided by you for use in certain districts and on certain specified State Highways in these istricts, but is for use where most needed, as occassion or necessity requires, on any State Highway in your county. Geo Hatch apearing before the Board for the purpose of showing to the Board that he was assessed with a piece of road running thro his ranch, claiming that this was a County Road. • The Board found this to be true, and on motion ordered that the amount of 01.95 be abated from Geo. Hatch's taxes for the second half of the year 1922 covering the assessment on this road,which is erroneous. A. Nordquist having offered to purchase the tax certificates of sale and the taxes to date on Lots H. and I. Block 35 Aspen. offering the sum of :30.00. Upon motion the said offer was accepted and the treasurer and clerk authorized and directed to transfer and assign said certificates for said sum. Meeting stalled to order by Chairman Reed, and the following were present- -Reed, O'Kane, and Williams, Attorney Clark and 'lerk Jennie E. Sanders. Minutes of the former meeting read and approved. On motion it was ordered that all supplies hereafter needed for road work shall only be purchased upon written order of Com. O'Kane. The Board having received a communication from the Colo. TacSCommission addressed to the Clerk of the Board under date of Mar. 27th. 1923, in reference to the action of the Board to taken on the 6th. day of March 1923 in reference to an extention of time for the payment of taxes due for the current year, and such letter not approving the actions of this Board in the above matter. Upon motion the said retolution to extend the time for the payment of the current year's taxes was, and is hereby recinded and cancelled. Messrs Wm. Finley, B. Bruton and John Jurick Jr. having appeared before the Board and asked for an appropriation to open and build, as far as possible, the County Road heretofore established on Sopris Creek and further stating that they and the people on Sopris Creek would donate their labor in value to an amount equal to any sum set aside by the Board. Upon motion the Board Ordered that the sum of $700.00 be set over to Road District No. 5 with directions to Road overseer Bruton to look after the work on said road, and expenditure of said $700.00and work to be done by said donors, and report his actions to the l'oard. Carlton the taxes due upon what is called the Midland Ranch adjoining the City of Aspen, and in giving Mr Carlton a statement of Taxes due, he included the taxes due on the SE* of SE4 Section 2, Twp. 10. S. R. 85 V. 6th. P. M., the same amounting to $86.90, and he now finds that said land is not included in the D. of T. held by said Carlton on the Midland Ranch, and that said D. of T. covered all ands claimed by said Carltonas belonging to said Midland Ranch, % and that said amount was erroneously collected by him, and asks that an order be made to refund the same to A. E. Carlton. Upon motion the Treasurer was authorized and directed to refund to the said A. E. Carlton the sum of $86.90 on account of erroneous collection. It appearing thJPeer Hunter on Sept. 19, 1921 purchased of the County Treasurer the Tax Certificate of sale issued to the County on sale made Dec. 30, 1919 for the SE4 of NWT and Ei of SW4 Sec • 17 Twp. 9, S. R. 85 W. and the said Hunter thereupon paid all subse- quent taxes, totalling the sum of 057.23, and it now appearing from the statement of the County Assessor that no such described land is subject to taxation in this County. There- fore, upon motion the Treasurer was authorized and directed to refund to the said Peer Hunter the sum of x;57.23 together with interest thereon, at the rate of 8% per annum, from Sept. 19th. 1921 to Feb. 15th. 1923. It appearing that the former Townsite of Ashcroft had about been abondoned for townsite purposes, with the exception of some few lots, on which the taxes are being paid, and that the same was formerly known as the Castle Fork Placer, and that J. T e County .attorney was directed to draw up a contract t: Dougherty Bros. of Snow Mass, to fence the road on both sides through the dhettleworth ranch, Capitol Road district, using cedar posts, set 16 feet apart, with four wires,lawful fences, to be completed for is acceptance on or before May. 15th. 1924, at .90 per rod. ". It appearing` that W. E. Stapleton has been assessed for approximately the past 20 years, J with about 4 acres of County Road, and the taxes on the same amounting to about 475.00 for said period, upon motion the treasurer was instructed to rebate the said amount to L. E. Stapleton, upon the paying of the balence of his taxes, due, amounting to ;.602.56. into Sobeck having offered to purchase the tax certificates of sale and the taxes to date on Lots A. and B. Block 113, Aspen, offering the sum of w10.00. Upon motion the said offer was accepted and the treasurer and clerk authorized and directed to transfer and - assign said certificates for said sum. I.Tike Lynch having offered to purchase the tax certificates of sale and the taxes to date on the Cora May and Cora May No. 2, H4ghI=nd Mining District, with U. S.
