Meeting called to order by Chairman Brown, and the following members were present. Brown Redd and Williams, commissioners, Deane, attorney, and Jennie E. Sanders, Clerk. Minutes of the former meeting read and approved. Thefellewing bills were audited, approved and warrants ordered dram in payment. The bil of Frank Bruin, sheriff, for the fees of office earned during the year 1921 and 1922, having at various times been presented, but still remaining unpaid and not approved, was presented in an amended account of $210.35. The amount as presented in the opinion of Csmmissieners Brown and Williams, being correct and justly due, upon motion Brown and Williams voted in favor of the payment of the bill as presented, - Reed voting a$afnst it, Payment was accordingly ordered as full settlement of all claims for fees earned by Bruin for the year 1921 and 1922 and for all amounts paid by him to his deputy for these years. R. Lewis, assessed thro misunderstanding at $600. for the year 1922, as being a car in good condition, the fact being that it was in lad and unusable condition, requiring an expense of $200. to make it servicable. That the valuation of $600. for the year 1922 be reduced and stand at $400. and the taxes on this valuation of $400. A, for the year 1922 be collected or this order will a without effect. The matter of petitioning the State Highway Advisory Board to take over certain portions of the old Colorado Midland Flight of Way for highway purposes came before the board, and upon motion the following resolutions were passed, Brown and Williams voting in the affirmative and Reed in the negative, and same sent to the State Highway Department. Be it resolved by the Board of County Commissioners of Pitkin County, Colorado, that it desires to. have accepted by the State Highway Department a certain portion or section of the Midland Railway grade, abondoned for railroad purposes, but well adapted for highway uses, running between the town of Aspen, Colorado and the town of Basalt Colorado, about eighteen miles in Length, being in Pitkin County, meaning so much of said portion of said Midland grade as upon the recommendation of the State aighway Engineer shall be found necessary and advisable and properly to be included in the State Highway designated as No. 82, formerly as 25, for, reasons of economy in construction and upkeep as well as for its better grade and more *tact direct course and the shortening of distance and that this resolution be forwarded for actio3 of the State a ighway department at the May meeting 1924, and be it further resolved that the matter is urgent because of work under contracts in progress, and the expenditures to be made on State Highway No. 82 for the year 1924 can be better made and with grater economy by using the desired and necessary portions of said Midland Rialway grade. Resolved further that the state Righway Engineer be directed forthwith to examine and report upon the same, in order that the State Highway Department shall be fully informed respecting. the matter of this resolution. Whereas; The County of Pitkin is, by virtue of deeds of conveyance duly of record, the owner of that particular parcel of land beginning in nr near the town of Aspen and term- inating in or near the t of Basalt, said parcel of land being a strip about 18 } miles long and 100 feet wide, formerly a part of the right of way of the Colorado Midland Reiiway, the said premises being within the County of Pitkin and state of Colorado, . excepting therefrom only those parts of said right of way which have heretofore passed to adjacent individual owners by deedsof purchase from the Colorado Midland Railway, and said premises so ogeepted and recorded 'for highway uses as a condition of such acceptance by the grantor in the deed to the County of Pitkin, and such accept- . ance furthermore having been' expressly made by resolution of the Board of Commissioners who thereby adopted and dedicated said strip of highway uses at the time the said deed was by them ordered to be recorded, and Whereas; • the said old railway bed along and within said strip of land is particularly adapted tit to the uses for which received and dedicated because of the excellence of its grade, the solidity of its mass and foundations and because it is the most direct and shortest possible of lines between Aspen and Basalt, and further because no equally good roar, structure could be made between said points except at a price which would be beyond • the means of Pitkin County, and in fact be. - • absolutely prohibitive by reason of such cost,and further because the said road bed right of way have been conveyed to the County of Pitkin without price, and as a °gift from citizen David R. C. Brown, who received the same by deed to him from the Colorado Midland Railway and for highviay uses only, the said land to revert to the donor unless used for highway, and whereas the • premises and rights so conveyed to Pitkin County are of groat worth for public highway uses not alone because of great first cost but because of the excellence of the condition of said road bed, and the immediate availability, and beoause at ,; small cost per mile they can be made into first class road, and a most desirable t and most necessary highway between said points, and for a fraction of the cost of any other line that could be built between said and thereafter be maintained . for year around use at light expense, and , Whereas; . in the judgement of the Commissioners of Pitkin the said right of way will best accomodate that travel passing through Pitkin County over State Highway Number 82 ( formerly designated as State toad No. 25) as well as serve a majority of the people of Pitkin County Now Therefore Be It Resolved, - that said road bed and right of way, shall as once, as heretofore accepted and dedicated, be- re- adopted, and is hereby adopted as County Road, confirming the acts heretofore of Commissioners in respeot' thereto, and that from the Wack crossing on West it shall as speedily as possible be converted to public use, to the end that it shall become a part of and be incorporated into said State Highway No. 82 ( formerly No 25) and thereafter shall be maintained and improved jointly by the County of Pitkin and State of Colorado, as the law provilee, and as by resolution the State Highway Department has been properly petieteoedoseotdodo and to include, by the Commissioners of Pitkin County at their May meeting A. The County t reasurer is instructed in the matter of the taxes on the Paige auto car the property of John and. an Sullivan of Aspen, to cancel all of the taxes and penalties against the sr-me for the period- from 1918 down to date amounting to $180.71 and to receive in lieu of said sue, the sum of $10.00, for the reason that said car was impressed into service by the Red rose for emergency work and humane releif at the time of the Influenza epidemic in 1918, and was ruined unavoidably thereby. The said John and Dan Sullivan neither received nor asked compensation for the said use. That this automobile has not been used and cant be used except at an expense approaching its original cost. The service rendered. was to the general public, other citizens as loyally and humane responded in that time of distress and fortunately with less loss. The car is not of more than $50.00 value according to the judgement of the assessor and competett citizens. Resolutions adopted by the Board of County Commissions, and ordered that same be published according to law, and copy sent to the State Highway department. • ": 68 RESOLUTIONS BY COUNTY COLL,ZI SSIONJ RS FOR ADOPTION OF STATE HIGHWAY Be it resolved by the Board of Commissioners of :Pitkin Countythat it is desired to have . adopted by the State Highway Department that certain portion of the Midland Railway Grade within the County of Pitkin, Colorado, abondoned for railway uses, extending from Snow Mass to the Wack crossing, being a stetch of road in extention of the adopted and constructed portion of ;£ said grade, running from Basalt in Eagle County to said Snow Mass station in Pitkin County, • already incorporated into State Highway No. 82( formerly designated as State Highway 25) eliminating therefrom that part of said State Highway running from the crossing of the Stapleton lane, so called, near Aspen, down through the canyon of the Roaring Fork river and on to Basalt, but not abondoning the same as a County road, but it to be preserved and maint- ained by the County, as County Road for the use of those whom it now best serves. This request is made in the interest of economy in construction and up keep, the uit ability and desirability of said section because of its easy grade and unobstructed view, . and its hortening of distance between Aspen and Glenwood Springs to the advantage of the larger volume of travel between Aspen and Glenwood Springs, making of it an extendion in fact of the great Independence Pass route from Denver and citi es of the Eastern_slppe and thence on to Salt Lake City, Utah, and to Pacific Coast, and because of safety it will insure. Resolved that by the State Highway Department, its Engineer shall be directed forthwith to examine and report, upon the matters in this :resolution set forth, In order that the State Highway Department shall be informed respecting the same for its immediate action because of urgency. I Resolved that because of recently completed extentions of State Highway No. 82, in ''itkin County and extentions being made, and to be made, work on same now in progress, the County of Pitkin needs and applies for from the State Highway Department for Maintenance of said roads sections completed and in progress to be completed early in 1925, the sum of '10,000. for maintenance in 1925 and requests that said amount be set over to Pitkin County for that 1 purpose to be met by an equal amount from Pitkin County. Crawley 6.10 Upon the request of the School Board of District No 1. that the Board of Commissioners apportion the money derived from the Forestry appropriation, at the rate of 95°x' for General School purposes, and 5% for general road purposes. Upon motion the said request was granted, and the Superintendent of Schools and County T authorized and directed to do apportion said Forestry funds. The treasurer having reported the sum of $2,705.68 having been received from the Forestry Department. The Treasurer reported an overdraft on the Poor fund in the sum of $950.96, and a balance of $508.19 in the Mother's Compensation Fund, and the sum of $3,715.78 in the County Con - tingent Fund. Upon motion it was ordered that the treasurer shall transfer $500. from the Mother's Compensation fund and $700. from the Contingent fund to the Poor Fund to care for said overdraft. Meeting adjourned to meet again_at 10 A. M. on Tuesday the 2nd. day of Dec- 1924. • Meeting called to order on Dec - 2nd. and all members were present. The petition of Jos- Chitwood to the Colorado State Tax Commission was returned, approved. Peter Susteric having offered to purchase the tax certificates and taxes to date on Lot I, , Block 107, Aspen, offering the sum of $17.00. Upon motion the said offer was accepted and the treasurer and clerk authorized and d irected to transfer and assign said certificates for said sum. George Stringer having offered to purchase the tax certificates of sale and the taxes to date on Lots K. & L. Block 30 Aspen, offering the sum of $50.00. The following resolution was adopted; - Be it Resolved, That the COMMISSIONERS DISTRICTS OF THE COUNTY OF PITKIN shall be altered and shall henceforth be bounded and described as follows, viz:- . District No. Two. . Beginning at a point on the line of Gunnison and 'Pitkin Counties, thence due north to the mounth of Maroon Creek and continuing in the same course, north, to the Eagle and Pitkin County line, thence following in a northwesterly course the lines.of Eagle and • Garfield oounties,'and continuing in a generally South Eastern course to the place of beginning on the Gunnison and Pitkin Counties line; Distriet.No. One.- Beginning at the point on Maroon Creek, where. Bleeker btreet of Aspen extended Westerly would intersect the line described as the easterly boundary line of District No. Two across • from Gunnison County to Eagle County, thence in easterly course along the center of said • Bleeker Street extended, to its intersection with Lake County line, thence along the Lake County, Chaffee and Gunnison Counti.=es' line to the point on Gunnison County line where the East Boundary of District No• 2, starts, Thence Northerly along said District No. 2 boundary line to the. place of beginning ; District No. Three Beginning at the point where the center line of Bleeker Street, extended Westerly, intersects the East line boundary of District No. 2,• thence Northerly to Eagle County line, thence Easterly following the lines of Eagle and Lake Counties to the point of intersection of the center line of Bleeker Street extended easterly to the Lake County Line, thence Westerly•along the center line of said Bleeker 'treet so extended to the 'place of beginning. . On motion duly made and seconded the foregoing resolution fixing the lines of Com- missioner's.Districts as therein defined was adopted, Commissioners Brown and Williams voting in the affirmative amd Commissioner.Reed voting in the negative.
