The following members of the Board of County commissioners of Pitkin county met at 4:00
o'clock P.M. Monday January 5, 1942: George W. Smith, Commissioner District No. 1; Orest
A. Gerbaz, Commissioner District No. 2; Boyd R. King, Commissioner District No. 3; M. M.
Neihardt, Clerk.
George W. Smith was unanimously elected Chairman for the ensuing year.
By unanimous consent the meeting was declared to be as of Tuesday January 13, 1942, the
several members of the Board intending to be absent from the County on said date which is th
statutory date for reorganization.

The motion was made, seconded and carried that the Board approve the action of Geo. W.
Smith, Chairman in signing complaint against Frank Case for stealing articles from the
Commodity Room.
- Motion made seconded and carried that the County furnish sufficient postage to the Tire
Rationing Board for carrying on their necessary oorreapondence.
A motion was made, seconded and carried that effective February 1, 1942 the following
scale of wages should apply for work on the County Roads and State Highways within the Count :
Common Labor - 4 3.50
Truck, Tractor aiid Maintainer -
Operators and other semi - skilled labor 4.25 .
Overseers 4 4.75
The Clerk was instructed to write Pow-Jr Equipment Co. relative to their invoice No. 456
July 11, 1941, stating that t he reason for declining to pay their claim was that the parts
did not fit our equipment and that they had -been notified thereof. The equipment was
Austin Western Maintainer and-the parts were blades therefor. Also Gallion Grader.
- The following resolution was offered and, on motion duly adopted:
That the sum of 45,000.00 be appropriated from the State Speoial Road. Fund to the
Speoial Roads or Highway Fund for the maintenance of Highways -482, 104 and 133 within the
County, to be matched by a like amount by the State Highway Department as expenditure is
made during 1942.
The application of Chas. D. Hart for-permission and expenses to attend the meeting of
County Assessors at Grand Junebion in the near future was granted.
At the _request of the Governing Board of the Pitkin County Free Library, Mr. C. E.
Coffey was appointed a member of said Board for a period of threesrbars. ;sir. Coffey thereby
succeeding himself.
Marjorie Parsons was appointed for a period of one year or during the pleasure of the
Board to succeed herself as Clerk and Deputy.
The report of the County Clerk for the month of January 1942 was approved.

The County Treasurer was authorized and instructed to make the following transfers of
Funds: 81,000.00 from the State Special Road Fund to Special Roads Fund
600.00 from the Registered Warrant Fund to the Poor Fund
The Clerk was instructed to write the State Highway Department asking for a waiver of 9.
claim on the Stiel Bridgeaoross- Maroon Creek near the Dwyer or Skiff Ranch, said bring( be-
ing no longer on a County or State Road and the County Commissioners desiring to sell it.
The Clerk was instructed to advertise for bids for tearing down or for purchase -- -not
including wooden parts.

Owing to the difficulty of figuring fractional days wages the following adjust-
ment of prevailing wage scale was made:
Overseers from $4.75 to $4.80 per day
Semi Skilled Labor from 04.25 to $4.40 per day
The motion was regularly made, seconded and carried that the District Attorney
be allowed all necessary mileage and expense to investigate and render an opinion as to what
interest the County has in a certain road leading from the Capitol Creek Road between the '
two bridges near Fred Harts to the ranches off• W. J. Hyrup and Howard Shelhamer.
The Clerk was instructed to wrote the Power Equipment Co., relative to blades,
that we would await the call of the representatived and be guided by the findings relative
to the desirability and possibility of using said blades.
The Clerk was instructed to write Harold H. Richardson, Adjutant General stati
that we have no available publicly -owned quarters for troops or family groups but that there
are buildings which could be easily converted into such quarters, said buildings being privat ly
owned.

The report of the County Clerk for February 1942 was approved.
The Bid of $300.00 from Morse Bros. Machinery Co..was received for the Maroon
Creek Bridge. This was . not deemed sufficient. The Clerk was instructed, by regular motion
and vote, to make a further call for bids to be presented by the next regular meeting on
April 6, 1942 at 10:00 o'clock A. M. Other firms had desired to make a bid but the weather
had been such that they could not make a proper investigation. A

o'clock A. M., Wednesday, March 18, 1942, with the following members present: George W. Smit

The minutes of the meeting held March 2, 1942 were read and approved.
Poor Fund Warrant No. 6901 in the sum of $5.00 to ?: J. Sardy, dated Jan. 20,
1942, having been reported lost, the Board on motion cancelled the same and ordered the
Clerk to prepare Warrant in like amount bearing same date and issued to same Payee, to be
numbered 6901 -A.
At an informal meeting held on the evening of Marc # 6, at which Auditor Rai..
L. McKee was present, at which meeting the financial affairs of the County were discussed,
the Clerk was instructed $o write a letter for publication in the Aspen Times, setting forth
certain conditions to him named. In pursuance thereof the Clerk wrote the following letter
which appeared in the issue of March 12, 1942. The Clerk was instructed to incorporate said
letter into the minutes of thds meeting, with the approval of the Board concerning its conte•.s
and presentation.
A LETTER FROM THE BOARD OF COUNTY COMMISSIONERS TO THE PEOPLE OF PITKIN COUNTY.
Dear Friends:
Pearl harbor changed everything. Sacrifices must be made in the palaces of
rich and in the hovels of the poor. We middle -class folks must also cheerfully forego
pleasures and advantages which a few short months ago would have caused us to "yell our
heads off ".
While affairs so far have been beyond our control, the time has come when we
must, every one of us, assume control. And that eontrol can be assumed only in one way:
By taking what comes to us with cheerfulness and determining to make any and all sacri-
fices which will bring a quicker and more definite victory.
One sacrifice we must make is that of first class roads. This Board is the
body which has the superintendence of the road upkeep in this County and is charged with
the responsibility of wisely and effectively spending the road dollars. There are so
many calls upon these funds and so few dollars in aS.d fund, that this responsibility,
even in the beat circumstances, is heavy; but in times like these, this responsibility
is almost overwhelming. For that reason we are making this appeal for your complete
co- operation.
Last year the greater part of the road money came from the following sources:
State gas tax $19,000.00; County tax levy $1,000.00. For the coming year it is estimated
that Pitkin County will receive from the State gas tax about 50% of the above amount.
Thus it can be readily seen that there must be a curtailment of road expenses. Since no
one can see into the future, the decrease in funds may be even greater.
Further, out of the revenues received, must be paid certain outstanding bills
as followg: O;t steel bridge, $1,074; On Chevrolet Truck, $435.00; To the State for seal
coating Highway 02, $2,337.65. And still farther, some of the outstanding registered
warrants must be retired. So it is plain that road expenses must be "cut to the bone ".
The Board is determined not to increase the indebtedness.
The Board is determined to give the very best service possible under the cir-
cumstances. They can see no other way than to thy to keep the roads passable, ever retain-
_ ing enough funds ,to met some unforseen emergency. This conservation of funds must begin
now. It would be foolish to, spend all the money during the summer and then be compelled
to let the roads be snowed in next winter; or to keep a smooth surface the first part of
J the year and be unable to take care of a wash -out or land - slide later on in the year.
We know the people of Pitkin County. We know that you are loyal to your
government: County, State and National. We know that you will be considerate of us. We
know that you will co- operate and understand. We know that you will do everything, endure
everything, and take pride in every hardship, that we may speedily and definitely avenge

W. J. Leigh was authorized to haul the ashes away from the Court House for $5.00.
Mr. Robert W. Sears, representing the U S Fish & Wild Life Service (Box 328 Grand Janet-

ion, Colo.) was present and gave information relative to Chipmunks and the Wyoming Ground
Squirrel in Pitkin County.
Motion was made, seconded and serried that this County be declared a pest district so
far as those two named rodents are concerned and that the U. S. Wild Life and Game Service
be authorized to institute Rodent Control.
Motion was made seconded and carried that the County pay salary of one forman for 1942
season, time of service to be determined by the Board and that County advance money for
poisoned oats to be refunded by the A. A. A. organization in the County. Amount of funds
used to be at discretion of the Board of County Commissioners. Foreman's salary to be $4.80
per day for actual service, said foreman to furnish necessary means for his transportation.
The above was acted upon under Chapter 229 Colorado Session Laws for 1937.
Motion made seconded and carried to allow $50.00 for road work on road leading to Lam-
precht Ranch up North Thompson Creek. Clerk was instructed to notify John Arbaney, Carbonda e
of such action.
The County Treasurer reported a total of $14,159.18 in outstanding registered warrants.
The offer of the sure of $G.00 for tax sale certificate and taxes up to and including 1940
on Lots Q, R & S, Block 12 Aspen was received and ordered published.

The minutes of the meeting held May 4, 1942 were read and approved.
The following resolution was proposed and passed:
"The Board of County Commissioners hereby resolves: That the access of Wm J. Leigh
to the Surplus Commodity Rooms in the Court House at Aspen and to the handling of
surplus commodities in care of said County, is hereby denied, intil further action
of this Board ".
Motion made seconded and carried that the Board employ another person to make deliverieS
of surplus commodities until W. P. A. can certify a substitute for Wm. J. Leigh. '`�
The Clerk was instructed to notify J. D. Foster, Surplus Commodity Supervisor, Box 1076
Grand Junction, Colo., of the above actions, requesting that he meet with the Board at his
earliest convenience to discuss the causes of the above actions and to make further arrangements.
Mr. H. M. Van Loon was elected to succeed himself under the new set -up as Welfare
Director of Pitkin County at $135.00 per month.
The appointment of Pearl'Anderson as Clerk in Welfare Department was approved. At $85.00
per month.
The clerk was instructed to send a copy of the above resolution to Wm J. Leigh% by
Registered Mail.

Dear Sirs: The following is recommended as resolution for adoption by your Board:
"Trr Importance of controling fires in this County is recognized; also the necessity for
some organization to take care of any fires which may occur with the least possible delay;
Now, Therefore, We, The Board of County Commissioners, Pitkin County, Colorado, have this
day, June 1, 1942, passed a resolution to authorize the County Sheriff to designate men a
County Fire Warden and Cooperators. It is further resolved that such men so designated
shall have authority to hire men, hire transportation facilities, and arrange for supplies
and equipment necessary to put out any fire which may occur on Private, County, or State
lands with the least possible delay; further that the rates of pay shall be the same as
those paid by the Forest Service. So that only once organization will be necessary within kk:
this County, and to prevent confusion, the Sheriff will agree with the Forest Service and
Division of Grazing upo4 the same men. Fire training as necessary will be done in cooper-
ation with the Wardens, Forest Service, and Division of Grazing. Sons one person will be
designated to receive fire calls fob the different agencies. By news paper articles, etc., tt
the Wardens and Cooperators will be encouraged to telephone or send information to the
designated person, as soon as it can be done without delaying action on the fire. This
designated person will then report to the responsible agency or agencies ".

that the resolution was not quite clear, in that it was the intention of the Board that
Pitkin County should pay for the extinguishing of those fires which were on private or County
gaound.

- The BO9rd of County Commissioners met in Special Session :Monday July 17, 1942 at
10:00 o'clock a. 1.., for the purpose of discussing the filling of the vacanoy in the office
of County Sheriff paused by the death of Frank Bruin.
There were present George W. Smith, Chairman; Orest A. Gerbaz, Commissioner and M. M.
Nei ardt, Clark. also present was Carl W. Bul hum, District Attorney to give legal advice.
The Attorney advised the Board that it would be their duty to appoint a
Sheriff to fill the place until the next general election unless they saw fit to call a
Special Election at once.
The Board decided such Special Election was not necessary or desirable.
It was decided to defer the appointment of Sheriff until Friday July 17, 1942 and
Commissioner :ling was notified of such meeting by Registered Letter..
The following Resolution of Condolence was duly adopted:
RESOLUTION
Whereas the Board of County Commissioners of Pitkin County, Colorado, has been inform-
ed of the death of the esteemed and efficient Sheriff of Pitkin County, Frank Bruin;
Whereas the said Frank Bruin has served for many years as the efficient and honored
Public Servant of the People of said Pitkin County and his }gassing will be a distinct loss
to the people of this Courty;
Whereas his presenoe will be missed keenly by all his friends and by the many who
have been by him befriended, and especially by his close assooiates among the offioers
of Pitkin County;
Now, Therefore, Be It Resolved by the Board. of County Commissioners of Pitkin County
acting for themselves personally and for the other public officials and ernpli,yes of Pitkin
County, as well_as for the whole citizenry of the County, that we hereby express our regret
at his u.itimely passing and extend our heart -felt sympathy to his Widow and near relatives.
Unanimously adopted this 13th day of July a. D. 1942.

Otto Johnson was nominated and unanimously elected until the election and qualification
of his suocessor. His duties to take effect immediately upon uroper qualification.
Otto Johnson was also elected to serve as Janitor during the pleasure of the Board
at ,75.00 per month. The Janitor was instructed to ascertain the ownership of the various
articles of furniture and personal effects in the Sheriff's quarters in the Court House; to
dispose of them a:cordingly and to move his own furnishings and effects into said quarters and to
occupy said quarters as his home.

The reports of the County Judge and Clerk of the District Court for July presented

The action of the Board at the Special meeting of July 31, 1942, in selling Tax
Sale Certificate No. 66 (Improvements and Personal Property) was affirmed.
The question of wages for road workers was considered. Prevailing high wages
elsewhere (It was believed) would deprive the County of those experienced and faithful road
men on tom the Board so much relies. It was felt that for the best interests of the County
a raise of wage scale was proper. Accordingly Motion was made seconded and carried to adopt
the following wage scale, effective August 1, 1942:

FIRE ORGANIZATION AGREEMENT FOR PITKIN COUNTY
This agreement entered into by and between the Forest Service and the Grazing Se
vice that only one agnitenktua fire organization will be needed within Pitkin County to
take care of fires on Grazing, Forest and County lands,
Now, therefore, to prevent confusion, the Regional Grazier and the Forest Super-
-4„ visor, Holy Cross National Forest, will agree upon the same fire wardens and cooperators.
These wardens and cooperators are given authority by both services to hire men, hire trans-
portation facilities and arrange for supplies and equipment to put out any fire which may
occur on lands controlled by either service.
Further it is agreed that win a fire occurs in Pitkin County, the Forest Servic
and Grazing Service agrees to stand their proportionate share along with Pitkin County, said
expenses to be prorated between the different agencies and County in direct proportion to the
total area burned over lands controlled by them.
Further it is agreed that one person will be designate' by the County, Forest
Service, and Grazing Service to receive fire calla for the different agencies. By newel paper
articles, etc. the wardens and cooperators will be encouraged to telephone er send informatio
to this designated person, as soon as it can be done without delaying action on a fire. This
designated person will then report to the respective agency or agencies.

Honorable Board of County Commissioners of Pitkin County, Aspen, Colorado.
Gentlemen:_ Under date of August 20, 1942, your petitioner, The Colorado Fuel
V j and Iron Corporation protested to Mr. Charles D. Hart, Assessor, the 1942 assessed valuati c
on 8,090 acres of remote, undeveloped and abandoned coal lands which were assessed for the
year 1942 at the rate of $6 per acre, total valuation $48,540, which valuation was an lucre se
of $12,135 in the assessment over that of the year 1941, the rate previously being at $4.50
per acre.
Copy of such protest made to the Assessor of Pitkin County was sent to your honorable
board so that you would be fully acquainted with the matter. Under date of August 29, 1942
the Assessor of Pitkin County, Colorado, informed your petitioner that he denied the protes
regarding the valuation as above indicated.
Your petitioner, The Colorado Fuel and Iron Corporation, respectfully requests that
the Board of County Commissioners, sitting as a Board of Equalization, fully consider the
matter of reduction and grant to the petitioner a decrease in the 1942 valuation in the
amount of $12,135, the contention being that such increase is too high, discriminatory and
contrary to Article 10, Section 3 of the Constitution of the State of Colorado.
As it is impossible at this time to make personal appearance before the Board, you
are respectfully requested to carefully consider this matter, notifying us of whatever act-
ion is taken so that if it is necessary, personal appearance may be made before the Board,
commencing the third Tuesday in beptember.

Mr. Charles D. Hart, Assessor Pitkin County Aspen, Colorado
Dear Mr. Hart: The Colorado Fuel and Iron Corporation hereby protests the 1942 assesse
valuation of 8,090 acres of Remote, Undeveloped Coal Land which you have assessed at the
rate of $6 per acre, total valuation $48,540, which valuation is an increase of $12,135 in
the assessment for the year 1941, which assessment was based upon a rate of $4.50 an acre. 4
This acreage is located at Marion, Spring Gulch, Coal Basin and Placita, all of which locat o
have for many years been completely abandoned.
As you so well know, all of this land is remote, all of the possible locations have been
opened and developed in years gone by, the areas when in production,with the exception of
Coal Basin, being served and primarily operated for, the Colorado Midland Railroad, which
ceased operations many years ago; the Coal Basin area, however, being served by The Crystal
River Railroad Company branch line extending from Redstone, Colorado, to Coal Basin, which
line was abandoned after World War One, all track and other facilities being removed. In .:
operation of these properties color oven operations were conducted at Cardiff and Redstone,
both of which locations as you know have long since been abandoned, hence there can be no
question as to the remoteness and imposibility of viewing any of this land from any stand-
point other than its present use, namely, poor grazing* Some years ago, when your predecessor was in office, the Colorai o Tax Commission conduct _d
a reappraisal of land values in Pitkin County and the rate of $4.50 was determined at that
time and spread on the property of Pitkin County in an effort to thereby equalize the vario s
property values on the many classed of property existent inthe County. While the Colorado
Fuel and Iron Corporation did not approve of the value of $4.50 per acre being correct, we
always believing that such value was too high, the value was accepted due to the basis of i•s
determination, namely, twice the value of grazing land which at that time, I believe, was
assessed at about $2 ar $2.25 per acre.
All of this land has remained in our ownership only through necessity in that it is a
under our General Mortgage, the provisions of which are mandatory in that such ]and could
not be sold at any time during the term of that Mortgage other than the surface only and tin
all subpsurface rights, whether they were existent or not, must necessarily be reserved in
such sale. The Mortgage further provided that upon the sale of any surface it was necessary •
pay to the Trustee under t hat Mortgage the sum of $5 per acre for all such lands sold and I
am sure that you will agree with me that at no time could one ever realize the price of $5
per acre for such surface only. Fortunately this Mortgage expires next February and we wil
then be in a position to take immediate steps to dispose of such ownership which has been, f.r
the past twenty years at more, a direct liability rather than an asset.
I am presenting these facts to you, realizing that you are anxious to approach this prob1 m
in an honest and fair manner and I do not believe that you were aware of all of the facts pel-
taining to such ownership at the tine of your discussion with Kenneth Mark, Bert Brenton and
Nick Buckholz.
You are respectfully requested to reconsider the increase which you have placed upon this
- 3roperty and ask that you consider making a decrease in the valuation in the amount of
$12,135, thereby placing the valuation on the same basis as has been carried for many years.
While we definitely plan to make disposition of this property next year, I can only feel
that the action which you have now taken in increasing the value can be but a detriment to i s
future continued use by any of your local constituents.
As further matter of information: I cannot help but inform you that the action taken in
this instance has not been fully carried out by Kenneth Mark of Gunnison County, he reducing
the valuation on but 385 -acres in his county to the value of $6, while considerable remote
acreage still remains in his county which has not received the reduction as agreed upon in
your conference. Further, Mr. renton has not, when I advised him in July, made any reduct
ion on the same land which extends into Garfield County; however, he did later modify his
valuation to conform to the so- called agreement in that he reduced valuation in his county
on 1,119 acres from $8 to $6 per acre, he not, however, making any decrease on an additional
5,955 acres which he still carries at $8 per acre. I cannot help but believe that this actin
taken by Mr. Buckholz in an effort to bring about equalization has been in vain in that careful
consideration was not given to the problems in the three different counties, nor to the land
itself, which, after all, is the important factor, and you can readily see that the action
which you have taken, which has brought about an increase in our assessed valuation in exce s
of $12,000 has not netted a decrease at all comparable in the other two counties.
Since it is impossible for me to appear before you personally it has been necessary tha
this letter cover more than would be essential to the ordinary protest, and I shall apprecia•=
it very much if you will give this matter your careful consideration at this time so that it
will not be necessary to make appearance before your County Board of Equalization in Septemb =

day September 15, 1942 with the following members present: George W. Smith, Chairman; Crest

The minutes of the meeting held September 8, 1942 were read and approved.
The following claims, having been approved by the Pitkin County Board of Public Welfa ',

The Clerk was instructed. to write Stanley Hahnewald at Snowmass, stating that compla t
had been made as to accommodations during the Primary Election at the polling place at that
• precinct; that the rental of $10.00 for each the primary election and General Election
(including one day each election for registration) was to cover the cost of providing
adequate heat and light for the use of the Judges of Ellction and the voting public; that
the Board would expect adequate provisions for the General Election.
On Motion, duly seconded and carried the salary of Marjorie Parsons as Clerk was
raised from $ao.00 to $100.00.
On Motion C. B. Rader was appointed as Co- ordinator of the Pitkin County Civilian
Defense Council.
The meeting was n mlxm4 declared to be resolved into a meeting of the Pitkin County
Board of Equalization.
"' The potion of Mike Paulich was granted to the following extent: Improvements on his
dwelling were reduced by the amount of $40.00 - -- $20.00 to correct error and $20.00 to
equalize the same with other contiguous properties.
J The petition of the Colorado Fuel and Iron Corporation for reduction of valuation on
undeveloped coal lands from $6.00 to $4.50 per acre was denied on account of the fact that
our valuation was already less than that of other contiguous counties. The Assessor's
valuation was not deemed exorbitant or out of oportion.

The Board met at 10:00 A.M. Wednesday Septem r 16, 1942 with the same members present
as on the preceding day. No business appearing the Board adjourned to meet on Thursday Sept.

The matter of the Valuation of 8090 acres of abandmned coal lands was again taken up and
the action of September 15 relative thereto was rescinded and the property was equalized
by placing a value thereon of $3.25 per acre.

Tn addition to the foregoing levies, the Commissioners are required by law to levy .20
mills for Colorado River Conservation.
The levy is based on a valuation of $2,186,113.00.
It will be seen from the foregoing levies that the Commissioners have left the total count?
levies the same as for 1942.
It is estimated that there will be a deficit at the end of 1942 of about $8000.00. This as
compared to a deficit of $21000.00 at the beginning of the year. Because of a reduction in
estimated gasoline tax revenue for 1943 we estimate a deficit of $100000.00 at the end of
1943.
In preparing the budget the county officials felt that'any increase could not be justified
in the face of rising living costs at the present time.
Complete cooperation of public officials and employees and taxpayers will be required to
prevent further deficits or increase in taxes in future years.

The board of County Commissioners of Pitkin County, Colorado, met at 10 :00 A. M.
Thursday December_ 17, 1942, with the following members present: George W. Smith, Chairman;
Orest A. Gerbaz, commissioner; M. M. Neihardt, Clark.
The minutes of the meeting held December 7, 1942 were read and approved.
The Bondsof Robert S. alley as County Treasurer of Pitkin County for the term beginni g
January 1, 1943 and as Public Trustee for the same term, in the amounts of $30,000 and $5,0.>0
respectively, given by him as Principal and the National Surety Corporation as Security
were approved as to form and sugficiency.
The `Clerk "was instructed to speak to John L. Herron as bead of the Rationing Board
that according to the contract signed by the Board and representatives of the Office of
Emergency Manager, Pitkin County was to furnish "heat, lights and electric'energy; janitor
service; toilet facilities. That "Any service other t han those shown above, necessaryto the
operation of the office are to be furnished by the Government ". Clerk was further instructs d
to request that telephone bills in the future be paid by the Government and that refund be
made for past telephone bills amounting to $30.85
