Deoember 3, 1935 TO THE HONORABLE BOARD OF COMMISSIONERS PITKIN COUNTY, COLORADO Gentlemen: Under advice from an attorney, we are herwith and herein, again calling your attention to the dangerous condition of the following buildings, to -wit: The Gould & Grover, or Charlotte Grover old oommission building situate on corner of Hopkins and Monarch streets, which has been condemned by the City as a menaoe, fire trap and nuisance, and should be immediately torn down or steps taken to make necessary repairs to make the building safe. Also the building on Cooper avenue known as the Emmett Block, which has been similarly condemned for the same reasons. Albert Maurin complained and objected to a valuation of 420.00 per acre on irri- gated pasture land as being too high. Mr. Hammond,the appraiser,stated that there are about 1000 acres in the County belonging to Williams Brothers, Louis Vagneur, Sullivan Vagneur, Mr"s. Brown, Fred Hart, et. al. Complainant asks for a out of 410.00 per acre. Complainant states that he is 5 miles from the Railroad. Board adjourned to meet at 10:00 A. M. Thursday September 3, 1936. The - Board met at 10:00 A. M. Thursday September 3, 1936 with the same members present as on the preceding day. The following complaints were heard: Mrs Mary Stott complained that her raise in valuation was too great. Dellore Vagneur complained that his value was too high on account of altitude. He stated that he raised 1/3 less than did those who had bottom ground. Albert Duroux complained that his land was too high at 450.00 and alould be 445.00. Sullivan Vagneur complained his valuation was too high, being higher than his neighbors with like ground and conditions. He stated that his hay land was higher than his neighbors' agricultural land, that he had rock bottom. Asks assessment on equal basis with Capitol Creek, Snowmass Creek and lands up to Aspen. Stated there should be not over 45.00 difference from others away from road, that hay lands should be the same. James J. Vagneur stated he was assessed at 450.00, that he had Mesa land, that he .. was at the tail -end of the ditch, that his land was gypsum - underlaid and steep. Justin Cerise stated that his land was worth no more than that of his neighbors, that it is rocky, that land does not hold water. Albert Grange says his land is too high, that he can't raise two crops so easily as others and that said land is hard to plow. Fred Gagnon complains about pasture land (about 100 acres) above his house, assess- ' ed at 42.50 per acre. J. J. Gerbaz complains because he is higher on first class land than the Carroll ranch. Same crops raised. Asks equalization. Mrs. Antonioli states that 460.00 is too high on her land. Stated that they get veri little water, that they are high altitude. Asks equalization with others. Mrs. Brice Arlian states her valuation is too high according to people b &low her. She states she gets only one crop of hay, that she has insufficient water and scabby potatoes. That all of the said land is underlain with gravel which necessitates the application o more water per acre to obtain the same yield of crops per acre as these similar lands mentioned. Especially is the barren, steep, mesa land assessed too high because the soil is originally low in natural fertility, it is necessary to maintain a twenty -two mile ditc' in order to bring water to this land and water is only available part of the time, and the land is steep so that the operation of machinery is difficult. I ask the Honorable Board of Equalization to make and equitable adjustment. Tagert on Sept. t was officially approved and passed: Whereas the U. S. Forest Reserve offers to build a road from Aspen to Ashcroft and desire to secure thru the County of Pitkin all rights of way necessary for this purpose and Whereas W. C. Tagert in order to induce this road construction offers a right of way thru, the Tagert Ranch in the Highland District in accordance with the U. S. Forest survey, de' ' seription hereto attached. Therefore be it resolved by the Board of County Commissioners that the right of way above described be accepted by the Board of County Commissioners and that a quit claim deed by W. C. Tage t emx cohering the said right of way be accepted for this purpose with the understanding and agreement that the County construct a fence on each side of the right of way in accordant with ' the following specifications: - -6 wires, galvanized, standard gauge, cedar posts, 16 ft apart, set 2 ft. in the ground and two stays between them and that the present road thru the Highland Ranch be returned to the said W. C. Tagert an, that . , the present fence on the Forest Reserve adjoining the said ranch be rebuilt. Forest Supervisor, it was agreed that the County shou d furnish planking for a bridge to be constructed across Castle Creek on the Crosby ranch on the road leading from the proposed new Aspen -to- Ashcroft Highway up into Conundrum Gulch provided that the Crosbys furnished the heavy timbers and the Forest Service did the work of putting, in the bridge. Said planking to consist of enough three -inch Engleman spruce or other like material to construct the flooring of a bridge approximately 35 feet long and 14 feet wide over all. Flynn of Aspen, Colorado, hereinafter called 1 second party, W ITNESSETH : First party hath let, leased and demised and by these presents does, let, lease and demise 'unto the seoond party the following desoribed realty known as the Aspen Raoe Track lying on th North of the Aspen Townsite as the same is now located. It is further mutually agreed that the first party will permit no other person or persons and /or corporations to occupy the said demised lands for any use whatsoever without first obtaining the written permission of the second party and that such use shall be for ball games and /or other public functions of the City of Aspen and /or County of Pitkin and that the said functions or activities will be so oonduoted as not to interfere with the operations and maintenance of the landing field and the in- ooming and out -going of planes. It is further agreed and understood that the seoond party may release any and all parts of the above demised land by paying to the first party the sum of fifteen dollars (415.00) at any date and that suoh payment will release second party from any further obligation under this contract. It is further mutually agreed and understood that the second party shall have the right to : remove any and all equipment planed upon said lands including buildings at the expiration of this lease and extension thereof should he so desire providing that he has paid the rent and maintained the field in accordance with the laws and regulations governing the same as herein • expressed. It is further mutually agreed that any failure upon the part of the seoond party to perform eaoh or any or all of the covenants and oonditions of this lease incumbent upon him to be performed shall oonstitute a default hereunder and entitle the first party to declare a forfeiture of all rights of the second party under this lease. Notice otaniy such declaration of forfeiture shall be given the second party in writing, mailed to seoond, party at his address, Aspen, Colorado. Upon default olaimed by first party, exoept a default in payments, first party shall speoify.in notioe of such default the particulars in which it is claimed that second party is in default hereunder, and shall further notify second party that is failure to remedy any suoh default will result in forfeiture at the expiration of thirty (30) days from date of such notioe from the first party in which to oure any suoh default. I If such default be oured within said thirty (30) days, no forfeiture shall result, but if suoh default be not cured, forfeiture of second party's rights shall take place at the expira- tion of said thirty (30) day period and no further notioe from first party shall be required.
