Aspen, Colorado December 30, 1944
Resolution adopted by the Board of Directors of the Pitkin County Bank of Aspen, Colordo
as of the above date.
Whereas, sixty -five residents of Pitkin County, joined by non- residents with interests in
Pitkin County, have placed the necessary funds up for the capital structmre of the Pitkin
County Bank, in order that such county might have the advantages of banking service within
its borders;
And, that in placing such funds up, and lendir their good names to the institution, without
expectation of any particular monetary return, they have created and maintained in Pitkin
County since June 1, 1942 valuable and helpful banking facilities with a degree of safety to
depositors that few if any banks can claim from the standpoint of how it's deposits are inve ted,
as shown by the figures below taken from the annual report of this date;

That, while such a condition makes for the depositor the strongest guarantee possible, which
in years ahead may be important, it does not provide the bank with sufficient income fo
it's sound operation. That the Board of Directors have seen, and the State Banking Department
have ordered, a measure of fair service charges be installed to insure that the Pitkin Count
.Bank may continue this strorq position and fulfill it's duties and obligations to the citize4s
of this county;
Further, that while the Board of County Co::::nissioners under the laws of Colorado have sole
authority for the designation of the bank or banks in Colorado in which funds of the county
may be deposited and drawn upon by the County Treasurer, to date only a portion of such fund
have been maintained with this, the only bank in Atkin County, although the bank has at all
times offered to accept and properly secure such funds as required by the laws of this stat ;
Therefofe, it is respectfully requested that the Honorable Board of County Commissioners
designate only the Pitkin County Bar:k as the lawful depository of Pitrin County funds, with
the full assurance that such fundw will be received and properly secured as required by law.
Further, that such accounts be covered with fair service charges in line with such charges
of other depositors, and that may be agreed upon between such 'Board of County Commissioners
and Board of Directors of this bank.

The reportt of the County Clerk for January 1945 was approved.
The reports of the Clerk of the District Court and of the County Judge were presented.
Dr. W. H. Twining was re- elected as County Physician at $400.00 per year.
The Petition of C. McDade for abatement of tax as set out below was granted:
Lot R Block 45 assessed as•follows in 1944. Lot 25.00, Improvements $45.00. Petitioner
represented that buildings had all been removed in 1943 and asked abatement of the tax
on $45.00 assessed thereon. Abatement granted in amount of $3.69
The following resolution was adopted: RESOLVED, That the sum of $5,000.00, or so much
thereof as may be required, be appropriated from the State Special Road Fund, for the
maintenance of State Highways within the County said amount or portion thereof, to be
matched with equal amount by the State Highway t epartment.
The Clerk was instructed to write the District Attorney as to whether there is any
possible authority vested in the Board of County Commissioners to transport High School
children from Rock Creek District to.Carbondale or to pay their tuition there.
The Clerk - was instructed to advise Lowell A. Griffith, Representative in the Colorado
General Assembly that this Board favors an increase of the salaries of County Officers in
any amounts the General Assembly may see fit and suggests the salaries approved by the
State Association of County Commissioners at their last meeting, as follows: Treasurer,
Assessor, County °Clerk, Sheriff $1,800.00 per year; County School Superintendent($1,600.00
per year; County Commissioners $800.00 per year in Pitkin County.
The Clerk was instructed to write Liberty Truck & Parts Co., informing them that this
County wishes to buy Maintainer. That, if they do not have any under present conditions,
that we have such second hand machine in sight al the Joe Smith New and Used Machinery Co.
4120 York St., „Denver; and would appreciate their-help in securing the sane and in making
any replacements that may be necessary.
The County Treasurer was authorized and instructed to transfer the sum of $1,000.00
from the State Special Road Fund to the Special Roads (Highway)Fund.

ASPEN LIONS CLUB
ASPEN,COLORADO January 17, 1945
To the Honorable Board of County Commissioners of Pitkin County: -
At the regular meeting of the Aspen Lions Club held January 15, 1945, the following
resolution was unanimously adopted;
"Whereas, in order that Pitkin County could have banking facilities for the general good
of such county, which has been supported not only by the members of this club, but by the
citizens ingeneral, and,
Whereas, it appears that such efforts have been supported to a very small degree thru th-
action of the Board of County Commissioners in allowing the bulk of the public funds under
their jurisdiction to be carried in an institution outside of Pitkin County,
Therefore, be it resolved that such Board of County Commissioners be requested to take
immediate action to remedy this situation, as it is the opinion of the. Aspen Lions Club that
there is not pow, nor has there been at any time since the opening of the Pitkin County Bank
justifiable reasons why such funds and business of the county have not been transacted

Gentlemen: -
In connection with our request that the Pitkin County Bank be named as sole custodian of
Pitkin County funds, our directors have gone into the matter of service charges. In this re-
spect it was our intentions to make such charges as small as possible consistent with the
necessity of such charge for any bank to maintain banking services in Pitkin County, and
taking into consideration that while large balances are not so helpful now in bringing in
income, in the years ahead it could be most important. Further, that it would not only bring
direct benefitSto us, but indirect benefits not only to us but to citizend of Pitkin County
in general.
While in conversation with County Treasurer Killey today, he advised that 560
in pledged securities would be ample to take care of his maximum dhposit needs, which amount '
we will be pleased to place up, as well as any additional should the occasion demand, in
order that such funds may be properly protected at all times as required by law. In connection
with service charges, he requested that such charges be billed to the county in order that
they might not interfere with the totals of his daily deposits or bank balances, which is
proper.
On the basis of estimated business, our present charges if- arplied would bring in the
following income, figured on a monthly basis;
County and Welfare warrants, 275.@ 10d each 27.50

Our directors have felt that a flat charge to the county of 515.00 monthly could be
made, billed to the county monthly or quarterly as the commissioners might desire. Our pres-
ent charge of 10i per warrant to non - depositors on county, welfare, and school district
warrants within the eounty drawn upon our county treasurer would be withdrawn, and we would
then cash such warrants without any charge to the holder, At the present time this charge is
bringing us in an income of $20.00 more or less monthly.
Such charge of $15.00 monthly would also include the depositing of all items drawn upon
outside points, payable to any of the county officers or office, and taken in connection wit
their duties therein, and where drawn directly in their favor. We wish to stress the "drawn
directly in their favor" as otherwise abuses might creep in that would destroy the working
of the plan. All taxes and moneys due the county are payable by law in cash. For convenience
of the taxpayer, county officials more often accept checks and drafts. This means that we
will accept such checks drawn directly by the taxpayer or whoever might be owing the county
without any charge if such check or draft is made directly to the county or its official,
but that such taxpayer may not save up his cream checks or other checks made to him and tend
. them in payment free from exchange charges. The taxpayer should deposit such items or cash
them at his local bank, and this arrangement would give the official just grounds on which t.
ask for cash or a check direct from the taxpayer. Should the official accept such items not
made directly to him, he should collect the exchange charges of 10d per hundred dollars per
item (items less than $50.00 only 5d) due to the fact that he will be expected to pay such
charges when deposited at the bank. We believe the board can see the necessity of such an
arrangement where the county is given a flat rate, And muti.al geod business for all concerne..
In consideration of the flat rate, no maintenence or service charge will be made on the
account, and the bank will furnish the necessary escrow holder and agreement.
Inasmuch as the large majority of warrants and outside items handled belong to the welfa
board, we consider that it would be entirely in order that such department stand at least
$10.00 monthly of the charge. Our present income of around $20.00 monthly is mainly fro;
welfare warrants, which charge would be eliminated with the proposed flat charge. Our ex-
pense in handling county warrants is likewise mainly from shipments of cash to meet such
warrants. We make this suggestion only to give the board an idea of approximate'', costs

State of Colorado, amending Section 8796 of the Compiled Laws of Colorado, 1981, as amended,
4 and approved January llth, 1934, and relating to the deposit of public funds in banks by
County Treasurers, and providing "That in all Counties in this State, the County Treasurer
shall deposit all the funds and moneys of whatsoever king that shall come into his possess-
ion by virtue of his office as s e County Treasurer in one or more responsible banks locate.

ioners of Pitkin County, Colorado, there 44 hereby approved and designated the following
named bank, located in the State of Colobado:

in which said bank the Treasurer cf Pitkin County, Colorado, shall deposit
all the funds and moneys of whatsoever kind that shall come into his possession by virtue of
his office as such County Treasurer, in his name as such Treasurer, as provided by law.

Be It Further resolved that the operation of this resolution shall be deferred until such
time within the period of 60 days, when the said Pitkin County Bank shall have submitted
Escrow Agreement and list of securities which shall receive the approval of this Board.
It is the intent of this resolution that it shall, at the time of said final approval of
Escrow agreement and securities, supersede all former resolutions of this or former Boards
of County Commissioners of Pitkin County, relative to approved depositories of County Funds.

February 17, 1945, with the following members present: George W. Smith, Chairman; Crest A.

The minutes of the meeting held February 5, 1945, were read and approved.

The Clerk was instructed to write Senator W. H. Twining regarding the proposed re-class-
ification of Counties in respect to salaries of County officers, stating that all advanced
in salaries as proposed are satisfactory but recommending in Pitkin County, increase in
salaries of Assessor, Sheriff, County Superintendent of Schools and Clerk of the District,
Qourt over the proposed salaries.
The resolution was offered and adopted that the board take steps to appeal the classigic -
tion of Henry Oscar Hendrickson on account of his place as Truck Driver ant being vital
and necessary with no possibility of being filled by another man.
The following resolution was offered and adopted: That the compensation} of the employes
of the Welfare Department will be approved in accordance with the schedule as presented
by the Merit System, with the approval of the State Department.

The following letter was received from the Pitkin County Bank:

Hon. Board of County Commissioners Pitkin County Aspen, Colorado
Genrlemen:- In accordance with your resolution of February 5th designating the Pitkin County
Bank as the sole depository for Pitkin County Funds, we have today handed Mr. Killey, County
Treasurer, escrow agreement signed by the First National Bank of Denver, Colorado as escrow
holder pledging $60,000.00 in United States government securities for the protection of such
county funds.
This will allow for a maximum deposit of $54,500.00, which Treasurer Killey had advised
us would be ample to take care of all maximum needs.. Should occasion arise for protection
of more funds at an = time in the future, we will be glad to increase our securities accordin ly.
You will note that $30,000.00 of the securities pledged become due April 1, 1945, which
we have authorized the escrow holder to replace with like new securities at such time, and f r
which the escrow holder will furnish the Treasurer at such time with proper receipts coverin
such renewed security.
The escrows is now complete, signed by all parties concerned, and the securities placed
with the escrow holder, awaiting your approval of same.

The matter of the approval of the secorities furnished by the Pitkin.County Bank was
laid on the table on account of the absence of Commissioner Gerbaz.
The County Treasurer reported the receipt of the sum of $4,383.03 from the State as
Pitkin County's apportionment of Forest Reserve money. On motion, seconded and carried,
the Treasurer was authorized and directed to place said amount in funds as follows

It was moved and carried to extend the resolution to employ Ralph L McKee as Audito
of County Books to include 1946 as well as -1945 at the rate of $200.00 per year for two ,,.

The Clerk was instructed to prepare a contract and send to Mr.. McKee for his signature.
The report of the County Clerk for February was approved.
The reports of County Judge and Clerk District Court were presented. x
Motion made seconded and carried that the County contribute the sum of 525.00
to the American Red Cross, and that the Chairman be authorized to increase the contribution
to $50.00 of necessary for the County Red Cross organization to reach its quota.

THIS RECEIPT AND ESCROW AGREEMENT, made, execpted and delivered in triplicate by and between
Robt. S. Killey, as County Treasurer of Pitkin County, Colorado, first party, hereinafter
called the "Treasurer ", Pitkin County Bank of Aspen,Colorado, second party, hereinafter call d
the "Bank ", and the First National Bank of Denver, Colorado, third party, hereinafter called
the "Escrow Holder."
Witnesseth, that whereas said Treasurer desires to deposit in said Bank, from time to time,
divers funds and money, which have heretofore, or shall %hereafter come into his possession
by virtue of his office as such Treasurer, the amount on deposit together with interest they on
not to exceed Fifty -four thousand five hundred Dollars.
WHEREAS, said Bank wishes to receive such deposit. and, in lieu of the giving of a depositor
bond, desires to, and does hereby pledge the following described securities, which are of th
market value of at least ten per centum more than the amount to be on deposit at any one ti ,
and interest thereon, to be held in the custody of the Escrow Holder as security for the
prompt payment-of such deposits and interest thereon, vix.:

NOW, THEREFORE, in consideration of the premises, it is mutually agreed by and between the
respective parties hereto as follows:
1. The Escrow Holder hereby acknowledges receipt from said Bank of the above described ^'
securities to be held by it for the purpose above stated and subject to the terms and con-
ditions hereinafter set forth.
2. Said securities, while the saw -.so remain in the custody of the Escrow Holds., shal
be considered as security for the prompt payment upon the check or draft of the Treasurer of
any and all such deposits now or hereafter, during the existence of this agreement, made by
him as such Treasurer, and of all interest accruing thereon; and in the event said bank shall
1 fail, refuse or neglect to promptly pay over to the Treasurer said deposit or deposits or any
part thereof or any interest thereon upon any such check or draft, such failure, neglect or
refusal shall be deemed or taken to be a default pursuant to the terms of this agreement, an
in such event upon written notice by the Treasurer of such default or failure, the Escrow
Holder shall deliver over to the Treasurer all of said securities to be sold by him and
applied in the satisfaction of said default. -
3. In the event the deposit secured hereby shall be reduced, then upon written instruct-
ions of the Bank and Treasurer to the Escrow Holder, the Elscrow Holder shall redeliver to
the Bank any part of the securities then held hereunder in accordance with such instructions.
Substitutions in securities held hereunder may be made upon written instruct ions of the Bank
and the Treasurer.
4. In the event the Treasurer shall at any time withdraw all of the deposit or deposits
made hereunder, thereby closing his account with the Bank he shall immediately certify in .
writing such fact to the Escrow Holder and said securities shall thereupon be.returned by the
Escrow Holder to the Bank, and this agreement thereby terminated.
5. Ifat any time, by reason of any diminution ton the market value of any of said secur-
ities, or of further deposits made by the Treasurer, it shall become necessary for the Bank to
pledge further securities hereunder and such pledge is in fact made, a receipt for such
additional pledged securities shall be signed by the Escrow Holder, in triplicate, and a copy
thereof shall at once be attached to, and kept with each respective copy thereof, and all
such further securities shall likewise be held subject to all terms and conditions hereof.
The Escrow Holder shall be under no obligation to inquire into, or determine the sufficiency
of the market value of any securities deposited hereunder or the need for any additional
securities.
6. Until the Treasurer shall have notified the Escrow Holder in writing of the existence
of a default, interest accruing upon any of these said securities may be collected by the
Escrow Holder and remitted to the.Bank; but after the Treasurer shall have notified the
Escrow Holder in writing of the existence of a default, no such interest shall be f94d over
to the Bank by the Escrow Holder,.but all such interest shall be deemed a part of the secure '
ity for such deposits and interest thereon, until such default or defaults shall have been
cured; provided, however, that with respect to any fully registered securities held hereunder
the Eacrow Holder shall have no duty concerning the collection or disposition of income thereon. (�
7. All fees and charges of the Escrow Holder shall be paid by the Treasurer. The Escrow
holder shall not be charged with any notice of default hereunder until served with written
notice thereof by the Treasurer. ��
8. One copy hereof shall be kept among the records and files of the Bank; oneAbhall be
kept in the custody of the Treasurer, and the remaining copy ahll be kept by the Escrow Holder.
9. This receipt and agreement shall be binding upon the successors and assigns of the
respective parties.

Mr. H. L. Jenness of the State Highway apartment was present and explained the Depart-
-,. manta plan for designating certain Federal Aid Secondary Roads. The Following RESOLUTION
was offered and on motion unanimously adopted:

The Official Bond of James B. Bray as Justice of the Peace given by him as principal
and the Columbia Casualty Co. in the amount of $1,000.00 was approved as to form and suffi-

M. M. Neihardt was instructed to execute a fire insurance policy on the Westerly Garage

Said party of the first part agrees and hereby does let the contract bo said party of the

and 1946 as follows: Two semi - annual audits each year, or at such other times as may work to
the advantage of both parties.
Said party of the second part agrees to make thorough and systematic audits as above set
'forth and to render an account thereof to the said party of the first part.
Said party of the first part agrees to pay said party of the second part the sum of $200.0
per year, in installments of $100.00 for each semi-annual audit and said second party agrees
to accept said amounts as set forth above, in full payment for said service.

The- Clerk was instructed to write F. W. Yale of the Colorado Fuel & Iron Corp., that ,,
Pitkin County has no plans to use any part -of -the old Crystal River Rif&sead as a Highway ,
but to suggest that the State Highway Department be contacted to,find out their intentions.
The Clerk was instructed to reply to the letter of Lt. E. M. Vonder stating that on acc. of
gasoline restrictions, snow and shortage of equipment it is not possible at present to open
up Highway to Ashcroft for skiers; to inquire if plans are to remain near next winter so than
they will desire the highway kept open; to state that Pitkin County's action in the matter w 11
depend upon securing equipment.
The Resolution was unanimously adoptasi -to request the County Treasurer to make a list of

At the request of the General Land office, tiic board savowed any desire to abquir-
title to 31 acres of land situated in Lots 6 & 7 in Section 7, T. 10 S., R. 84 W. 6th P.M.
which lies Northeasterly from the Court House, on which are situated the dwellings belchngin",
to members of the Zupancis family and which Elizabeth Borstner desires to Homestead.
Clerk was instructed to mail certified copy of order to C C Mather, General Lend Office, 'I
355 Federal Building, Salt Lake City, 10, Utah.
It was agreed to lease the Race Track to John Hoaglund for the berm of five years at ;5. b0
per year, payable on May 1, of each year, beginning on Aug. 7, 1944, first payment being
due at once (May 1, 1945), unless said race track should be plowed, cultivated and used am
agricultural land, in which case the rental should equal the taxes assessed on land of equal value
used as agricultural or cultivate land based on an acreage of 5 acres. Provided, however, th t
the County reserves the right to terminate this lease whenever said land is needed or desire
by the Board for public use.

Milton G. Conner was appointed as County Veterans Service Officer and the jury room
at the head of the stairs in the Court House (West side) was appointed for his use.

Gentlemen: One of the farmers living in Pitkin County suggested to me the other day tha
he though it would be no more than right for Pitkin County to pay something toward my ex-
penses and salary for work done on the labor program in that county, for the last year and
what will be done this year.
As you probably know, we have taken care of the Mexican Nationals in that county making
several trips through the summer which runs into mileage, and also have made several tele-
phone calss concerning the placement of labor. To date this county has taken care of these
• expenses which hardly seem fair to them, although they have made no kick.
I am wondering if $50 per month for the next six months would be too much to ask your
board to pay for the service. If this would be agreeable, I would take care of whatever
mileage and telephone calls there were and keep the balance.

The Clerk was instructed to write Darrell Vail asking what the chancees were to get
2 or 3 tanks of oil for repair work on Highway 82 within the next 30 days or so; to ask a
reply so that we can get gravel ready; to request that he come at his convenience to look
over the roads.
The request of Charles Garlington for cancellation of all taxes on certain mining prop-
erties, on his payment of all treasurer's fees was laid on the table.

The matter of the application of Pansy Trotter for Beer Wine and Spirituous Liquor Li
at kedstone was taken up after having been refused. On Motion duly seconded and carried
the same was granted.
A Lease was signed whereby the County leaned to Johnnie Hoaglund for the term of five
years beginning on the 7th day of August 1944 (being a renewal covering the property ,.
known as The Race Track northeasterly from and contiguous to Aspen. Consideration $5.00
per year provided that should land be plowed, cultivated or used as agricultural land
the rental shall equal the taxes assessed on land of equal value used as agricultural land
based on an 'wigwags area of five acres. Lease may be terminated by County whenever land is needed C...,

Clerk was instructed to write Mr. Thomas K. Younge at Grand Junction, telling him t it
the matter of snow- plowing at Norrie had been investigated; that they had ascertained that
the work had been done on private property and had been ordered by the representative of tie
Biggs Kurtz Company; that the custom is to charge for work done on private property, althol
occasionally such charge has been waived when a amallamount of plowing has been done at th
time the plow is passing along the highway, but not on special trips as was this one.
That, in this instance, without setting a precedent, the County will include these service
in the claim of Mr. Crowley and that Mr. Crowley is being paid by the County.
The Clerk was instructed to inform Arbaney Brothers that the County will pay for th
necessary materials for the rebuilding of the bridge on the North Thompson Creek Road;
that the Board will be over in that country and will contact them about the lumber.
The Clerk was instructed to write A. V. Lough, County Agricultural Extension Agent at
Glenwood Springs that the Board is willing to pay him $25.00 per month for 4 months for
work reaching into Pitkin County.

Minutes of the meeting held September 4, 1945 were read and approved.
Resolution in the form of a letter to the State Highway i department and the Governor was
signed on resolution of the Board.
On resolution the sum of $150.00 was promised to survey a site near McLean Flats for an
Air Port. Warrant to be made on request payable to L. M. Elisha.
An order was given to J. V. Rose for two 1945 Chevrolet trucks to be delivered as soon as

The Board of County Commissioners was called into session at 2:00 P. M., Wednesday
October 3, 1945, for the purposes of making up a budget for the year 1946 and of conferring
with the Auditor of Accounts of Pitkin County, Ralph L. McKee concerning the proper mode of
procedure in handling future sales of Tax Sale Certificates and establishing a policy for th <
same.
There were present: George W. Smith, Chairman; Orest A. Gerbaz, Commissioner; Clarence t.
qualm, Commissioner; M. M. Neihardt, Clerk; and Ralph L. McKee, Auditor.
The following resolution was offered and unanimously adopted:
RESOLUTION
WHEREAS, Events affecting Real Estate Transfers in Pitkin County, have reached a stage where
it is impossible for the County Treasurer's Office to furnish the necessary information that
the public has requested in sufficient time to hereafter properly conduct public sales of
Tax Sale Certificates, and
WHEREAS, It is the opinion of the Board of County ColvEMA4oners and the County Treasurer tha

some time must be allowed for the County Treasurer t work up to date',
NOW, THEREFORE, BE IT RESOLVED, That the County Commissioners will not hold another Public s :le
of Tax Sale Certificates before December 15, 1945, at which time a date will be set and
advertised.
AND, BE IT FURTHER RESOLVED, That it is the will of the Board of County Commissioners that
no one request from the Treasurer a Tax Statement on prior certificates until Dec. 15, 1945.
And, BE IT FURTHER RESOLVED, That the County Commissioners do hereby make arrangements for
additional help to prepare the necessary information to conduct the next Tax Sale,
AND BE IT FURTHER RESOLVED, That requests in writing for Statements of Taxes due will be
considered in the order received but will not be prepared for any sale earlier than the
Board of County Commissioners and County Treasurer consider a reasonable time to prepare
such statements.

The valuation of your county for the year 1945 as certified by the Colorado Tax Commiss-
ion is $2,292,260.00 and your county has been charged with state taxes on that valuation.
The above information is furnished as required by Section 21, Chapter 158, Session
Laws of 1943.
Your attention is directed to the Session Laws of Colorado,. 1945, House Bill No. 50, waic;
provides for a tax levy of six (6) mills on each dollar of assessed valuation on all sheep ans
goats, except those in feed lots, to be credited to the Preditory.Animal Fund.
Also to Colorado Statutes Annotated, 1933, Chapter 110, Section 325, which provides twat
there shall be levied and collected a tax equal to one -tenth of one per cent upon the assesses
valuation of all producing and non - producing metalliferous mining property, including lode
claims, placer and mill sites, together with all improvements thereon, to be credited to the
Metal Mining Fund.
In connection with making up your tax levy, the amounts each county will receive from
the apportionment of the 35% of the income tax which goes to the General County School Funds
will not be available until October 20th, at which time the State Treasurer will notify you

OJT R.LSOLUTION, Permission was given to the Forest Servioe to put a pipe of approximately
12 inohes diameter aoross the State Highway No. 82 between Lot M in Block 10 and Lot C in
Block 11 City of Aspen. Pipe to be not less than 14 inches beneath the surface of the road
and road to be restored in a condition acceptable to the Board.
The application of Pansy Trotter for a renewal of her license to sell wine and spirituou•
liquors was approved and the same forwarded to the ::tats Licensing authority.
1 The following agreement was entered into with H. M. Christopher: the county agrees to
. pay said H. M. Christopher the sum of :,300.00 for the right -of -way through his land as road
is now constructed, 40 feet wide. Said Christopher agrees to give a suit -claim Deed to the
• same on completion of survey. The Coljnty agrees to gravel a private road from this right -of
s way to the said Christopher's house on a route to be designated by him. County agrees to
put legal fence on eaci-, side of said right-of-way and to build two gates, one at the entrant:

Am taking this action with deep regret after serving the Public in this capacity 1 ,
for the past 25 years, during which time we have had pleasant time working together in plac-
ing; the County in the the grand finincial condition that it is today.
Looking back to the day I took office in Jan. 1921 with the County having out
276,000 in bonded indebtedness and ; 11 8 8,000 in registered warrants, with an assessed. valuati
of •j4,805,500 - -- today we can state that with an assessed valuation of .c2,315,7E0 the County
holds ; 15,000 in War bonds and several thousand cash in Sank - -no outstanding bonds or regis-
tered warrants.

The Board discussed the preaaiiL, nsce;Gity for the employment of an attorney for this
County *, and it was the unanimous opinion of the Board that an Attorney should be employed, a
once. The Chairman stated that dttorney C. H. Darrow, of Glenwood Snrinbs, Colorado, had born
rdcently consulted by members of the Board concerning County af"airs and had not been paid
for legal advice given The question as to who should be an pointed was considered and after
discussion, Commissioner Gerbaz moved that the Board employ the said C. H. Darrow as attorne -
for this County. The motion was seconded by Corry - i_ssi oner Qaam, and thereupon on vote taken •
• the motion was carried unanimously. The Board then upon motion unanimously carried set the
salary and compensation for such attornov at Fifty Dollars 0150.00) per month, as of Deconber
1, 1945, plus mileage at the statutory rate for officials of this County, for trips of said
Attorney made by him in connection with the business of this County; and further cornpensatio
for litigation commenced and prosecuted, or defended, by this County, its officials and agents,

On motion duly seconded and carried Mrs. Marjorie Jenkinson was unanimously elected to
• fill the vacancy effective January 1, 1946 at a salary, set on advice of County Attorney,
• at $150.00 per month. The clerk was instructed to notify her of her selection and to in-
struct her to provide bond in the amount of $25,000.00 as such Treasurer and another bond

The 44 oard ordered the following opinion of the County Attorney incorporated in the min
utes (Refers to action of Dec, 11): Mr. Ralph McKee, c/o Hotel Jerome Aspen, Colorado
Dear Sir: This is in answer to your interrogatory concerning the salary to which a newly
appointed TXreasurer for Pitkin County, Colorado, would drew.
Senate Bill No 390, which was approved by the Governor on,aApril 2, 1945, bein :
now in force, provides, among other things, that for the purposes at compensation of the
counties of this State are classified according to population into six classes. Pitkin
County is placed in Class VI, Group A, and the salary for the County Treasurer is set at
*1,800.00 per annum.
Your question as tated to me is to the effect as to whether a new appointee wort d
receive the new salary as serby Senate Bill No. 390, or the Salary set by former law in force
at the time the present Treasurer was elected and took office.
Section 30, Article V of the Colorado Constitution, which, so far as pertinent
to the matter before us, provides: "No law shall extend the term of any public officer, or
increase his salary, after his election or appointment, as fixed by legislative enactment."
My opinion is that the new Treasurer appointed would be entitled to receive and
draw salary at the new statutory rate as defined in said Senate Bill No. 390. The consti-
tutional prohibition relates to increase or decrease "after his election or appointment."
• (Underscoring is mine). - Election or appointment are stated in the disjuncffve and mean
either one or the other. Thus, if an official is appointed, his salary cannot become in-
, creased nor diminished during his term of office. But he would be entitled to receive the
salary set by the legislature before his appointment and that in effect at the time that he
becomes appointed and takes office.
