The offer of the sum of 40.00 for tax sale certificate and taxes up to and including 1945 on Certs 1971, 1972, 1973, 1974 of 1899 for 1898 on North 50 feet Lots 1, 2, 3, 4 in Block 4, Eames Addition to Aspen was accepted. The following resolution was duly adopted: RESOLUTION WHEREAS, By an Act of the second Extraordinary Session of the 29th General Assembly, approve. In an analysis of the various counties' share of the State funds allocated on the basis of State Highway mileage in your County, we do not find that it is less than m= y other counties that have had no Highway Department contribution to their maintenance costs. Darrow, the following resolution was unanimously passed and adopted, to -wit: WHEREAS, at a regular meeting of the Board of County Commissioners of Pitkin County, Colorado, held on the 7th day of October, A. D. 1946, a resolution was passed and adopted crdating and establishing a public hospital for Pitkin County, Colorado, in said County, pursuant to petition in that behalf signed by the requisite number of freeholders of such County and presented to said Board of County Commissioners; AND, WHEREAS, said resolution provided for and appropriated to the Board of Trustees for Pitkin County Public Hospital, for the creation and establishment of such hospital, certain, funds and moneys; AND, WHEREAS, since the passage and adoption of such resolution, a public hospital had been acquired for said County of Pitkin, consisting of certain real estate and a hospital .,,e, building, together with certain surgical instruments, equipment, medicines, supplies, hospi- tal equipment and personal property located at said building; and, whereas, said building when so acquired was in a bad state of repair and has since been and now is being renovated,, altered, repaired amd partially refurnished by said Board of Trustees; AND, WHEREAS, the amount of work which was and is to be done and the estimated cost for such renovation, alteration, repairing and refurnishing of said hospital building has had to be and will be increased and revised as the improvement progressed and will progress because work and improvement which could not hate been reasonably foreseen when estimates were made became and has become necessary, from time to time; and, whereas, sufficient tax collections have not been made by said County to open and operate said hospital because of the time of year; AND, WHEREAS, the moneys budgeted for and appropriated to said public hospital are 1a- sufficient and additional funds are required for such purpose by reason whereof an emergency exists with respect to the subject matter caused by contingencies which could not have been reasonably foreseen at the time of the adoption of the budget for Pitkin County, Colorado, for the fiscal year 1947; AND, WHEREAS, it has been made to appear to this Board of County Commissioners that the sum of $4,500.00 will be required by said Board of Trustees over and above the moneys and funds heretofore budgeted and appropriated for public hospital purposes of said County during the present fiscal year, and that there are sufficient funds belonging to said Oounty is its Building Fund and Registered Warrant Fund not needed for other purposes of said County during the balance of the resent fiscal year, to make further appropriation to said Board of Trustees in the sum of $4,500.00. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of the County of Pitkin in the State of Colorado, that an emergency exists in Pitkin County, Colorado, with respect to the completion and opening of a public hospital in said County because of the facts contained herein. BE IT FURTHER RESOLVED that there should be and hereby are transferred from the Building Fund of Pitkin County, Colorado, the sum of $2,100.00 and from the Registered Warrant Fund of said County, the further sum of $2,400.00, all to its Public Hospital Fund, being a total sum of $4,500.00, for the uses and purposes of the said Board of Trustees for Pitkin County Public Hospital. The County Treasurer was authorized and instructed to transfer the sum of $4,000.00 from the State Special Road Fund to the Special Roads (Highway) Fund. - On motion duly carried, it was decided to hire Frank J. Willoughby to trace out the boundaries of the Lux Placer in full. The Clerk was instructed to write a letter of protest to the Colorado Tax Commission against the needless expense for the County in re- valuing the properties in said County, pointing out that the entire County was re- valued by H. B. Hammond of the Colorado Tax Com- er' . mission in 1936; that these valuations had remained the same; that the relative values of all rural properties had remained the same; that very few complaints concerning equaliza- tion had arisen; that Pitkin County valuations are yet higher than others of approximate like situation and class; that if any increase in valuation should be found advisable, a percentage increase would be equally as sati as a complete re- appraisal. After indit- ing said letter, the Clerk was instructed to submit it to the Board on June 24, for their approval, alteration or rejection. At the request of Peter Grange, with the concurrence of Mela Cerise, the following Agreement was executed in triplicate to be submitted to the different parties concerned for signature. The Chairman of the Board, C. 0. Quam was authorized and instructed to sign this agreement for the County should it be found acceptable to the other two parties. D. 1947, by and between THE COUNTY OF PITKIN, party of the first part; MELA CERISE, of the County of Pitkin and State of Colorado, party of the second part; and PETER GRANGE, of the County of Pitkin and State of Colorado, party of the second part, I WITNESSETH: 1 The said PITKIN COUNTY, party of the first part, having constructed a road through the land 1 of the said Mela Cerise between the residence of the said Peter Grange and the County Road known as the Emma Road and having made a fill at the Northeast end of the Peter Grange Bridge (commonly known as the Stockman Bridge), agrees that such work has been made at the expense of said Pitkin County. The said MELA CERISE agrees to allow the said Peter Grange, his heirs and assigns forever the privilege of using said road from the present residence of the said Peter Grange to the Emma County Road through the property of the said Mela Cerise. The said PETER GRANGE agrees to allow the said Mela 'arise, his heirs and assigns forever the privilege of using attutzsaitxratanthaxismait the road as now existing and the said Peter Grange (otherwise Stockman) Bridge from the present residence of the said Mela Cerise to State Highway No. 82 through the property of the said Peter Grange. The Colorado State Tax Commission Denver, Colorado. - - Gentlemen: The Board of County Commissioners of Pitkin County respectfully call to your attention certain facts concerning assessed valuations in Pitkin County which seem to be pertinent to the re- appraisal of properties in said County and which in their opinion should make a complete valuation unnecessary, thus saving the County a considerable expense. Due to a bad condition of the assessment in the County, in the year 1936, a representativ- from the Tax Commission, Mr. Blaine Hammond spent the whole year here making a complete reap praisement and valuation. These figures were made out scientifically and met with the approval of practically every taxpayer in the County. Practically no changes have been made since and very few requests have been made for equalization. Hence, the taxes do not generally need to be equalized. With regard to lands in Pitkin County, we find that ours are assessed higher already th= most of the other Counties having approximately the same values and conditions. Our near neighbor, located lower in the valley with better crop conditions has a valuation on irrigated land of $40.00 and on irrigated pasture kat lower, so that the average of all irrigated land is about $32.50. Pitkin County Class A irrigated land is $57.78 and Class B $32.37. This is Garfield. County Montrose County.with better crop conditions has Class A at $52.52. Gunnison County, it seems, has no Class A lands as they have switched largely to stock raising and use their lands for grazing. We not Saguatche Co. has theirsvalued at $22.92. Further, Pitkin County is decidedly changing to a stock - raising County, since our short seasons here interfere with the raising of crops and therefore much of our Class A lands would be more accurately se- ?, scribed as irrigated pasture. As to improvements, our Assessor is experienced in rural matters, is capable, pains -taki g and reliable. We feel that his judgment in such matters is as reliable as that of any. We do not consider the expense which the County would be subjected to by a general re- g , appraisal would be justified by the results. We therefore respectfully suggest that, so far as Pitkin County is concerned, a complete re- valuation be not undertaken. So far as the City of Aspen is concerned, conditions have changed here. But, as yet, the improvement has not passed the experimental stage. Values in the City are an unknown quanti y; probably there has been an increase in values due to a better condition of the community, bu the present state of excitement prevents and actual appraisal of value. In a short time, a better judgment of actual values can be made: time may improve a part of the prevailing pri e s to be justified; on the other hand, the whole thing, or at least the major part of it may collapse, as has been the case so many times before. We would suggest that a proper increase in valuations be made on a percentage basis, tak ng into account recent improvements, on the valuationsas set by Mr. Hammond. Our County Assess oresintimate knowledge of conditions both before and after the "boom" would render him particularly qualified for such work. In short, it is the opinion of the Board that your proposed plan to re -value Pitkin County would prove a needless expense and there is danger that matters might be left in a worse condition than they are now. That the Licensees, in removing said slag or mining concentrate and sampler tailings, shall not destroy the natural contour of the hill and make no holes in said real property, and if the contour should become destroyed or any holes dug in so removing, the Licensees by the end of said five (5) year/ period, shall fill such holes and restore the contour as near as can be pracitcalbly done. 3. That the Licensees and their successors in office shall not assign any of their rights hereunder without first obtaining the written consent of the Licensor. 4. That no charge shall be made by Licensor, her heirs ofassigns for any slag or mining concentrate and sample: tailings which have been heretofore appropriated by said Licensees, their employees, servants, agents and representatives, it being understood that such remova was made with the express consent of Licensor, without consideration other than that define. herein. Quam Chairman of the Board County Commissioners Aspen,Colo October 29, 1947 Dear Mr. Quam: We would like the permission of the County Commissioners of Pitkin County to put in an eight foot parking in front of the Hotel Jerome running the length of the block on Main Street between Mill and North Monarch. We have been informed by Mr. William V. Hodge , Jr. vn o consulted Mr. John Marshall of the State Highway Department in Denver who advised it would be alright to go ahead if we can clear it with the City and County authorities and leaving a right of way approximately thirty feet on each side of street center or a total of sixty feet in all. If we extend a parking eight feet from the sidewalk, it would be more than thirty feet from the curb to the street center. We would like to install this parking for the purpose of beautifying the hotel block as we would plant the strip with shrub , flowers, trees, etc. It would be our intention to eliminate parking in front of the hotel and perhaps encourage parallel parkilig in the rest of the block if the City Council and Commissioners would deem it advisabi. The Board by unanimous resolution deemed such action inadvisable and refused the request. %'he following resolution was unanimously passed: RESOLUTION RE FIRE - FIGHTING Nhereas: The sheriff and other county personnel have been doing certain work toward the pre - vention of forest fires in our county for which it is impractical to keep definite expense records, and Nhereas, the Federal Government, acting under the Clarke McNary Act, of 1942, partially re imburses certain co- operating agencies acting under the authority of an agreement with the State Board of Forestry of Colorado for the protection of State and privately owned forest lands, and Nhereas: Pitkin County being one of the above mentioned agencies is entitled to recognition of expenditures of time made by certain county paid personnel in carrying out fire prevention activities, Be It Hereby Resolved by the Board of County Commissioners of Pitkin County, Colorado, seated in regular session this 3rd day of November, 1947, that a fire fund be hereby created in the amount of $200.00 annually for the purpose of fire prevention activities, outside town and civic boundaries, within the said County of Pitkin. Brown, who was acting at the time for Aspen Skiing Corporation. When Mr. Brown paid these taxes, the Board of County Commissioners by Order dated September 3, 1946, assigned to him tax sale certificate No. 2 issued at the sales ' of December 14, 1934. We were subsequently advised by John Herron that the Blazing Star claim was unpatented and that we should not proceed to tax deed upon it, and Mr. Herron gave a right of way agreement for the chair lift. To the best of my knowledge Aspen Skiing Corporation has reimbursed Harry 3rown for the expense that he advanced on its behalf, but the Corporation has never been re- 196 paid by the county for the amount of money that it received on these tax receipts for payment of taxes on a claim which should not have been taxed. By copy of this letter I am asking Mr. Watt to see if his office has any record of any repayment to Aspen Skiing Corporation. By copy of this letter to Harry Brown I am notifying him that it is the company's understanding that he has been repaid for all that he advanced on our behalf. S. A. 1935, County Budgets for Ordinary, Poor and Contingent purposes are limited to a levy of 4.0 Mills. Any levy in excess of this cannot be extended withott the prior approval of the Colorado Tax Commission. If the above mentioned levy is insufficient_ to meet your needs, permission can be granted to levy not to exceed and additional 5 mills. For general school purposes a maximum of 5 mills can be levied on the assessed valuation of your county using the valuation as fixed by the State Board of Equalization, less the sum of $2,779.01 your Income Tax apportionment. Darrel, the following resolution was unanimously passed and adopted, to -wit: WHEREAS, there is no duly qualified, licensed or acting abstracter within or for Pitkin County, Colorado; and, whereas, the owners of real property and persons having any interest in or against real property in Pitkin County, Colorado, are greatly inconvenienced and are being injured by the fact that there is no such abstracter; AND, WHEREAS, it has been represented to this Board of County Commissioners that the Abstracters' Board of Examiners of Colorado is ready and willing to issue an abstracter's license to one James C. M., Thursday Jan. 29, to discuss Land Use Planning. The reports of the County Clerk, County Judge and Clerk District Court for Dec. received *iaax State Special Relief Warrant No. 2662 dated Feb. 18, 1945, never having been presented for payment, the same was ordered cancelled and payment stopped. It was agreed to pay to the Pitkin County Bank the sum of $25.00 per month instead of ;$15.00 as heretofore for exchange services in said bank according to former regulations- -the same to be divided 50 -50 between Ordinary Fund and Welfare Administrative Fund. The Board decided to buy gas for the County Equipment from M. G. Conner of Aspen instead of from Paul Marts of Glenwood as heretofore and Clerk was instructed to notify Mr. Marx of the change.
