The Board of County Commissioners of Pitkin County, Colorado, met at 10:00 o'clock A.M.
Thursday December 18; 1947, with the following members present: Clarence 0. Qum, Chairman;
Orest A. Gerbaz, Commissioner; George W. Smith, Commissioner; M. M. Neihardt, Clerk.

• The County Treasurer was authorized and instructed to transfer $2,000.00 from the State
4 '1 Special Road Fund to the Special Roads (Highway) Fund.
The application of the A & T Co., for license to sell wine, beer and spirituous liquors
at Redstone Inn was received and January 5, 1948 was set for a hearing provided advertising

The Board of County Commissioners of Pitkin County, Colorado, met at 10:00 A. M., Monday
January 5, 1948, with the following members present; Clarence O. Qum, Chairman; George W.
Smith, Commissioner; Orest A. Gerbaz, Commissioner; C. H. Darrow, County Attorney; M. M.
Neihardt, Clerk.
The minutes of the m eting held December 18, 1947 were read and approved.
The offer of $40.00 &f} 8 of 1937 for 1938 on Highland Chief 2272 Columbia accepted

The application of H A Deane for renewal of License to sell Wine eer and Spirituous
t, Liquors was approved.
The application of the A & rCo., Inc to sell wine, beer and spiiituous liquors at
Redstone, having been previously received and Jan, 5, 1948 having been set for a. hearing;
proper publication having been made according to law; and no objection appearing, the same
was approved. (This License was really a renewal of the one granted for 1947 to, Don Shingler)
The Application of Marvin W. Catto for a License to sell 3.2 Beer at Red Mountain Ranch
having been previously received and Jan. A, 1948 having been set for a hearing; proper
publication having been made according to law; and no objection appearing, the same approved.
At the suggestion of the Pitkin County Library Board the following appointments were
mede to the Membership of said Board:
Mrs. Mona Frost to succeed herself - -a term of four years
Mr. H. H. Hadley to fill vacancy occasioned by removal from city of C. D. Snyder
Mrs. Doris Willoughby for a term of four years, being the fifth member required by new law.
The Clerk was instructed to inform W. H. Lambreth Assistant Manager Planning Division
State Highway "epartmernt, that a meeting of the Board would be called at the Court House
at 7 :30 P. M., Thursday Jan. 29, to discuss Land Use Planning.
The reports of the County Clerk, County Judge and Clerk District Court for Dec. received
ststsx State Special Relief Warrant No. 2662 dated Feb. 18, 1943, never having been
presented for payment, the same was ordered cancelled and payment stopped.
It was agreed to pay to the Pitkin County Bank the sum of $25.00 per month instead of $15. 0
as heretofore for exchange services in said bank according to former regulations - -the same
to be divided 50 -50 between Ordinary Fund and Welfare Administrative Fund.
The Board decided to buy gas for the County Equipment from M. G. Conner of Aspen instead
of from Paul Marts of Glenwood as heretofore and Clerk was instructed to notify Mr. Marx
of the change.

The members of the of County Commissioners of Pitkin County, Colorado met at
11:00 A.,M., Tuesday, January 13, 1948, as follows District No. 1, George W. Smith;
District No. 2, Orest A. Gerbaz; District No. 3, Clarence 0. Quam; County Clerk M.M.Neihar.t,
By common consent Commissioner C. 0. Quam acted as Temporary Chairman. • ,
George W. Smith was nominated as Chairman of the Board for the ensuing year, but he aske.
to be excused. Orest A. Gerbaz was nominated and elected.
The term of Leonis Usel as a nether of the Colorado River Water Conservation District
expiring at this time, he was elected to succeed himself. ,
Road Overseers were re- elected as follows:
John Snyder, John C. Skiff, Claude Crowley, Rot) Whitbeck.
Dr. A. M. Cochrane was re- elected as County Physician at a salary of $400.00 per annum.
Warren J. Conner was unanimously elected as County Assessor until the next General
Election, to fill the vacancy caused by the death of Assessor Ebert Kling. e

The following Resolution of Kespect was offered and unanimously adopted:
RESOLUTIONS OF RESPECT
WHEREAS, Almight God, Who places a just valuation upon the actions of men, has deemed the
work of one of His servants sufficient, and has called from his labors
EBERT KLING, COUNTY ASSESSOR OF PITKIN COUNTY: -
WHEREAS, Pitkin County has thereby lost the services of a most efficient officer, whose go
judgment, fairness and uprightness commended him to the respect, confidence and esteem of
all the citizens and won for him the love of all the otherservants of the County who worker
with him in the administration of the said County;
AND, WHEREAS, The Board of County Commissioners and other County officers,. L eputies and Clarks
who were closely associated with him in their work, desire to record their high esteem,
affection and appreciation for the work which he has performed, and their sense of loss - -- .
officially and ' personallly - -- occasioned by his passing; l
THEREFORE, BE IT RESOLVED, By the Board of County Commissioners of Pitkin County, on be-
half of themselves as a Board and as individuals and on behalf of the other officers, Depu
ties and Clerks of Pitkin County, that Pitkin County has lost one of the most efficient
officers in its history and the individuals engaged in the work of County Government have
lost one of their most valued friends.

The Board of County Commissioners of Pitkin County, Colorado, met at 10:00 A. M., Monda
February 2, 1948, with the following members present: Orest A. Gerbaz, Chairman; George W.
Smith, Commissioner; Clarence 0. Quam, Commissioner; C. H. Darrow, County Attorney; M. M.
Neihardt, Clerk.
The minutes of the meeting hel$.January 18, 1948, were read and approved.
State Special Road Fund warrant No. 2099, dated Oct. 1, 1945, to Ben Smith, being repor -
ed lost, on motion Board declared the same cancelled, payment stoppe4.they.eon and ordered
the Clerk to issue another to take the place of the same. Said warrant was to be in said
amount, as of same date $4.25 and numbered 2099 -A.
neports of County Judge, County Clerk and Clerk of District Court received and filed.
.Official Bond of Warren J. Conner in the amount of $5,000.00 given by him and National
Surety Corporation from Jan. 13, 1948 to second Tuesday in January 1949 was approved as to
form and sufftiency. Also approved was State Bond by same Principal and Surety in' the -
amount of $1,000.00.
Ebert Kling, County Assessor, who was bonded with the National Surety Corporation under
their Bonds No. 940674 and 940675, having departed this life, the said Bonds were discontin-
ued and Cancellation Notice was duly signed by the Chairman of this Board, on a motion duly
seconded and carried.
The Clerk was instructed to write the Power Equipment Co., that the Board is ready to
pay the remaining $3,000.00 due on the grader recently purchased from them as soon as said
Grader is repaired so as to be acceptable.
The offer of Chas F. Garlington of $500.00 for Tax Sale Certificate 1131, 1132, 1133,
1134,1135 and 1136 of 1903 for 1902 on Merrimac Lode and others was again tabled.
The following described land was sold to Albert Duroux for the sum of $60.00 and the
County Treasurer was authorized and instructed to issue a County Deed therefor, on receipt
of said amount of $60.00. The said land had been appraised by the County Assessor at $10.00
per 'acre.
A tract of land situated in the NE*NE*, Section 12, Tp. 10 S., R. 85 W. of the Sixth
Principal Meridian and more fully described as follows: Beginning at a point on the
West line of said NEW* whence Corner # 6, Fowler Placer bears N 45 W, 91.08 feet;
thence south 882.5 feet along the west line of said NE4NEI to the center of the
Roaring Fork River; thence N 89 43! E, 310 feet along the center of the Roaring
Fork River; thence N 70 39 E, 135.1 feet along the center of the Roaring Fork
Riven; thence S 85 53 E, 361.2 feet along the center of the Roaring Fork River;
thence North 59 feet to the intersection of the lino between Corner # 6 and Corner
# 7 of the Fowler Placer; thence N 45 W, 1129.8 feet along said line to the point
of beginning. Containing 8.03 acres more or less.
Less Railroad 1.85 acres - -Net 6.18 acres.

The above described land lies in the Fowler Placer No. 6788 Roaring Fork Mining
District. Taxes have been paid on the above described property by Albert Duroux
and prior ow,ers, since 1936, being described as part of the Brown Placer.
I aaatg appraise the above land at $10.00 per acre, due to the fact that it is
Seep Land, with many rocks and its location is remote (Signed) Warren J. Conner
County Assessor. '
The Clerk was instructed to write the Highway Department that the Board will accept the
proposition of the Department that the maintenance of Highway #82 from the top of Independ-
ence Pass to Aspen be performed by the Department, at the expense of Pitkin County, provided
that the Department opens the said pass with heavy equipment without charge; that the expense'
of the County as provided shall be withheld by the Department from the gasoline tax due to
the County, merathxk as same is incurred; that this agreement applies to the year 1948 only
and that the cost to the County shall not exceed $3500.00 for 1948.
These arrangements made with the understanding that the Department will rebuild and finish
Highway #82 from Aspen Rest to Eagle County line in 1949.
The petition. of William K. Martz for refund of taxes for 1948 was allowed as follows:

ons were not extended in the Assessment Roll. That he has paid 1948 taxes. The amount of
ebate on said $460.00 would be and is $18.00

•ear Sir: In accordance with Section 17 of the Colorado State Library Act of 1947 we herewith
submit our report for the year 1947. On December 31 the number of books accessioned was 6221

of which 551 were acquired during the year. Of these 146 were donated. The total circula ihn
was 7695, an average of 641 per month. The largest number of books issued in any one month
was 929, this being in December. We have subscriptions to 19 magazines of which 5 are do-
nated. Three newspaper subscriptions are also donated.

Approximately 1/3 of the amount spent for books was for Reading Circle books which are
used by the country schools as well as Aspen & Basalt schools
The Librarian was on duty two hours a day Monday through Friday and 3 hours on Saturday.:
until the middle of May. After that three hours every day. ner wages are 40 per hour.
More than 500 books which were donated have not been accessioned because of the limit-
ed time of the Librarian. The room was not cleaned and papered in 1947 as planned because of
limited funds. All December and some November bills remained unpaid at the end of the year.

Pitkin County, Colorado, the following road, as a county road, to -wit:
A forty (40) foot strip of land, the center line of which is described as beginning at a
point on the South line of Lot 9, Sec. 6, Township 11 South, Range 88 West of the 6th
P.M., whence the east 1/4 corner of said section bears S. 29 16' E. 1513.16 feet; thence
N.6 15' W. 178.1 feet to Sta. 1; thence N. 37 21' E. 330.6 feet to Sta. 2; thence N. 50
25t E. 150.7 feet to :Sta. 3; thence N. 38 39' W. 178.3 feet to Sta. 4; thence N. 11 14'
W. 518.0 feet to Sta. 5; and thence N. 40 48' W. 180.7 fe t to Sta. 6, containing one and
forty -one hundredths of an acre, more or less, to connect ublic road on each end throu; :,h
White River National Forest Lands.
Petitioners ask that said Board pass and adopt a resolution creating the width of such
proposed road to be forty (40) feet instead of the usual width of sixty (60) feet.
Petitioners further request that the right of way for said road be acquired and road es-
tablished by Pitkin County, Colorado, without view.
It is represented by the undersigned that less taan twenty (20)- freeholders reside witti:

In response to the above petition the following resolution was offered and unanimously
adopted: R E S O L U T I O N
At a regular meeting of the Board off` County Commissioners of the County of Pitkin, State of
Colorado, held at the County Court House on the 2nd day of,February, A. D. 1948, there being
present, Chairman Immax Orest A. Gerbaz, Commissioners C. 0. Quam and Geo. W. Smith, Count
Clerk M. M. Neihardt and County Attorney C. H. Darrow, the following resolution was unanimou'-
ly passed and adopted, to -wit: the
WHEREAS, tho Board of County Commissioners has been petitioned, by /written petition of the
requisite number of freeholders of Pitkin County, Colorado, to establish a County road here-
inafter described, and have requested that such road be forty (40) feet ,$wide instead of the
statutory sixty (60) feet; and, whereas, petitioners desire that the right of wqy for such
road be acquired and said road be established without view;
AND, WHEREAS, this Board of County Commissioners is of the opinion, after an examination of
said petition, and upozj an investigation of the facts, that public convenience and necessity
require the establishment of such proposed road and that it be forty (40) feet in width; and
' whereas, it is the opinion of this board that the right of way for such road should be acquired
by Pitkin County, Colorado, without view;

this said County acquire and establish, without view, the following road, of a width of

Count , e right of way therefor, to -wit:
A forty (40) foot strip of land, the center line of which is described as beginning at
a point on the South line of Lot 9, Sec. 6, Township 11 South, Ae ge 88 West of the 6th
P.M., whence the East 1/4 corner of said Section bears S. 29 16' E. 1513.16 feet; thenc:•
N. 6 15' W. 178.1 feet to Sta. 1; thence N. 37 21' E. 330.6 feet to Sta. 2; thence N. O rel
50 25' E. 150.7 feet to Sta. 3; thence N. 38 39' W. 178.3 feet to Sta. 4; thence N. 11'
14' W. 518.0 feet to Sta. 5; and thence N. 40 48' W. 180.7 feet to Sta. 6, containing
one and forty -one hundredths of an acre, more or less, to connect with public road on

The Board of County Commissioners of Pitkin County, Colorado, met at 10 :00 A. M., Monday
April 5, 1948, with the following members present: Orest A. Gerbaz, Chairman; George W.

Minutesof the meeting held March 18, 1948, were read and approved.
The Deed from Pitkin County to Tony Vedic made pursuant to the resolution of this Board
on September 2, 1947 having been issued for a greater amount of ground than Pitkin County
had any b &aim upon and a consideration of $240.00 having been accepted in payment therefor,
resolution was offered and motion made that the county accept a quit claim deed from
® i Antonia Vedic, sole heir at law of the said Tony Vedic, for that part of the property de-
scribed in said Deed to the said Tony Vedic upon which County had no claim; and that a refund
be made by said County to said Antonia Vedic Saxxtkaxgcsawaxktamsakaxlaazt proportionally for
the acreage returned. Motion carried.
The reports of the County Clerk, Clerk of the District Court and County Judge, received.
Motion made seconded and carried that the sum of $250.00 be allowed Chas E. Fifield,
President Aspen Lions Club to be used for advertising on the part of the Federation of Inter-
, national Skiing, to be taken from Advertising Fund.
The amount of $6,297.58 having been received from the State of Colorado for Forest
Apportionment to Pitkin County, on motion made, seconded and carried, the said sum was
apportioned as follows:
95% or $5,982.70 to General School Fund
5% or $ 314.88 to State Special Road Fund
On Motion made seconded and carried the following scale of wages for road workers was
adopted, thereby rescinding all previous rates:
Overseers $7.50 per day
All Others 7.00 per day.
The term of George Letey as a Director of the Pitkin County Hospital, having expired the
second Tuesday in January 1948, he was re- elected to succeed himself, with term to end the
second Tuesday in January 1953.
Frank J. Willoughby having resigned as Director of the Pitkin County Hospital, on account
of being dis- qualified by his election as Alderman for the City of Aspen, Mr. Mike Marolt
was elected to succeed him for the remainder of the term ending the second Tuesday in January,
1951. - -
Laurent Arbaney having resigned as Director of Pitkin County Hospital, on account of his
having moved from the County, Mr. Justin Cerise was elected to succeed him for the remain-
der of the term ending the second Tuesday in January 1949.
Mr. Leonis Usel, representative of Pitkin County on the Colorado River Water Conservation
. Board, made-•a comprehensive and instructive report on the actions of said Board.
The attention of the Clerk was called to the fact that in the last published proceedings
the payment of $3,000.00 to the Power Equipment Co., was listed as"Parts" whereas it should
have been "payt" on Maintainer- -this being the final payment thereon.

Monday May 3, 1948, with the following members present: Orest A. Gerbaz, Chairman; George W.
Smith Commissioner; Clarence 0. Quam Commissioner; M. M. Neihardt, Clerk and N. E. Darrow,
serving as County Attorney for C. H. Darrow.
The minutes of the meeting held April 17, 1948 were read and approved.
The offer of $20.00 for tax sale certificate No. 33 of 1923 on the East 14 feet of Lot C kintakcsakx819
in Block 89, Aspen, was accepted. (Louis Pastore)
Pursuant to the resolution of April 5, 1948, concerning the adjustment of the land deeded
to Tony Vedic, the County Treasurer was authorized and instructed to deed the following de-
scribed land to Antonia Vedic and the refund of $151.20 to Antonia Vedic was authorized

The resolution was offered, seconded and unanimously carried that there be Counting
Judges in Precincts 1 and 2 and in No. 15 at Snowmass for the coming General Election.
This action was taken because of an anticipated increase in registration and polling.
The District Attorney had rendered an opinion in writing that such action would be permiss-
ible if the Board deemed it advisable.
The reports of the County Clerk, County Judge and Clerk of the District Court presented.
The petition of Mrs. Frieda heichert for refund of taxes in the amount of $12.90 on
Improvements on Lots E and F, Block 17, East Aspen Add. was granted on the following reasons:
"The above improvements are located on Government Land, and City Tax, was extended on assessed nka
valuation of $300, therefore the Petitioner should be: entitled to a refund of $12.90, amount
of City Tax, mistakenly extended on $300, valuation ". This was approved by the Assessor.
The application of Howard I. Dearhamer for renewal of License to sell 3.2 beer at
Meredith was approved.

RESOLUTION
At a regular meeting of the Board of County Commissioners of the County of Pitkin, i-a -tha
in the State of Colorado, held at the County Court House in the City of
Aspen, Colorado, on the 6th day of July, A. D. 1948, there being present Chairman Orest A.
Gerbaz, Commissioners Clarence 0. Quam and George W. Smith, County Clerk M. M. Neihardt and
1 County Attorney C. H. Darrow, the following resolution was unanimously passed and adopted,to -wil
WHEREAS, it has been made to appear to this Board of County Commissioners that the
moneys and funds raised for the Outstanding Warrant Fund of Pitkin County, Colorado, for
several years last past, have been erroneously credited to either a Registered Outstanding
„.., Warrant kw Account or Registered Warrant Account in the books of the Treasurer's Office
of said County; and, whereas, in budgeting such moneys and funds no registered outstanding
warrant account or registered warrant account was contemplated, but only an outstanding
warrant fund;
AND, WHEREAS, it is the desire of this Board to correct said error by giving proper
designation to the said moneys and funds;
NOW, THEREFORE, BE IT RESOLVED that the Treasurer of Pitkin County, Colorado, correct
the books of his office by deleting therefrom the designations of "Registered Outstanding
Warrant Account" and "Registered Warrant Account ", as current Funds or Accounts on such
books, and to substitute in place thereof and designate the same as "Outstanding Warrant Fun ".
AND IT IS HEREBY ORDERED that this rmolution be entered in the recorded proceedings of I
this Board of County Commissioners andr hereof, duly certified by the Clerk of this
Board be delivered by him to each the Treasurer and the Assessor of Pitkin County, Colorado.

The Rai of County Commissioners of Pitkin Cour..ty met at 10 :00 A. M., Monday July 19,
1948, with the following members present: Orest A. Gerbaz, Chairman; George W. Smith, Commis - oner;
Clarence 0. Quam, Commissioner; M. M. Neihardt Clerk.
The meeting was declared to be concurrently a meeting of the Board of County Commissio
ers and a meeting of the Pitkin County Board of Equalization.
Mrs. John I Beckerman made complaint that Lots F & G in Block 98 was assessed at $40.s'
and as in the City of Aspen, whereas it is outside the City limit. The County Assessor,
being present agreed to assess at out -of- the -city rate, leaving the valuation the same. This
satisfied the claimant.
The mtnutes of the meeting of the Board of County Commissioners held on July 6, 1948;
were read and approved.
Mr. C. H. Elliott presented the matter of the purchase of tax sale certificate on
Lots A & B in Block 84, Aspen, whereas he received certificate for only t.Wa a part thereof.
The matter was laid on the table until the meeting of August 2 when the County Attorney will
be present, at which time an arrangement can be made.
The sale of tax sale certificate on the Jote Smith Lode on July 6, was by motion inter-
preted to mean all taxes on all outstanding certificates on said claim. It was meant to
cover the delinquent taxes on all, to which the Treasurer would add his fees for the certif-
icates and the full current tax.
It was agreed to employ James C. Hiatt to microfilm the Abstract books of Lodes, Farm
Lands (Township books) and City Block Books as well as current land and real estate instru-
ments for the past 20 years at a cost of approximately $270.00.
The Clerk was instructed to send such of the Abstract books as needed it to C. F. Hoeck =l
Blank Book and Litho Co., for re- binding, just as soon as the micro -films returned and were � .
found to be in good shape,
The Clerk was authorized to rent a safety box in the Pitkin County Bank for the keeping
of the films and for other things which should be so secured. Box to be in name either of

A cheek for the Pitkin County Hospital was received from the Crystal River Lodge, Inc.
.n the amount of $425.00, this being the gross proceeds of the entertainment given at that

his as an unusualll generous contribution, not only as to the amount but also as to the
sacrifice and cost incurred by Messrs Cook and Higgins, the members of the Corporation.

The undersigned citizens and taxpayers of Pitkin County, Colorado, respectfully petition
he BOARD OF COUNTY COMMISSIONERS of said county, in connection with THE HIGHWAY DEPARTMENT
•F THE STATE OF COLORADO, if that is involved, to make certain repairs on the Woody Creek Roa.
:bout four miles in length from the point where it leaves the paved highway at the old J. J.
erbaz residence, past the Woody Creek Store, and back to the point where said road again
oins the paved highway.
The reason for requesting this action is that said highway has become very rough, badly
in need of gravel surfacing, and that certain safety changes should be made, particularly at
: bad torn where said highway passes over the railroad right of way, and by lowering of the
:rade at the point where there is a bridge, as said grade is too steep for safe travel at
dimes of snow and ice. There is also a narrow bridge between the Woody Creek Store and the
ighway that appears to us to be dangerous because it is narrow, and the approach to the bri:_e
as a sharp turn which seems dangerous, especially for winter travel.
As a result of this road condition, since the railroad quit carrying the mail, the carri =rs
ave been unwilling to go to the Woody Creek Postoffice, and it is necessary for someone to
.eet the carrier at the paved highway, and common carriers of freight and merchandise quite ,
:enerallt refuse to come to the Woody Creek Store, giving as their reason the bad condition
.f the highway.
J The road generally should be placed on a better grade, widened in places, dit ch and
: r ailroad crossings rebuilt and put in safer condition, and the rough portions, particularly
ear the Woody Creek Store, straightened up. There is already a bridge on the ground at one
.oint, which should be, in our opinion, installed, and proper approaches and changes mate in
he alignment of the road made to make such bridge feasible and safe.
We respectfully petition that this old road be reviewed, and so altered, changed and
epaired as to be a safe and convenient highway, as it serves a considerable area, and under
1 .resent conditions, is most inconvenient, and at times, most unsafe.
This petition is executed in duplicate, so that, if desired, one copy thereof may be
.resented by your Board to the State Highway Department, and joint action obtained, if possible.

In reference to the above resolution concerning the vacation of part of Gillespie Avenue,
the following are the petition and resolution:
Aspen, Colorado
August 3, 1948
To the Board of County Commissioners of Pitkin County Colorado
Dear Sirs: I am the owner of Lots 35, 36 and 37 in Block 90 of Hallams Addition to the City
of Aspen and of Lots 1, 2, 3 and 4 of Block 103 of said Hallam's Addition, being all of the
land lying on both sides of that portion of Gillespie Avenue, lying East of Lake Avenue.
I intend to build a house on part of the land known as Gillespie Avenue lying between said
.. Blocks 90 and 103, if I am able to obtain the vacating og said Gillespie Avenue, so that *kw
said entire parcel of land on both sides of said Gillespie Avenue, including the vacated
street, will constitute one parcel of real estate.
I therefore respectfully request the County Commissioners of Pitkin County, Colorado, to
vacate that portion of said Gillespie Avenue, lying between said Blocks 90 and 103 of said
Hallam's Addition and lying East of the Street known as Lake Avenue in said Hallam's Additio ,
so that I will be able to consolidate all of said lands into one parcel and build my residen•e

of August, A. D. 1948, there being present Chairman Orest A. Gerbaz, Commissioners Clarence
0. Quam and Geo. W. Smith, County Clerk M. M. ieihardt and County Attorney C. H. Darrow, the
following resolution was unanimously passed and adopted, to -wit:
WHEREAS, this Board of County Commissioners has been petitioned, in writing, by Alma
Morganthau Wiener, to vacate a portion of County road described as that part of Gillespie
Avenue, lying between Blocks 90 and 103 and lying East of Lake Avenue, all in Hallam's
Addition to the City of Aspen, Colorado, for the reason that said petitioner is the sole
owner of all lands situate on both sides of the portion of .tka County road so sought to be
vacated and desires to build a residence house which will be located in part on said County
road; and, whereas, it appears to this Board of County Commissioners that the said petitione
is the only freeholder on either and both sides of the portion of the County road involved
in said petition, and that no freeholder nor anyone else would be injured if such portion
of County road should be vacated, and it farther appearing to this Board that no one would
be deprived of a way to and from his property;
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of the County of Pitkin,
State of Colorado, that all that portion of Gillespie Avenue, lying between Blocks 90 and
i 103 and lying east of Lake Avenue, in Hallam's Addition to the City of Aspen, Colorado, the
same being a County road, should be and hereby is, vacated.
AND IT IS HEREBY ORDERED that this resolution be entered in the recorded proceedings of
this Board.

Upon motion the County Commissioners recommended to the Pitkin County Hospital Board that
they make application for inspection and approval of Pitkin County Hospital to become a membe
of the Blue Cross Association.
The amount of $392.28 was received from the Department of Interior to Reimburse Pitkin
County for the sum of money expended from the Ordinary Fund to fight a fire in Arbany Gulch.
Said amount was deposited to account of Ordinary Fund from whence it originated.

lode claims, placer and mill sites, together with all imporvements thereon, to be credited

On August 6, 1948, school districts numbers Six and Fifteen, Pitkin County, and Joint One,
Pitkin and Eagle Counties, by vote regularly taken in their respective districts, became
consolidated into one district with two divisions, The boundaries of the new district will
be known as Joint One A and Joint One B. Joint One A embraces the old school districts Six
and Fifteen and will carry no special levy for the tax year 1948.
It will be subject to Pitkin County High School special and bond and interest levies.
Joint One B will embrace the old school district Joint One heretofore, and it will carry
a five mill special levy on valuation as certified to the school district Joint One by
the County Assessor, August 1, 1948.
Joint One A and B will be subject to the same special levy for the tax year 1949.

At a regular meeting of the Board of County Commissioners of the County of Pitkin, State
of Colorado, held at the County Court House at the City of Aspen, Colorado on Monday,October
4, 1948, there being present, Chairman Orest A. Gerbaz, Commissioners George W. Smith and
Clarence 0. Quam, County Attorney C. H. Darrow and Wm C. Stapleton acting Clerk, the followin;
resolution was unanimously nassed and adopted, to -wit: WHEREAS, at a regular meeting of this `
Board of County Commissioners held on this date, the annual budget for Pitkin County, Colorado,
for the fiscal year 1949, setting forth the expenditures to be made for such fiscal year
was adopted by this Board; AND WHEREAS, in conformity with the statute of the State of Colorado
in such case made and provided, this Board of County Commissioners desires that the necessary

The following Agreement was discussed, adopted and signed regarding the maintenance of
State Highway No. 82 by the State Highway Department for the year 1948:

AGREEMENT
THIS AGREEMENT, MADE this 12th day of June, 1948, between the COUNTY OF PITKIN, hereinafter
called the "County ", and the COLORADO ESTATE HIGHWAY DEFARTP"ENT, hereinafter called the "Denar,-
ent", WITNES"ETH, through conference and correspondence, it has been determined that the
County desires the Department to maintain State Highway !'o. E2 between the city limits of
seen and the Pitkin-Lake County line at the ton of Independence Pass, at the sole expense of
Pitkin County for the season of 1948, and such arrangement is agreeable to the department,
_OW, THEREFORE, in consideration of the premises and of the mutual covenants and anreernents
ierein contained and the faithful performance thereof, the parties hereto promise and agree
as follows:
1. The Department, with its own organization and equipment, will begin maintenance operation;
on State Highway No. 82 between the city limits of Aspen and the Pitkin -Lake County line at
the top of Independence `ass, as soon as prectical after this Agreement is executed, and will
continue same until the first deep snow of the season 1948 -1949 closes the Pass, after which
aintenance will be discontinued unless further raintenance under the terms hereof is arranged
to be carried on by mutual agreement.
2. Charges are to be made for actual expense covering labor, material, supplies and rental of
equipment, but no administration or overhead charges will be made against the County. AWN,
3. The County is to be billed monthly for the work done, and payment will be made promptly.
If payment is not made within 30 days after presentation of bill, the State Treasurer is
!authorized and requested, upon being advised of this fact by the Department, to pay said
indebtedness and debit the same against Fitkin County's accumulated annrortionrnent of the
7otor Fuel Tax and Motor Vehicle License fees.
4. This Agreement shall not be deemed valid until it shall have been approved by the Control'_er
of the State of Colorado, or such assistant as he may designate.

WHEREAS, James C. Hiatt, the duly licnesed and acting abstractor of Pitkin County, Colorado,
is now a tenant in the Court House of said County under agreement with the Board of County
Commissioners of said County at a rental of Twenty Dollars ($20.00) per month; and, whereas, 1
it has been made to appear to this Board of County Commissioners that the said James C. Hiatt
is not in a position to pay further rental up to and including the 1st day of January, 1949;
land, whereas, it further appears to this Board that the said James C. Hiatt is the only
!abstracter within said County, and is furnishing to the public adequate and efficient service,
!for which reason it is the opinion of this Board that his office rent should be waived from

NOW,THEREFORE, BE IT RESOLVED that any and all moneys of Pitkin County, Colorado, in the
Contingent Fund are not and will not be needed for the purposes for which the same were
raised during the remainder of the present fiscal year, and that all such moneys are needed or
expenditures from the General Fund of said county, for which reason the same should be and h.reby
are transferred from the Contingent Fund of said County of Pitkin to its General Fund.

Ordinary County Revenue Fund to the Poor Fund. Said amount being erroneously transfered by
•rder on October 4, 1948, from Outstanding Warrant Fund and belonging to Poor Fund according to Budget.
The County Treasurer is also authorized and instructed to transfer the sum of $2000.00 from
the State Special Road Fund to Special Roads (Highway) Fund.

The Board of County Commissioners of Pitkin County, Colorado met at 10:00 A. M. December
8, 1948 with the following members present: Orest A. Gerbaz, Chairman; Commissioner Clarence
i. Quam; Wm C. Stapleton Acting Clerk; Mr. George Smith Commissioner Absent:
The minutes of the meeting held December 6, 1948 were read and approved.
Upon motion duly seconded and carried the Commissioners agreed to remove and haul the
snow from Highway 82,2 Blocks from Cooper Avenue to Hopkins Avenue paying Harley Peppard
$5.00 per hour for the use of his loader,fandt:a1so - other places as designated by the Commiss-
ioners.
N•oe :objection appearing the Application of Harold Christopher for a Package Liquor License
at Redstone, Colorado was granted. Commissioners Quam and Gerbaz voting for approval,
Commissioner Smith Absent.
