APPROVING ACQUISITION OF THE WINE POINT PARCEL

RECITALS
1. The Pitkin County Open Space and Trails Board of Trustees is charged with the
responsibility of acquiring open space properties within Pitkin County, and.
2. The Pitkin County Open Space and Trails Board of Trustees has designated
certain types of properties as priority acquisitions, with scenic lands, habitat and
recreational lands as priorities.
3. The 75-acre Wine Point parcel is possessed of outstanding scenic, habitat, and
recreational values.
4. The owner, Albert Frei desires to retain a ten-acre parcel on the southern portion
of the Property, adjacent to Crystal River Country Eastates, and sell the remaining
approximately 65 acres ("the Property") to Pitkin County at fair market
(appraised) value of$740,000. The conservation of the property could be achieved
while allowing the seller to retain a 10 acre parcel adjacent the Crystal River
Country Estates, thereby enabling the Open Space Program to achieve its
conservation goals while preserving funds for other priority acquisitions.
5. A roughly one mile stretch of the Crystal River Railroad Grade along the Crystal
River will become public through this acquisition.
6. The Property is highly visible from the Highway 133 Scenic Byway and contains
critical summer and winter habitat for bighorn sheep.
7. The 75-acre property is divided into two acre parcels, the full development of
which would seriously degrade their open space values.
8. The Property has been divided into two lots under state law, the full development
of which would seriously degrade their open space values.
9. On October 5, 2001 the Open Space and Trails Board passed a resolution
recommending the expenditure of$740,000 for the acquisition of the Property.

NOW THEREFORE, BE IT ORDAINED, by the Board of County Commissioners of Pitkin
County, Colorado as follows:
1. The Board approves an expenditure of $740,000 for the purchase of the 65 acre
Property.
2. The Chair is authorized to execute a contract for the purchase of the property
following approval of the form by the County Attorney's office and Open Space
Director, and is authorized to execute such other documents, as may be necessary to
finalize this transaction following approval of the form of those documents by the
County Attorney's office and Open Space Director.
3. That adjustments be made to the year 2001 budget as follows:

The E 1/2 BE 1/4 of Section 9, Township 9 South, Range 88 West of the Sixth
Principal Meridian, except that part of the NE 1/4 BE 1/4 of Section 9 lying
Northwesterly of State Highway No. 133, said exception is described as
follows:
Beginning at a point on the Northwesterly right of way line of said Highway,
whence the Northwest Corner of said ME 2/4 SE 1/4 bears West 520.0 feet;
thence West 520.0 feet along the North line of said ME 1/4 BE 1/4 to the
Northwest corner of said ME 1/4 BE 1/4;
thence South 450 feet along the West line of said ME 1/4 BE 1/4 to a point on
the Northwesterly right of way line of said Highway;
thence Northeasterly along highway right of way 687.60 feet to the Point of
Beginning.
