HomeMy WebLinkAboutbocc.res.070.1986 $ RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF PIT KIN COUNTY, COLORADO VACATING BEECH DRIVE IN REDSTONE Resolution No. 86- 70 WHEREAS, Irving Tasman (hereinafter "Petitioner ") has presented a petition requesting the vacation of Beech Drive in Redstone, • Colorado ; and WHEREAS, the Pitkin County Planning and Zoning Commission heard the above petition at a regularly scheduled meeting on April 2, 1986 and recommended by their Resolution No . 86-13 that the Board of ' County Commissioners of Pitkin. County, Colorado (hereinafter "Board") • deny the Petitioner ' s request to vacate Beech Drive; and WHEREAS, the Board heard the petitioner ' s request to vacate Beech Drive at a regularly scheduled duly noticed public hearing on June 9 , 1936; and WHEREAS, the Board finds that the small lot size on which the Petitioners residence and business is located will create an undue hardship doe to Floor Area Ratio restrictions; and WHEREAS, thea Petitioner has pr-opos.ed to provide certain com- munity services to offset the loss of Beech Drive as a public way. NOW, THEREFORE, BE PP RESOLVED by the Board that it does hereby vacate Beech Drive in Redstone, Colorado, subject to the following conditions: 1 . The Petitioner shall provide water.. to Redstone Park until a permanent hook up between the Park and the Redstone Water District is established. The Petitioner will donate $2,000 to Pitkin County for the installation of said water hook up at the .time of application for a building permit or at such other time as the County may request it, but in no event shall Petitioner be required to provide water to the Park after December 31 , 19{33 . 2 . A water fountain to be dedicated for public use will be constructed by the Petitioner in a location to be approved by the Rea-..ton Iark cci tion. 3 . An electric outlet will he constructed by the Petitioner in RIP 7 esolution No. 86- 70 Page 2 a location approved by the Redstone Park Association and dedicated for the use of Park functions. 4. A handicap access ramp to the Park will be constructed by the Petitioner in a location approved by the Redstone Park Association. 5 . The Petitioner ' s proposed house addition shall not intrude into the vacated portion of Beech Drive. 6 . Prior to the construction of any building addition which willincrease the size of the Petitioner ' s building footprint, the Petitioner will apply for approval through the Pitkin County 1041 Floodplain Review process. 7 . Upon the request of -the Board, the Petitioner shall provide construction easements along the Crystal River as may be necessary for public works projects, including but not limited to flood control work and structures. 8 . The portion of Beech Drive that reverts to the Petitioner • shall be maintained as public open space and shall further remain as pedestrian access to the park and Crystal River . No fences or other obstructions to public travel shall be placed within the vacated right-of-way. APPROVED by the Board at its regular meeting on June 23 , 1986 .
