COUNTY, COLORADO,GRANTING MASTER PLAN AMENDMENT,GMQS
EXEMPTION, SCENIC OVERLAY, SUBDIVISION EXEMPTION FOR A LOT LINE
ADJUSTMENT,AND SPECIAL REVIEW TO ASPEN/PITKIN COUNTY AIRPORT-
EAST SIDE INFRASTRUCTURE DEVELOPMENT(ESID)

RECITALS
1. The Board of County Commissioners of Pitkin County("Applicant"),as owner of the Pitkin
County Airport, has applied to the Board of County Commissioners of Pitkin County, Colorado
(`BOCC")for the following approvals:
A. Relocate the parallel taxiway system and remove abandoned pavement and install
taxiway lights along parallel Taxiway A and runway end identifier lights(REIL's)at
the south end of Runway 15/33;
B. Expansion of GA(General Aviation)parking into the area currently used for long-
term and employee parking;
C. Redesign and reconstruction of the parking and circulation facilities in front of the
Main Terminal to accommodate 107 of the 149 relocated long-term parking spaces
and improvements to the commercial vehicle circulation loop. This improvement
also requires other changes to the roads in front of the Main Terminal to
accommodate improvements to circulation. Further,the 93 employee parking spaces
along with 42 remaining long-term parking space displaced by the GA aircraft-
parking apron will be relocated to the north end of the Intercept Lot. The Intercept
Lot will be modified, including realignment of the access road,to accommodate this
use;
D. Removal of North FBO (Fixed-Base Operations)hanger and relocation of uses within
this structure to the existing ARFF/SRE(Airport Rescue Firefighting Facility/Snow
Removal Equipment) building;
E. Construction of new ARFF/SRE facility on the west side of the runway;
F. Construction of a new Deice Apron and glycol collection system immediately west of
the existing Rental Car Storage Lot. The Deice Apron will include taxiway lighting
around the perimeter;
G. Reconfiguration of the Rental Car Storage Lot to replace square footage displaced by
the Deice Apron and glycol system;
H. Relocation of the Air Traffic Control Tower(ATCT); and
1. Landscape screening associated with the redesign of the Main Terminal parking and
circulation system, rental car storage lot/deice apron and GA aircraft parking
expansion.
2. The Planning and Zoning Commission("Commission")at a regularly scheduled meetings
on September 4, 2001,reviewed the application,and a recommendation of approval was forwarded
to the BOCC with conditions.
3. The BOCC heard this application at a duly noticed public hearingon December 5,2001, at
which time evidence and testimony were presented with respect to this application.
4. The BOCC finds that the Applicant's proposal complies with the Pitkin County Land Use
Code and the Airport Layout Plan Update, provided that conditions of this document are adlered to.

NOW THEREFORE BE IT RESOLVED by the Pitkin County Board of County
Commissioners that it does hereby grant approval to the Pitkin County Airport Master Plan
Amendment, GMQS Exemption, Scenic Overlay, Subdivision Exemption of Lot Line
Adjustment, and Special Review for the East Side Infrastructure Development(ESID), subject to
the following conditions,which shall run with the land and be binding on all successors in
interest:
1. The Applicant shall pursue Scenic Overlay Review prior to the construction of the new
AARF/SRE building on the west side of the airport property and the relocation of the Air Traffic
Control Tower(ATCT).
2. Landscaping shall be installed in accordance to the approved Landscaping Plan. Any
significant changes shall be reviewed and approved by the Community Development Department.
All development must comply with the provisions of the Pitkin County's Noxious Weed
Management Plan.
3. Lighting shall be installed in accordance with the approved Lighting Plan, as amended in
the text if the ESID application amendment dated October 15,2001. Any changes to the lighting
shall be reviewed and approved by the Community Development Department.
4. An Earthmoving Permit shall be obtained from the Community Development Department
prior to commencement of work if all grading and fill placement exceeds 50 cubic yards.
5. As part of the regrading and redevelopment of the parking lots, General Aviation apron
and the Intercept Lot, the Applicant shall submit a Drainage and Erosion Control Plan to the
County Engineer for review and approval, prior to the submittal of any building permit
applications.
6. Prior to the submittal of any building or grading permit applications, a Construction
Management Plan detailing construction activities, methods of handling traffic, project schedule,
the location of construction trailers and material staging, shall be submitted for review and
approval of the County Engineer and Community Development Department.
7. Nighttime construction shall be conducted between the hours of 10:30 p.m. and 6:30 a.m.
during the months of May through October.
8. Pending the final designs for parking and circulation, new access permits may be
required.
9. The Applicants shall prepare an amended plat in accordance with Land Use Code Section 5-
60-040. The plat shall be recorded 30 day after the recording of a resolution of approval. The plat
shall also be submitted in a digital format for integration into the County GIS system.
10. The Applicant shall comply with all codes and requirements of the Aspen Fire Protection
District.
11. Given the difference in the calculated employee generation rate between the Applicant and
the Housing Office,the Applicant shall comply with the following:

A. Required housing mitigation for the ARFF/SRE Facility shall be determined at time of
Scenic Review. Five years after the issuance of a certificate of occupancy for the
proposed new ARFF/SRE Building facility,the Applicant shall conduct an auditunder
the following terms:
1) The Applicant shall retain an auditor and shall gain prior approval from the Housing
Office Operations Manager for the selection of the auditor
2) The Applicant shall be fully responsible for all fees associated with retaining an
auditor.
3) The Applicant shall provide deed restricted,affordable housing for any additional
employees beyond those required at final approval for the ARFF facility(Scenic
Overlay approval).
B. The Applicant shall propose an alternate legal option under the Federal regulations for
deed restricting the units in perpetuity to therental price terms as defined in the
Aspen/Pitkin County Affordable Housing Guidelines in effect at tlr time of Final Plan
approval of this proposed application. If the Applicant does not propose an alternate
legal option for deed restriction,than the ownership interest in the affordable hosing
units/bedrooms shall be conveyed to the Aspen/Pitkin County Housing Authority in
their entirety; and the Pitkin County Airport shall maintain control of the operations and
finances of the affordable housing units.
C. The unit rental prices shall be no greater than allowed under the Affordable Housing
Guidelines that are in affect at the time of Final Plan approval. The average of the units
shall be no higher than a low-priced Category 3.
D. The Housing Office shall qualify all tenants under the Affordable Housing Guidelines.
E. The floor plans of the affordable housing units shall be included in the Scenic Overlay
approval process for review of the Housing Authority Board.
F. Employee mitigation for the portion of the ARFF facility which exceeds the Growth
Management Exemption for replacement square footage shall be calculated utilizing the
warehouse employee generation standard as identified in Section3-130-030 of the
Pitkin County Land Use code.
G. Employee housing units built on site shall be used to satisfy the required employee
mitigation as calculated pursuant to number condition 12(F).
12. The Applicant shall adhere to all material representations made in the application and
public meetings.
13. Statutory vested rights for the approval contained herein are granted pursuant to the
Pitkin County Land Use Code and Colorado Statutes, subject to the exceptions set forth in Pitkin
County Land Use Code, § 4-140 and C.R.S., § 24-68-105. The statutory vested rights granted
herein shall expire on December 5, 2011.
