ORDINANCE OF THE BOARD OF COUNTY COMIVIISSIONERS OF PITKIN COUNTY,
COLORADO,REZONING LOTS C23—C27 OF THE RIDGE OF RED MOUNTAIN
SUBDIVISION FROM THE R-30 ZONE DISTRICT TO THE R-6 ZONE DISTRICT

RECITALS
1. Whitman/Vandslingerlandt/Hunter Creek Road Ventures LLC/Teschner/Souki ("Collectively
referred to as the Applicants") have applied to the Board of County Commissioners of Pitkin
County,Colorado("BOCC")to rezone Lots C23 -C27.
2. The properties are all located in the Ridge of Red Mountain Subdivision and are legally described
as Lots C23 -C27,Ridge of Red Mountain Subdivision.The Lots are ali currently zoned R-30, The
Lots are depicted in E�chibit A.
3. The Pitkin County Planning and Zoning Commission considered the proposed rezoning at a
regulazly scheduled meeting on December 13,2012,and recommended approval by a vote of 3-0.
4. The BOCC reviewed the application at 1�Read'mg at a regularly scheduled, duly noticed public
hearing on March 28�, 2012 and at a continued 1�` Reading on June 13, 2012. The BOCC
conducted a site visit at the properties on Apri123rd, 2012. 2°d Reading was heard at a regularly
scheduled public meeting on November 14�, 2012. Evidence and testimony were presented with
respect to this application.
5. The BOCC finds that the proposed land is eligible for the R-6 zone district designation as it meets
the intent of this zone district.
6. The BOCC further finds that the rezoning is consistent with Sections 2-30-40(i) and 2-40-10(c)(2)
of the Pitkin County Land Use Code.
NOW,THEREFORE,BE IT ORDAINED by the BOCC that it hereby rezones Lots C23-C27 of
the Ridge of Red Mountain Subdivision from R-30 to R 6,as shown in E�ibit A.
NOTICE OF PUBLIC HEARING published in the As�en Times Weeklv on the 23`� day of February,
2012.
INTRODUCED AND FIRST READ AT A PUBLIC HEARING on the 28�'day of March,2012.
CONTINUED ON FIRST READING to the 13�day of June,2Q12
APPROVED AND ADOPTED AFTER SECOND READING on the 14�'day of November,2012
