BOARD OF ADJUSTMENT
GRANTING A VARIANCE FOR CALSUN II, INC.
Resolution No. 02 -11
WHEREAS, CALSUN II, Inc., owners of 1124 and 1126 Red mountain Road, are requesting a
Collector Street setback variance where 50 feet us required from the Red Mountain Right -of -way,
and front and side yard setback variances on both lots, where 30 feet and 20 feet are required to
construct terraced retaining walls that exceed 30 inches in height; and
WHEREAS, 30 inches is the maximum height allowed for retaining walls within setbacks, and 50
feet is the required front yard setback for this 1+ acre parcel in the RS -30 zone district; and
WHEREAS, the subject property is described as a tract of land situated in Lots 21 and 23, Section
Township 10 South, Range 84 West of the 6" Principal Meridian, but is fully described in Exhibit
A; and,
WHEREAS, the Board of Adjustment is vested with the power to grant or deny such variances by
virtue of Title II, Section 7- 10.30, Pitkin County Code (Land Use Code) and Colorado Revised
Statutes, 1973, 30 -28- 118(2) (C); and,
WHEREAS, based on the evidence presented, the Board of Adjustment makes the following
findings:
1. Proper notice procedures, including the notification of all adjoining property owners, has been
shown by the applicant.
2. The required hardship or practical difficulty has been established.
3. Granting such relief will not cause substantial detriment to the public welfare and will not
substantially impair the intent and purpose of the Zoning Resolutions and the zoning maps.
NOW, THEREFORE, BE IT RESOLVED by the Board of Adjustment that a 36 height variance
shall be granted for the construction of a retaining wall as shown on Exhibits B, C,and D due to
topographical hardships.
WARNING: Any violation of the terms of this resolution may result in rehearing and possible
revocation.
The Resolution was adopted by vote of the Board of Adjustment of the County of Pitkin, State of
Colorado.

Beginning at the Northwest corner of said Lot 21,
thence S 89 °24' E 185.87 feet along the North side
of said Lot 21;
thence South 248.26 feet to the South side of Lot 21;
thence N 89 °24' W 165.08 feet along the South side of
said Lot 21 to the Southwest corner of said Lot 21;
thence N 4 047' W 249.35 feet along the West side of
said Lot 21 to the Northwest corner of said Lot 21, the
point of beginning.
1126 RED MOUNTAIN ROAD
A tract of land situate in Lot 23, Section 7, Township 10 South,
Range 84 West of the 6th P.M., more particularly described as
follows:
Beginning at the northwest corner of Lot 23, thence south
4 047' east along the west line of Lot 23 a distance of 125
feet; thence easterly and parallel to the north line of Lot 23
a distance of 350 feet; thence north 4 047' west a distance of
145 feet to the point of intersection with the north line of
Lot 23; thence westerly along the north line of Lot 23 a
distance of 300 feet, 2 inches to the point of beginning.
