APPROVING ACQUISITION OF THE BRACKETT PARCEL
ORDINANCE #01-129_-7
RECITALS
1. The Pitkin County Open Space and Trails Board of Trustees is charged with the
responsibility of acquiring open space properties within Pitkin County, and
2. The Pitkin County Open Space and Trails Board of Trustees has designated
certain types of properties as priority acquisitions, with scenic lands and habitat
lands as priorities.
3. The 45-acre Brackett property ("Property") is possessed of outstanding scenic
and habitat values.
4. The Property is the only developable private land in the north bowl of "the
crown" a large area above El Jebel which is important winter range for mule deer.
The development of the property would hinder resource management such as
controlled burning on adjacent public lands administered by the Bureau of Land
Management.
5. The Property is highly visible from the mid-valley and the full development of
which would seriously degrade its scenic values.
6. On November 28, 2001 the Open Space and Trails Board passed a motion
recommending the expenditure of$300,000 for the acquisition of the Property, or,
at the election of the Seller if a TDR could be certified and sold, the County
would alternatively pay $100,000 for the land after sale of the TDR.
NOW THEREFORE, BE IT ORDAINED, by the Board of County Commissioners of Pitkin
County, Colorado as follows:
1. The Board approves an expenditure of $300,000 for the purchase of the
approximately 45 acre Property, or $100,000 for the purchase of the Property if a
TDR is severed prior to purchase by the County.

2. The Chair is authorized to execute a contract for the purchase of the property
following approval of the form by the County Attorney's office and Open Space
Director, and is authorized to execute such other documents, as may be necessary to
finalize this transaction following approval of the form of those documents by the
County Attorney's office and Open Space Director.
3. That adjustments be made to the year 2001 budget as follows:
