LOCATION: The property is located up West Buttermilk Road near the access to the Eagle Pines subdivision. ZONING/LOT SIZE: The property contains 48 acres and is a conforming parcel in the AFR 10 zone district. BACKGROUND/DESCRIPTION: The BOCC approved a GMQS exemption and 1041 hazard review for an AH unit on site in Reso. 99 -136. The Code states that only the BOCC can remove a deed restriction for an AH unit and the Applicant would like to get permission in advance to remove the deed restriction should they or future owners decide to remove their voluntary AH unit. Staff Analysis: Section 3- 200.080: Minor Amendment to a Development Permit. This application meets the standards of this Code section. The purpose is to take care of planning review in advance so that the owners can remove the unit if they desire without in the future without BOCC approval. RECOMMENDATION AND CONDITIONS OF APPROVAL: Staff recommends that the Board of County Commissioners approve the Pfister Tract 2 Minor Amendment to a Development Permit. In August of 1999, the Board of County Commissioners approved Resolution 99 -136 granting a Growth Managment Quota System Exemption for an affordable housing unit on the subject site (refer to Attachment 2). Typically, Piktin County requires a property owner to deed restrict affordable housing units to income, occupancy and price restrictions. The restrictions may be removed by a property owner upon approval of the Board of County Commissioners provided that the dwelling is removed or modified. The modified improvements must no longer be capable of occupancy as a dwelling unit (see Land Use Code, Section 3- 150 -120 E.). The Kelso affordable housing unit was asked for voluntarily by the applicant and was not required as mitigation. Consequently, the applicant is seeking approval for the capability to unilaterally remove the deed restriction at some future time. A pre- requisite of unilaterally removing the deed restriction would be the removal or modification of the dwelling unit. Minor amendments to development permits must comply with Section 3- 200 -080 of the Land Use Code. This section of the application demonstrates compliance with the Code. A. The amendment must not change the use of the proposed development between residential, commercial and tourist accommodation uses. West Buttermilk Pfister Tract 2 (Exhibit A) is 48 acres and is located in the AFR -10 zone district. 3. The Planning and Zoning Commission considered this application at a public meeting on July 6, 1999. NOW, THEREFORE, BE IT RESOLVED by the Board that it hereby grants approval for the West Buttermilk Pfister Tract 2 Growth Management Quota System Exemption and 1041 Hazard Review for an Affordable Housing Unit subject to the conditions listed below which shall run with the land and be binding on all successors in interest: 1. The proposed affordable housing unit shall be a minimum of 1,100 sq. ft. in net livable floor area. If the proposed affordable housing unit is between 1,100 sq. ft. and 1,400 sq. ft. in net livable floor area, it shall be deed restricted to category 1 or2 price. income, and occupancy guidelines. If the residence is greater than 1,400 sq. ft. in net livable floor area, it shall be deed restricted category 3 or 4 price. income, and occupancy guidelines. 2. The Applicant shall comply with the following standards for development on slopes of greater than 15 %: A. Adequate mechanical support shall be provided for cut slopes. B. Adding water which may decrease slope stability shall he avoided. C. Adding weight to the top of the slope shall be avoided. D. Disturbed slopes must be contoured so that they can be re- vegetated. E. Steepening of existing slopes shall be avoided. F. Cuts, fills, grading and excavation shall be confined to the minimum area needed for construction. G. The Applicant shall submit a drainage and erosion control plan to the Comity Engineer for review and approval, prior to submittal of any building permit applications. H. Prior to submittal of any building permit applications, the residential foundation design shall be approved by a Colorado registered professional engineer. 1. The house shall be designed to preclude the accumulation of radon gas. 3.
