BOARD OF ADJUSTMENT
GRANTING ARTERIAL HIGHWAY, FRONT, AND SIDE YARD
SETBACK VARIANCES FOR
24041 HIGHWAY 82, BASALT
Resolution No. 13 -2012
WHEREAS, Heitor Nakagawa, owner of 24041 Highway 82, Basalt, is requesting approval of
berms which exceed 4 feet in height and are constructed in the Arterial Highway, Front and Side
Yard setbacks; and
WHEREAS, the lot contains .6 acres and is located in the AR -10 zone district; and
WHEREAS, the property is more fully described in Exhibit A; and
WHEREAS, the Board of Adjustment is vested with the power to grant or deny such variances by
virtue of Section 2- 10 -30(d) of the Pitkin County Land Use Code; and,
WHEREAS, based on the evidence presented, the Board of Adjustment makes the following
findings:
1. Proper notice procedures, including the notification of all adjoining property owners, has been
shown by the applicant.
2. The required hardship or practical difficulty has been established.
3. Granting such relief will not cause substantial detriment to the public welfare and will not
substantially impair the intent and purpose of the Zoning Resolutions and the zoning maps.
NOW, THEREFORE, BE IT RESOLVED by the Board of Adjustment that a 10' Front Yard
Setback variance be granted for the additions shown on Exhibits B - 6 due to topographic
hardships.
WARNING: Any violation of the terms of this resolution may result in rehearing and possible
revocation.
The Resolution was adopted by vote of the Board of Adjustment of the County of Pitkin, State of
Colorado.

Meridian, Pitkin County, Colorado, lying Northeasterly of and adjacent to State Highway No 82 and Southerly of afence as
constructed and in place, described as follows:

Beginning at a point on said fence whence Angle Poin
Tract 56, bears N. 73 °31' W. 6 59 feet;
