Schaffner, Zoning Officer and Acting Secretary Brewster - McLeod opened the meeting at 5:45 pm. NEW BUSINESS: 013 -2012 Nakagawa, Heitor 24041 Highway 82, Basalt Doug Pratt and the owner's nephew, Jimmy Nakagawa, were present to request height variances for berms that were constructed in excess of the four foot (4') height limit for berms located within road and yard setbacks. The application was tabled at the November 6, 2012 eeting so that the applicant and concerned neighbors could reach agreement on a landscape plan. Also present were neighbors, Nancy and Stan Booth, Marc Obadian, and the attorney representing the Booths and the Steeles, David Smith. Throm stated that he visited the site with Jimmy Nakagawa but that there was no discussion regarding the berm. He commented that he didn't think that the berm affected the view of the lot diminished because additional berm whenscompared to he berme less lot next doorrhway was greatly Since Brewster- McLeod was not present at the previous hearing, Pratt showed the surveys with dscape both existing and preexisting grades, photos, and the proposed Ian distributed t plan the other parties last1e situation. Pratt stated that the proposed landscape p was Friday. He explained that some rocks will be left at the toe of the slope for stability. Finally, he explained that the rock wells around the trees were an attempt to save the trees when the height of the berm around the trees was reduced. Smith explained that the neighbors are still concerned, and expressed issues pertaining to the extent of the "massive" re- grading on the lower portion (closest to the highway) of the lot and how it may have affected drainage to the neighbor's detriment. He said that he believed the hardship to be self- imposed and that the application should be denied and the berm removed. If not, the berm should be softened and reduced in height. He hinted at continue neighborhood o ithe es which will be resolved at the BOCC. He stated that he was happy to applicant towards modifying the berm. 11111• 0- Head asked if a permit was issued for the berm. restriction. 0 Schaffner stated yes, but with a 4' height Pratt asked if the Board could table the application for one more month in hope of a more full Board presence. Head stated that the application was already tabled for one month and that he was disappointed that the applicant had not worked toward agreement in that time. He stated that he favors approval of the application if agreement can be reached between all parties. He moved to table the application until the January 8, 2013 meeting date. Brewster - McLeod seconded the motion and it passed 3 -0. 014 -2012 Rock River Properties, LLC 100 River Rock, Woody Creek Brian BeazleY was present to represent the owner in a request for a 10 foot front yard setback variance where 30 feet if required on this .6 acre parcel in the AR -10 zone district for the construction of a second story addition and an entrywaY. The Affidavit of posting was submitted. There were no members of the public present to comment on this application. A letter of support from neighbors, Wayne and Marjorie Landis, was submitted. Beazley presented the Board with a site plan and explained a previous request to the Board earlier this year where a front yard setback variance was being sought. That request was not approved. Since then, the applicant received a site plan approval which redesignated the rear yard as a front yard. This eliminated the need for the original request, but a front yard variance is still needed for the proposed entryway and second story addition over the existing residence. Head moved to approve the request due to topographic conditions. Thrum seconded the motion and all were in favor. In May of 2012 David Johnston Architects, PC, who represents the Owners of the subject property, submitted an application for a variance to the established front yard setback. The request entailed a second story addition over a pre- existing structure which was in the front yard setback and an additional one -story footprint which encroached in the same setback. In the July 3`d meeting with the BOA we established that this second story addition concept was acceptable to the board and they would grant a variance however the additional footprint square footage would be denied considering the new footprint that was established. The decision however was tabled instead of ruled upon and ultimately the application was withdrawn. After this meeting we met with members of the planning and zoning staff on site to review the original front yard setback that was established by the county. We decided that the front yard, defined as: the point in which access is taken, was actually the established rear yard. The planning staff allowed the owner to reestablish the front yard and create a new determination through a site plan review. This was submitted and reviewed in October by staff and with public notice (see attached). The public was without comment and therefore staff approved the new front yard designation and a revised activity envelope was created. With the front yard reestablished and due to the irregular and narrow shape of the lot, the West corner of the existing structure is now encroaching into the setback as was the East corner prior. The additional one story footprint was designed to fit within the new activity envelope and is now a non - issue. The house is within the envelope except for the upper story addition which is stacked on top of the existing structure. We are now asking the Board of Adjustments to grant us a similar ruling as they did in July for the West corner of the house. With verbal support from the neighbors in favor of the proposed variance and design with no objections received thus far, we respectfully request that the Board of Adjustments grants a ten foot front yard setback variance due to the hardship of irregular and narrow lot and existing conditions of the house on site. The addition as designed and proposed will add aesthetic value to the surrounding neighborhood and will serve as an example of the type of character we in the community hope to promote. These berms received Site Plan approval and an Earthmoving Permit in August of 2012, both of which allowed the berms to be constructed no greater than 4 feet in height.
