BOARD OF ADJUSTMENT
GRANTING A FRONT YARD SETBACK VARIANCE FOR
0321 SOPRIS CREEK ROAD
Resolution No. 02 -2012
WHEREAS, Bill Harriman and Lee Lee Stege, owners of 0321 Sopris Creek Road, are requesting
approval of a 5 foot Front Yard setback variance where 50 feet is required for this 3.72 acre parcel
in the AR -10 zone district, for the construction of a small kitchen addition; and
WHEREAS, the property is more fully described in Exhibit A; and
WHEREAS, the Board of Adjustment is vested with the power to grant or deny such variances by
virtue of Title H, Section 7- 10.30, Pitkin County Code (Land Use Code) and Colorado Revised
Statutes, 1973, 30 -28- 118(2) (C); and,
WHEREAS, based on the evidence presented, the Board of Adjustment makes the following
findings:
1. Proper notice procedures, including the notification of all adjoining property owners, has been
shown by the applicant.
2. The required hardship or practical difficulty has been established.
3. Granting such relief will not cause substantial detriment to the public welfare and will not
substantially impair the intent and purpose of the Zoning Resolutions and the zoning maps.
NOW, THEREFORE, BE IT RESOLVED by the Board of Adjustment that a 5' Front Yard
Setback variance be granted for the addition shown on Exhibits B and C due to downzoning.
WARNING: Any violation of the terms of this resolution may result in rehearing and possible
revocation.
The Resolution was adopted by vote of the Board of Adjustment of the County of Pitkin, State of
Colorado.

Meeting of the
Pitkin County Board of Adjustment
January 3, 2012
Members Present: Rick Head, Jamie Brewster - McLeod, Bob Throm, Patrick
McAllister, Seth Hmielowski
Members Absent: Jim Rifkin
Staff Present: Joanna S. Schaffner, Zoning Officer and acting secretary
Rick Head opened the meeting at 5:35pm. Schaffner and Hmielowski were both late.
There is no recording of this meeting. Minutes are based on the notes taken at the
meeting.
Caseload:
Case #01 -2012 Touchdown Snowmass
800 Brush Creek Road, Aspen
Paul Taddune was present representing the applicant in a request for Arterial Highway,
Front and Side Yard setback variances where 100', 100', and 50' respectively are
required on this 35+ acre lot in the LIR zone district, to allow a ranch gate constructed
without a permit to be permitted. It was noted that the gate has received planning
approval.
The Affidavit of Posting and Mailing was submitted. There were no members of the
public present to comment on this application.
Taddune explained that the applicant constructed the gate intending to match the Droste
ranch gate situated directly next door, but wasn't aware that a permit was required. The
gate was cited by the County's Code Enforcement Officer.
The applicant feels that the gate is necessary because people use the entry area off the
road as a turn around, or sometimes "explore" down the applicant's driveway. Others are
looking for an entrance to the Sky Mountain Open Space parcel and are attracted by the
Droste ranch gate. The applicant wishes to reduce confusion and identify the driveway as
private. The gate crosses an access easement with the Drostes, and a letter of support
from Peter Droste has been submitted.
McAllister asked if there were any objections from the public. The response was no.
Head asked if the Open Space Parcel was accessed near this area. The response was no.
He then asked what hardship the applicant was claiming.
Taddune responded that Droste was allowed to have a gate and that gate has caused
confusion that has negatively impacted the applicant.

Throm moved to approve the application as presented due to topographic hardship. He
explained that the driveway entrance is lower than the roadway and can't be seen from
Brush Creek Road. The fact that it appears to be a turn- around can also be considered a
topographic hardship. The Droste ranch gate has been there "forever ", so he suggested
that "time" is also a hardship.-
McAllister added that the applicant also suffers unnecessary traffic impacts that are a
peculiar and practical hardship.
Brewster - McLeod seconded the motion, and the gate was approved by a vote of 5 -0.

The applicants and their representative, Scot Broughton were present requesting a 5 foot
front yard setback variance where 50 feet is required on this 3.72 acre lot in the AR -10
zone district to construct a small addition to single - family residence. It was noted that the
proposed addition has received planning approval.
Broughton explained that the existing house lies five feet within the 50 foot front yard
setback. The proposed addition is to enclose a little niche such that the addition will not
extend any fiuther into the setback than the existing house already does. He mentioned
that neighbors Tom Clark and Michael Ememann both offered their support.
Both Head and Hmielowski asked what hardship is being claimed.
Throm elaborated the house has been there for "fifty years ". He claimed that this is a
historical structure and didn't feel the matter needed a lot of discussion. He commented
that short of tearing down the house and rebuilding it elsewhere, the addition had to go in
the setback. He also expressed that the unusual condition of the property caused an
undue hardship on the property owner.
McAllister questioned why the request needed a variance when it appeared on the
recorded site plan. Schaffner explained what the site plan indicated and stated that only
the Board of Adjustment can grant approval for development within the setback, which is
why the Board reviews so many requests for development proposed within building
envelopes located entirely within setbacks.
After a short discussion, the Board agreed that if the house _predated codes, then
downzoning is the appropriate hardship.

Brewster - McLeod moved to approve the addition based on downzoning. She explained
that the house predated the codes, and the variance will not cause the addition to extend
beyond the original footprint of the house.
Throm seconded the motion. The vote passed with a vote of 4 -1, with Hmielowski
voting against.
Minutes:
Brewster - McLeod moved to approve the minutes of the December 13, 2011 meeting.
Throm seconded the motion and all were in favor.
Discussion:
Schaffner asked the Board if they would be supportive of a code amendment that allowed
ranch gates as an improvement that would be allowed within setback areas. The Board
agreed that they could support such an amendment to the Land Use Code.
Brewster - McLeod stated that it was important that the Board not define the applicant's
hardship for them. It was agreed that applicant need to do better at defining their
hardship and should use the prescribed code language.
There being no farther business, the meeting was adjourned at 6:10 pm.

Due to the nature of the existing house location on the property with additions
constructed over several years on an original farm- house, and its proximity to Sopris
Creek Road, current enacted front yard setback requirements for the underlying zone of
AR -10 create a nonconforming front yard setback condition, and prove to be a hardship
for minor development to the existing house on the street side of the property. We are
approaching the PITCO Board of Adjustments per section 2 -40 -110 of the PITCO Land
Use Code to request a front setback variance that is not un- similar to a previously
approved application.
This subject property had previously gone through a 1041 Hazard review to establish a
building envelope, and legalize a Caretaker Unit. With this application a minor
proposed addition was indicated in the front yard of the property in the same area that
our request is being made, which required a variance setback. This application was
approved in 2005, per included Plat; Reception #513185; B74/P77, and Administration
Decision No. 67 -2005; Reception #512805. At the time of this application vested rights
were granted through 2008. Owners of this initial application did not develop the
existing house per the approval, and allowed the vested rights to lapse. The subject
property has been purchased by a new owner. We are requesting a re- granting of this
previously approved request to do a minor addition per the initial approval.
The current owners desire to construct an 85 square -foot pantry addition off the existing
kitchen on the street side of the house. The current condition has a step in the building
that the owners would like to square off for the pantry. The existing structure currently
sits within the 50' -0" setback at 45' -0" off the east property boundary. Our request is to
establish a front setback for the portion of the addition that follows the existing house
front yard setback of 45' -0 ".
We feel that granting this variance request will not cause substantial detriment to the
public good and will not substantially impair the intent and purpose of the Pitkin
County Comprehensive Plan and land Use Code.

HAZARD REVIEW AND SPECIAL REVIEW FOR A CARETAKER DWELLING UNIT

RECITALS
I . Jane W. Smith Living Trust ( "Applicant`) has applied to the Pitkin County Community Development
Director ( "Director') for 1041 Hazard Review and Special Review approval to establish a building
envelope and legalize a Caretaker Dwelling Unit (CDU).
2. The parcel is located at 0321 E. Sopris Creek Rd., and is more specifically described in Exhibit A.
3. The parcel is zoned AFR -10 and contains approximately 3.72 acres.
4. The Director finds that the wildfire hazard within the envelope can be mitigated, and that the
envelopes are located on slopes of less than 30 %.
THE DIRECTOR DOES HEREBY APPROVE the Jane W. Smith Living Trust 1041 Hazard
Review and Special Review for a CDU, subject to the following conditions, which shall run with the land
and be binding on all successors in interest:
1. Prior to submission of any building permit applications for new development, the Applicant shall
submit a 1041 Hazard Review Site Plan to the Community Development Department for approval and
recording. The mylar copy of the site plan must be signed by the owner prior to submittal for recording.
2. Prior to commencement of any earthmoving or construction activity, the Applicant shall stake the
corners of the building and other envelopes and install construction fencing around the perimeter of
the envelopes The fencing shall remain in place for the duration of the construction.
3. Prior to issuance of any building permits for a new residence, the Applicant shall:
A. Complete a fireplace /woodstove registration form with the Community Development
Department, if necessary.
B. Pay the applicable road impact and affordable housing fees.
4. The Applicant shall comply with the following to mitigate impacts on wildlife:
A. Dogs shall be leashed or kenneled.
B. Fencing outside of the building envelope shall comply with the wildlife fencing standards in the
Land Use Code.
C. Install and use an approved bear -proof trash container as required by the County.
D. Maintain native vegetation outside of the building envelope.
E. Avoid fruit- bearing trees and shrubs in any landscaping.
5. The Applicant shall comply with the following landscaping and wildfire defensible space mitigation
standards:

A. Vegetation shall be reduced to break up the vertical and horizontal continuity of the fuels a
minimum of a 30 foot perimeter around all structures.
B. Spacing between clumps of brush and vegetation within the 30 foot perimeter shall be a minimum
of two times the height of the fuel. Maximum diameter of the clumps shall be two times the height
of the fuel All measurements shall be from the edges of the crowns of the fuel.
C. All branches from trees and brush within the 30 foot perimeter shall be pruned to a height of 10 feet
above the ground and ladder fuels from around trees and brush shall be removed.
D. Tree crown separation within the 30 foot perimeter shall have a minimum of 10 feet between the
edges of the crowns.
E. All branches that extend over the roof eaves shall be trimmed and all branches within 15 feet of the
chimnevs shall be removed.
F. Low vegetation (less than 6 inches in height) shall be maintained within a 10 foot perimeter around
all structures.
G. The Applicant shall be responsible for the continued maintenance ofthe defensible space vegetation
requirements.
6. The Applicant shall comply with the following additional wildfire mitigation standards:
A. Roofs shal I be constructed with a Class A roof covering or a Class A assembly as defined in the
International Building Code (IBC) Section 1505.2. Wood shake /shingle roof coverings are
prohibited. Roofs with less than a 3:12 pitch are not permitted unless they comply with the
following:
I ) All roof coverings shall be noncombustible materials and installed on a Class A roof assembly.
2) All roof coverings shall have a surface that shall facilitate the natural process of clearing the
roof.
3) All roof designs shall facilitate the natural process of clearing roof debris. Protrusions above
the roofline, such as parapets, shall be prohibited.
4) Roofs shall be installed as required by the adopted building code and shall have a minimum
slope of 1 48.
5) All roof designs, coverings, or equivalent assemblies shall be specifically approved by the Fire
Marshal prior to submittal of a building permit application.
B. Vents shall be screened with corrosive resistant wire mesh with mesh '/4 inch maximum.
C. Roofs and gutters shall be kept clear of debris.
D. Yards shall be kept clear of all litter, slash, and flammable debris.
E. All flammable materials and firewood /wood piles shall be stored on a parallel contour a minimum
of 15 feet away from any structure.
F. Swimming pools or ponds shall be accessible to Fire Department vehicles.
G. Fences shall be kept clear of brush and debris.
H. Wood fences shall not connect to the structure.
1. Fuel tanks shall be installed underground with an approved container.
J, Propane tanks shall be installed according to NFPA 48 standards and on a contour away from the
structure with standard defensible space vegetation mitigation around any above - ground tank. Any
wood enclosure around the tank shall be constructed with materials approved for 2 hour fire -
resistive construction on the exterior side of the walls.
K. Each structure shall have a minimum of one 10 pound approved ABC fire extinguisher placed in a
visible and accessible location.

L. Addresses shall be clearly marked with 2 inch non - combustible letters and shall be visible and
installed on a non - combustible post.
M. New utility lines shall be buried within the driveway.
7. No development, including grading, excavation, 511 placement, berming, landscaping, vegetation
removal or disturbance or septic system shall occur outside of the approved building or
access /landscaping envelopes.
8. All areas disturbed by construction shall be revegetated within one growing season of the project's
completion.
9. The caretaker dwelling unit shall be limited to 1,000 net livable square feet and the kitchen shall contain
a minimum of a two burner stove with oven, standard sink, and at least a 6 cubic foot refrigerator plus
freezer A minimum of one off -street parking space shall be provided for the unit.
10. Prior to submission of any building permits for the caretaker unit, the Applicant shall obtain and the
Housing Office shall record a caretaker dwelling unit deed restriction. Actual Floor plans of the unit
shall be submitted to the Housing Office with the deed restriction.
11. Prior to issuance of a Certificate of Occupancy for the caretaker dwelling unit, the Housing Office shall
inspect the unit.
12. The Applicant shall obtain'the required variance and building permit necessary to legalize the existing
barn and Caretaker Dwelling Unit within 6 months of this approval.
13. The Caretaker Dwelling Unit (CDU) shall remain vacant until the proper permits have been obtained to
legalize the existing CDU.
14. The Applicant shall adhere to all material representations made in the application and shall consider
those representations to be conditions of approval, unless amended by other conditions.
15. Statutory vested rights for the approval contained herein are granted pursuant to the Pitkin County
Land Use Code and Colorado Statutes, subject to the exceptions set forth in Pitkin County Land Use
Code, § 4 -140 and C.R.S., § 24 -68 -105 The statutory vested rights granted herein shall expire on
.2008.
