Pitkin Countv's Obli at�ions: Pitkin Coimty shall: I a) County agi•ees to g►�ant$3,000 to Colorado Mountain Catlege Go2Woi�k Programs as appi•oved in the County's 2013 budget,whieh r�vas approved by the Board of Caunty Commissionet�s on December 19,2012. Grant func�ing will provide Go2Workshops for displacecl and iueumbent worlcers,witli empliasis on basic sleills enhancemeut and career slcills. �� ; b) The total amount of this coi�tract shall not exceed $3,000 cash maximum iu 20i3. The County�vill pay Agei�cy the totat amount of this grant on or before the last day of Ma�•ch 2013. Payment is contingent upon receipt of mutually agreed upon Performance Measures and satisfactory seini-amiiial repo►�ts as outlined in section 2(n)of this contract.The return of a comp(eted contract is i•equirec�iii arder to receive payment. 3 � l , � � ; � 4. General Pi•ovisions a. The Parties to this Grant intend that the relationship beriveen them conteinplated by the Grant is that of independent agency. No agent, employee,or se�vant Agency rvill be solely and entirely responsible for its acts and the act of its agents, employees, seivants and subcontractors during the perforinance of the Grant. b. Payment pui•suant to the Grant, if in County, State or Fede��al funds, whether in � �vhole ar in part, is subject to and contingent apon the contin�»ng availability and appropriation of Cowrty fiinds for the piirpose thereof. � c. This Grant constiti�tes tl�e full and complete agreemej�t of the parties and ; supersedes or incorporates any prior written and o3•al agi'eements of t�ie pai•ties. Tn addition,Agency understands that no Co«nty official or empIoyee,otl�er than the Board of County Commissioners acting as a body at a Doa�•d meeting,has a�ithority to entei•into a Grant or to tnodify the terms of this Grant on behalf af the County. Any such Grant or modification to tliis Gcant must be in writing and be � e:ceceited hy the parties hereto. � 5. DefauldCancellation. If Agency sl�all defautt in the performance of Agency's Obligations pursuant to the tei•ms of this Agreement,and/or fails to provide an accounting or use oe appeopriatio�z of monies granted in the manner in which such accounting was represented to the County,Agency shall havs the right to cu�•e said default after written notice by the Couuty of the default to Agency.
