DENHOLM AND 250 ASPEN, LLC Administrative Decision No. 1 -2013 RECITALS 1. David M. Denholm and 250 Aspen, LLC ( "Applicants ") have applied to the Community Development Director ( "Director ") to adjust the lot line between the two lots in order to resolve an overlap that is the result of a surveying error. 2. The lots are located at 218 and 250 Willoughby Way, and are described as Lot 2, Lynch Lot Split ( "Denholm Lot ") and Lot 3, Block 1, Green Acres Subdivision ( "250 Aspen Lot'). 3. The lots contain 0.258 acres and 1.517 acres, respectively. The Denholm Lot is non - conforming in size and the 250 Aspen Lot is conforming in size in the R -30 zone district. 4. The Lynch Lot Split was approved by the Board of County Commissioners ( "BOCC ") in 1984, and the plat is recorded in Plat Book 16 at Page 96. 5. The Green Acres Subdivision was approved by the BOCC in 1963, and the plat is recorded in Ditch Book 2A at Page 292. 6. The eastern boundary of the 250 Aspen Lot does not correlate with the western boundary of the Denholm Lot. There is an overlap between the lots that is approximately seven feet wide and 86.5 feet long, or 559 square feet. The Applicants have agreed to split the overlap area into two portions, with the southerly 280 square feet (Exchange Parcel A) remaining with the 250 Aspen Lot and the northerly 280 square feet (Exchange Parcel B) remaining with the Denholm Lot. 7. Certain improvements on the Denholm Lot are located within the front and side yard setbacks; the Board of Adjustment granted variances for the construction of these improvements within the setbacks (Resolutions Nos. 94 -46, 98 -11 and 00 -5). 8. The Community Development Director approved a Site Plan for a replacement residence on the 250 Aspen Lot, pursuant to Administrative Decision No. 73 -2012; the site plan has not been recorded. Administrative Decision No. 73 -2012 acknowledges the overlap with the Denholm Lot and notes that the overlap would be split with the neighbor for purposes of calculating floor area on the 250 Aspen Lot, which is consistent with what is now proposed to be memorialized via a lot line adjustment. 9. The Director finds that the lot line adjustment request is consistent with the applicable requirements of Sec. 2- 30- 20(g)(4) of the Land Use Code ( "Code "): it will not create an additional lot, increase floor area for either of the lots, or create a lot substantially different in size for development or resale purposes. The Denholm Lot will remain non - conforming as to size and the 250 Aspen Lot will remain conforming as to size. 10. The Director further finds that the lot line adjustment has been configured to preserve the improvements on the Denholm Lot within the side yard setback that is adjacent to the 250 Aspen Lot, and so as not to compromise the previously approved setback variances. The Director further finds that the lot line adjustment is necessary to correct an inadvertent survey error to recorded plats; that the error was not intended to circumvent the provisions of the Code; and that the correction increases or does not substantially affect the degree of compliance with the Code; and, therefore, that the proposed adjustments to the Lynch Lot Split plat and the Green Acres Subdivision plat are consistent with the provisions of Sec. 2- 20- 30(g)(5) of the Code. Rudnick noted that the notice of posting has been presented. Darin Rienks, the applicant's representative, stated that the applicant is proposing to construct a garbage enclosure to keep the animals out of the trash. Referencing a map, he pointed out the location of the intended structure. Rienks stated that the City has a concern regarding snow removal, however it isn't an issue as long as the applicant maintains and will move or remove the enclosure if he is asked to. There was discussion regarding whether the enclosure was on the lot or on the right -of- way. Clarke stated that a portion of the enclosure is on the lot, and although it is unclear in the survey, the remaining portion is probably on the County/Willoughby Way right -of- way. 000001 � Z� MINUTES of the Pitkin County Board of Adjustment Tuesday, March 1, 2606 There was discussion regarding the Board's authority to grant this variance. Throm pointed out that the application states that Bert Pierce of the Road and Bridge Dept. has given permission to build in the right -of -way due to proximity of the road. Lukes clarified that the applicant is not asking for a variance to build in the right -of -way, the applicant is asking for a variance for the 2 '/1 ft. that is on the property in the setback. Lukes stated that it appears to only be 1 '/S ft. Clarke stated that he believed it should be a request for a 30 -ft. variance. Throm stated that the BOA should grant the variance and direct the applicant to work it out with the county. Cooper asked if the applicant has had contact with the neighbors. Rienks responded that he has only had direct contact with Jack Crandall, and that he believes it is a good idea because he is getting animals in his garbage as well. Rienks has received no negative feedback. There were no public comments. Rudnick noted that the notice of posting has been presented. Tim Malloy, the applicant's representative, introduced Shannon Murphy and Peter Van Pelt, the Director of Aviation. Malloy referenced a map to point out the location and area of the airport. He noted previous approvals on the project. Malloy gave a summary of the proposal stating that they are seeking approval for a two foot pavement extension; a variance for the apron within the 200 foot setback; an extension and relocation of the fence; and a variance to park construction trailers during the construction period. He pointed out the locations of each on the map provided. There was discussion regarding the location of approval for the construction trailers for the construction that occurred last year. Murphy clarified this location by referencing the map. 000002 RESOLUTION OF THE PITKIN COUNTY, COLORADO BOARD OF ADJUSTMENT GRANTING A FRONT YARD SETBACK VARIANCE FOR JOHN PHILLIPS Resolution No. 00-5 WHEREAS, John Phillips, owner of 218 Willoughby Way, is requesting approval of a Front Yard Setback variance of 30 feet, for construction of a trash enclosure; and WHEREAS, 30 feet is required for this lot in the R -30 zone district; and WHEREAS, the subject property is described as Lot 2, Lynch Lot Split; and, WHEREAS, the Board of Adjustment is vested with the power to grant or deny such variances by virtue of Title II, Section 7- 10.30, Pitkin County Code (Land Use Code) and Colorado Revised Statutes, 1973, 30 -28- 118(2) (C); and, WHEREAS, based on the evidence presented, the Board of Adjustment makes the following findings: 1. Proper notice procedures, including the notification of all adjoining property owners, has been shown by the applicant. 2. The required hardship or practical difficulty has been established. 3. Granting such relief will not cause substantial detriment to the public welfare and will not substantially impair the intent and purpose of the Zoning Resolutions and the zoning maps. Denholm, the owner of Lot 2, Lynch Lot Split, also known as 218 Willoughby Way, Aspen, Colorado (the "Denholm Property"). On behalf of our client, we are submitting this request for a Minor Subdivision Exemption for a Lot Line Adjustment involving the Denholm Property and the property owned by 250 Aspen, LLC, a Colorado limited liability company, located adjacent to and west of the Denholm Property, described as Lot 3, Block 1, Green Acres Subdivision, also known as 250 Willoughby Way (the "250 Aspen Property "). Authorization letters signed by both property owners are included in this packet (see Tab 1). An 8'/2" x 11" vicinity map and reduced copies of the recorded plat maps showing the locations of the two properties are included in this packet (see Tab 2). Pursuant to the Pre - Application Conference Summary dated February 13, 2013 (see Tab 3), this summary letter explains the request for the Minor Subdivision and Lot Line Adjustment, provides background on prior approvals and permits, and addresses compliance with Land Use Code Section 2- 30- 20(8)4, pertaining to Lot Line Adjustments. I. Background on Prior Approvals, Permits, Etc. A. Parties and Properties: David M. Denholm ( "Denholm "). The Plat for the Lynch Lot Split contains two (2) platted lots, and the Denholm Property is the westernmost of the two Lynch Lot Split lots. The Lynch Lot Split plat shall hereinafter be referred to as the "Lynch Lot Split Plat." 250 Aspen LLC a Colorado limited liability company ( "250 Aspen'). The 250 Aspen Property (Parcel Identification Number 273707210133) is legally described as Lot 3, Block 1, Green Acres Subdivision, according to the Plat thereof recorded in the real property records of Pitkin County, Colorado on September 17, 1963, in Ditch Book 2A at Page 292, County of Pitkin, State of Colorado. The plat for the Green Acres Subdivision contains three (3) platted lots, and the 250 Aspen Property is the easternmost of the three Green Acres Subdivision lots. The Green Acres Subdivision plat shall hereinafter be referred to as the "Green Acres Plat." B. History: 1. Both the Lynch Lot Split Plat and the Green Acres Plat were approved by the Board of County Commissioners of Pitkin County. The eastern boundary of the Green Acres Plat, which is also the same as the eastern boundary of the 250 Aspen Property, does not correlate to the western boundary of the Lynch Lot Split Plat, which is also the western boundary of the Denholm Property. 2. Recent land survey work has revealed that the eastern portion of the 250 Aspen Property and the western portion of the Denholm Property both include the same strip of land which is approximately seven feet wide and 86.50 feet long. This "Overlap Area" is shown in the hatched area of Sheet 1 of 2 of the Minor Subdivision Exemption Plat of the Denholm/250 Aspen Lot Line Adjustment (see Tab 4). On information and belief, the Overlap Area exists as a result of a prior surveying error. 3. Certain improvements on the Denholm Property are located within the front yard and side yard setbacks established by the Pitkin County Land Use Code. The Pitkin County Board of Adjustment (the "BOA ") has previously granted variances to the Denholm Property to allow for the construction and maintenance of these building improvements within the setbacks. In Resolution No. 94 -46, the Pitkin County Board of Adjustment (the "BOA ") granted the Denholm Property a three -foot front yard setback variance for a roof. In BOA Resolution No. 98 -11, the BOA granted the Denholm Property a 27 -foot front yard setback variance, a five -foot west side yard setback variance and a 320 square foot increase in floor area for the construction a�L� HOLLAND &HART,. In BOA Resolution No. 00 -5, the BOA granted the Denholm Property a 30 -foot front yard setback variance for construction of a trash enclosure. These three BOA Resolutions shall be referred to herein as the "Denholm Variance Approvals." 4. The Denholm Variance Approvals all relied on the property line descriptions established by the Lynch Lot Split. Denholm and Denholm's predecessors in title have therefore used and relied on the property descriptions contained in the Lynch Lot Split for purposes of establishing the Denholm Variance Approvals. 5. 250 Aspen has claimed ownership of the Overlap Area, and has filed a quiet title action against Denholm in Pitkin County District Court Case No. 13CV4, seeking a judicial resolution of the ownership of the Overlap Area. Denholm has responded with counterclaims. As an alternative to litigation, 250 Aspen and Denholm have agreed to settle their dispute and join in a land use application to split the Overlap Area into two portions, with one portion of the Overlap Area vesting in 250 Aspen and the other portion of the Overlap Area vesting in Denholm. II. Compliance with Land Use Code Section 2- 30- 20(¢)4 We believe this application complies with the criteria in the above cited Land Use Code subsection for the following reasons: The adjustment creates not more than the original number of two (2) platted lots. 2. The purpose or effect of the lot line adjustment is not the creation of a new lot or parcel, nor does it increase exempt or non exempt floor area or maximum house size for either property, nor does it create a lot or parcel substantially different in size for development or resale purposes. 3. At 66,087 square feet, the 250 Aspen Property is a conforming lot in the R -30 Suburban Density Residential Zone District and the resulting lot shall conform to the minimum requirements for area or width established by the provisions of the Land Use Code. 4. At 10,957 square feet, as adjusted, the Denholm Property is a substandard size lot in the R -30 Suburban Density Residential Zone District and the resulting lot will increase in non- conformity as to lot size; however, the other standards of the Land Use Code will continue to be met. In this regard, the Lot Line Adjustment has been configured so that the Denholm Variance HOLLAND &HART... Ms. Suzanne Wolff March 5, 2013 Page 4 Approvals are not compromised so as to increase the intrusions of building improvements into the RS -30 Zone District setback applicable to the Denholm Property, as previously provided for in the Denholm Variance Approvals. 5. The applicants have prepared a Minor Subdivision Exemption and Lot Line Adjustment Plat in compliance with the standards set forth in the Pitkin County Land Use Application Manual. 6. An application for a minor plat amendment consistent with the proposed lot line adjustment is submitted concurrently with the application for a lot line adjustment. The applicants believe that a minor plat amendment consistent with this proposed lot line adjustment is necessary to correct the discrepancy between the eastern boundary of the 250 Aspen Property and the western boundary of the Denholm Property, where the error was not intended to circumvent the provisions of this Land Use Code, the correction increases or does not substantially affect the degree of compliance with the standards of this Land Use Code; and the revisions to the Lynch Lot Split Plat and the Green Acres Plat associated with the Lot Line Adjustment Plat will comply with the final plat standards of the Pitkin County Land Use Application Manual. III. Lot Line Adiustment Plat Included with this packet (see Tab 4) is a 24" x 36" proposed from of Minor Subdivision Exemption Plat of the Denholm/250 Aspen Lot Line Adjustment prepared by Sopris Engineering, LLC in accordance with Section 2.l .13 of the Pitkin County Land Use Application Manual. IV. Fee and Fee Agreement Also included with this packet is a signed copy of the Pitkin County Community Development Agreement for Payment of Land Use Application Fees form (see Tab 5) along with a check in the amount of $1,273.00 payable to the order of the Pitkin County Treasurer to cover the Planning Office flat fee and the Web Technology fee referenced in the Pre - Application Summary.
