HomeMy WebLinkAboutBocc Packet 04242013 Mail Ballot ElectionAGENDA ITEM SUMMARY REGULAR MEETING DATE: April 24, 2013 AGENDA ITEM TITLE: Authorizing the Pitkin County Clerk and Recorder to Conduct the November 5, 2013 Election by Mail Ballot in Accordance with C.R.S. 1-7.5-101 et seq. STAFF RESPONSIBLE: Janice K. Vos Caudill, Pitkin County Clerk and Recorder William Mast, Election Manager ISSUE STATEMENT: Conduct the Pitkin County November 5, 2013 Coordinated Election as a mail ballot election. BACKGROUND: The Election Code of 1992, Title 1 of the Colorado Revised Statutes, permits odd -year elections (also known as "Coordinated Elections") to be conducted by mail ballot only, subject to the approval of the Board of County Commissioners as Pitkin County's governing board. During the 2013 budget approval process, it was determined and approved by the Board of County Commissioners to budget accordingly the five-year budget plan for mail ballot elections in odd -years (2013, 2015 and 2017). KEY DISCUSSION ITEMS: NIA BUDGETARY IMPACT: The initial 2013 Election Department budget request was $117,853; the budget was prepared, and predicated on the assumption, for a polling place election. While working through the 2013 approval process and assessing the five-year budget plan, it was determined that mail ballot elections should be implemented in odd years (2013, 2015 and 2017); therefore, the five-year budget plan was adjusted each odd -year and decreased by $25,000 per year, reflecting a total of $75,000. RECOMMENDED BOCC ACTION: The Clerk and Recorder and staff respectfully recommend the Board of County Commissioners approve the process to conduct the 2013 Coordinated Election by mail ballot only, as set forth in proposed Resolution, as ATTACHMENTS: 1. Resolution A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF PITKIN COUNTY, COLORADO, AUTHORIZING THE PITKIN COUNTY CLERK AND RECORDER TO CONDUCT THE NOVEMBER 5, 2013, COORDINATED ELECTION BY MAIL BALLOT, IN ACCORDANCE WITH C.R.S. 1-7.5-101 et seq. Resolution No. 2013 Recitals 1. The General Assembly has found, determined and declared that self-government by election is more legitimate and better accepted as voter participation increases; and 2. By enactment of Article 7.5 of Title 1 of the Colorado Revised Statutes, the General Assembly concluded that it is appropriate to provide for Mail Ballot Elections under specified circumstances, and under the supervision of the Secretary of State, subject to rules promulgated by the Secretary of State; and 3. Subsection (3) of Article X, Section 20 of the Constitution of the State of Colorado permits the ballot issues of various entities to be consolidated at specified elections, which elections may also be conducted by mail ballot; and 4. The Board of County Commissioners ("Board") finds it to be in the best interest of the citizens of Pitkin County that the various districts and political subdivisions in the County be permitted to conduct the election set for November 5, 2013, by consolidated mail ballot. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Pitkin County, Colorado: 1. The November 5, 2013 election shall be conducted by mail ballot. 2. Pitkin County Clerk and Recorder is hereby designated as the election official for said Mail Ballot Election, pursuant to C.R.S. 1-7.5-104(1). 3. The various political subdivisions and special districts within the County shall be permitted to consolidate their ballot issues, under the direction of the Pitkin County Clerk and Recorder. 4. The Pitkin County Clerk and Recorder shall conduct said Mail Ballot Election under the supervision of the Secretary of State, and the provisions of Article X, Section 20, Colorado Constitution and of C.R.S. 1-7.5-101, et seq.
