NOW, THEREFORE, BE IT RESOLVED by the BOCC that it does hereby designate the red barn to the Pitkin County Historic Register and list the two frame houses on the Pitkin County Historic Inventory, as shown on the map attached as Exhibit B, subject to the conditions set forth herein, which shall run with the land and be binding on all successors in interest. L The Applicant shall adhere to all material representations made in the application or in public meetings or hearings and shall consider those representations to be conditions of approval, unless amended by other conditions. 2. Within 120 days of the date of this approval, the Applicant shall record a Covenant Agreement in a form acceptable to the County Attorney in which the Applicant agrees to preserve, maintain and restore the red barn in accordance with the Pitkin County Preservation Handbook ( "Handbook "). The Covenant shall also address the listing of the two frame houses on the Historic Inventory and shall recommend that the houses be maintained, repaired or otherwise altered in a manner that complies with the Handbook. The Covenant shall specify that any new construction and /or additions to historic or non - historic buildings on the site shall be reviewed under the Handbook to ensure compatibility with the historic character of the site. Prior to recordation of the Covenant Agreement, the Applicant shall complete additional research to determine the chain of ownership of the property and the owner presumably responsible for the construction of the barn. 3. failure to comply with these conditions of approval may result in revocation of this approval, or any subsequent permit(s) or approval(s) related to this property, or vested rights associated with this property. No incentives are requested for the designation. The Applicant intends to obtain an Historic Structure Assessment of the barn in order to then pursue grant funding for building improvements. APPLICANT: City of Aspen REPRESENTATIVES: Stephen Ellsperman & Sarah Shaw LOCATION: 34702 Highway 82 ZONING/LOT SIZE: The property contains approximately 165 acres and is zoned AR -10. The property is encumbered by a conservation easement held by Aspen Valley Land Trust. BACKGROUND/EXISTING CONDITIONS: The City of Aspen purchased the property in 1999. The existing facilities are shown in the application (Site Plan /Inventory and photos). REFERRAL AGENCIES: Referral comments from the Historic Preservation Officer are incorporated in this memorandum and are attached for reference. The application was referred to the Brush Creek Metro District, but comments were not provided. STAFF COMMENTS: DESIGNATION TO HISTORIC REGISTER (LUC Sec. 7 -20 -100): The Applicant proposes to designate the red barn at Cozy Point Ranch to the Historic Register. The barn was erected on or about 1930. The Applicant has prepared historical documentation of the property, which is included in the application. The Historic Building Inventory Record is included in the application. The Record states that the resource is significant for its association with the history of settlement and agriculture in Pitkin County, having been the homestead of True A. Smith and the site of a ranch operated by the Smith family for many years. Suzannah Reid, Historic Preservation Officer (HPO), states, "The historic Barn was built in 1930 and is one of a handful of large barns that remain in the Valley. The two frame houses [built in 1900] are typical of the modest early ranch house common in the valley, however they lack some of the Victorian era stylistic elements also commonly seen. All are associated with the original settlement of this property and its operation as a ranch. The majority of the development on the site is located on the north end, leaving a considerable portion of the site open for agricultural uses. This balances the new development and preserves the impression of the traditional ranch compound which is essential to the integrity of the Ranch theme." uu,,JO1 -J4 Ms. Reid supports the designation of the barn to the Historic Register, and has responded to the Code criteria for designation to the Historic Register in her referral letter (Attachment A). She notes that the barn retains a high level of integrity, in that it has not been significantly altered; retains its original form, materials, window and door pattern and use; and remains in a prominent location on the site and is easily visible from the highway and Juniper Hill Road. Although the two frame houses have been "heavily altered," she recommends that they be listed on the Inventory to recognize them as historic. Including these buildings on the Inventory will allow them to be addressed in the Covenant Agreement for the Preservation of Historic Structures, which will be recorded. While the Covenant will require that the barn designated to the Historic Register must comply with the Pitkin County Handbook and Guidelines for Preservation of Historic Properties ( "Handbook "), it will recommend that the houses listed on the Inventory be maintained, repaired or otherwise altered in a manner that complies with the Handbook, in order to preserve the historic integrity of the buildings and preserve the potential for designation to the Register in the future (compliance is voluntary if listed on the Inventory). RECOMMENDATION: Staff recommends that the Board of County Commissions make a motion to approve a Resolution designating the red barn on the Cozy Point Ranch to the Historic Register and listing of the two frame houses to the Historic Inventory. The site contains numerous buildings, only three of which are eligible for designation to the Pitkin County Register. The oldest buildings on the site were included in the 1999 Historic Survey that was undertaken by the county. The survey reviewed two frame houses and the historic Bam. At the time of the survey several other buildings were existing on the site and several more have been added, including a large riding arena and stables. The historic Barn was built in 1930 and is one of a handful of large barns that remain in the Valley. The two frame houses are typical of the modest early ranch house common in the valley, however they lack some of the Victorian era stylistic elements also commonly seen. All are associated with the original settlement of this property and its operation as a ranch. The 1999 survey indicates that the ranch was originally established by Jotham Smith who settled on the land in 1885. True A. Smith, Jotham's son, operated the ranch until 1930 when the property was sold. According to newspaper accounts the ranch was very successful with 300 acres dedicated to both farming and livestock. According to the survey the houses were built in 1900. Employee house #1 is a one and one half story house with a gable roof and shed roof addition on the west side. Some 1i 3 0, J0005 original windows remain, but the building has been heavily altered. Employee house #2 is a one story side gable house with a smaller side gable addition. None of the original windows or the original window pattern remain. Apparently both were heavily remodeled in 1983. The Barn is a two story building with a gable roof on the main section and a shed roof continuing the roof plane to the east. Most of the original openings appear to remain, though the actual window units may have been replaced. Large sliding doors are located on the north elevation and a large hayloft door dominate the facade. Two small cupola vents are located on the main ridge. The Barn appears to be in near original condition. The majority of the development on the site is located on the north end, leaving a considerable portion of the site open for agricultural uses. This balances the new development and preserves the impression of the traditional ranch compound which is essential to the integrity of the Ranch theme. To be included on the Register the property must be found to demonstrate a higher level of significance. That significance can be demonstrated by use of the following criteria: I. Importance of the historic theme to which the resource is related to the County's history. Ranching is the one of the most important themes in this part of the Roaring Fork Valley. The houses and Barn are indicative of the commitment that early settlers made to ranching in the valley. The fact that the complex continued to evolve over time is an important element of the ranching theme. 2. The number of other historic properties that this resource represents and how it is exemplary. Several ranch sites remain in the valley. They range from complete ranch compounds with house, barn and outbuildings to isolated houses or isolated barns. The two houses on the site are modest buildings and not particularly unique among the remaining ranch houses. The Barn, however, is an excellent example of the size and type of Barn found in the valley. Fewer than five large bams remain in this part of the valley. 3. The resource's level of integrity of location, setting, design, materials, worlonanship, feeling and association. There has been a considerable amount of development on the Cozy Point site resulting in a wide variety of agricultural and support buildings. Continued development is part of the ranching theme, but it also has the potential to diminish the original character of the site. In this case the size and modest character of the houses make them particularly vulnerable to the large scale development that surrounds them. As a result of this combined with the substantial alterations, the houses retain only a small amount of integrity. The Barn, fortunately, is not as heavily impacted by the new development. It remains in a prominent location on the site and is easily visible from both the highway and Juniper Hill Road. It is Z iu'006 smaller than the significant riding arena, but it is not obscured by it. In addition, the Barn has not been significantly altered, retaining its original form, materials, window and door pattern and use. The Barn retains a high level of integrity. 4. The qualities of singularity such as rarity, uniqueness, and age. The houses and Barn date from the early part of the 206' century and are part of a handful of ranch properties that remain in this part of the Roaring Fork Valley. The design of the Barn is singular among the remaining historic barns. S. Visual prominence. The site is located along highway 82 and is highly visible. The fact that a large part of the site remains agricultural land adds to the prominence and character of the site. 6. Role in community events and celebrations. n/a 7. If the work of a notable architect, builder or craftsman, how this property compares with the body of work produced by the individual or firm. n/a 8. If associated with a notable individual, how the property illustrates their contribution to the county, state or nation. This property is associated with the True Smith family, however the family seems to have sold the property at the time the Barn was built. Going forward additional research should be completed to determine the chain of ownership and the owner presumably responsible for the construction of the Barn. Since the applicant intends to move forward with a Historic Structure Assessment, this information should be made part of that document. The application is focused on the designation of the Barn, which is the most significant historic resource on the property. The houses are heavily altered and though they may not be eligible for the Register they should be placed on the Inventory for the purpose of recognizing them as historic. The Barn meets the criteria for designation and should be designated to the Register. GIJ0007 Memorandum THE CITY of ASPEN To: Suzanne Wolff, Senior Planner Pitkin County Community Development Department From: Stephen Ellsperman, Director of Parks & Open Space City of Aspen Parks Department Re: Cozy Point Ranch Barn Designation to Historic Register PID #264321200851 Date: April 10, 2013 The City of Aspen purchased Cozy Point Ranch in 1999 for the sole purpose of preserving the agricultural heritage of the upper Roaring Fork Valley. The land, which is designated as public open space, consists of approximately 60 acres of flat irrigated hay meadow and pasture, 30 acres of equestrian facilities, and approximately 70 acres of sagebrush shrublands. Recent acquisitions of adjacent property by Pitkin County Open Space and Trails have added thousands of acres of spectacular back country trails and boundless wilderness access to the property. Conservation easements held by Aspen Valley Land Trust insure that these lands will remain unchanged in perpetuity. Facilities at Cozy Point Ranch are a conglomeration of historic and modern structures. The most significant structure at the ranch is the prominent red barn, a visual icon in the upper Roaring Fork Valley and visible from both the up and downvalley lanes of adjacent SH 82. The barn is particularly significant because it is one of the last standing historic agricultural structures in the upper Roaring Fork Valley The building itself is in fair condition and is in need of significant structural reinforcement as it continues to be used for agricultural purposes related to the ranching, farming and educational programs in place at Cozy Point Ranch. Historical Significance of Property Historically known as the True Smith Homestead, Cozy Point Ranch consists of approximately 165 acres and is located to the west of SH 82 just north of the Brush Creek Road intersection. The property was purchased by the City of Aspen in 1999 and is currently managed for agricultural uses. As part of a larger Pitkin County Reconnaissance Survey, the Colorado Historical Society conducted an Historic Building Inventory Record of the property in 1999 and offered the following architectural description of the existing conditions of the ranch structures. 000001 This complex includes two frame houses, a large barn, a huge arena and wing with 32 stalls, newer sheds, and a moved house /shop. The two -story barn has a front gable roof with widely overhanging eaves and two small cupolas. The barn has corrugated metal roofing and the walls are clad with horizontal board siding with corner boards. The roof of the barn flares toward the northeast to cover a shed roof wing. The east wall has a diamond - shaped window at the apex of the gable, the second story has two small windows, and there is a large central opening flanked by pedestrian doors. The front has large central double sliding doors with diagonal board trim. The upper story has a large central opening with diagonal trim, flanked by a large and a small window There is a square vent at the gable apex and a hay winch structure at the gable peak. On the northeast wall are several larger windows with shutters and smaller windows. There is a frame house with a steeply pitched gable roof which has a screened -in porch on the west. The house has lap siding and a projecting bay on the front. There is a window on the gable face and the roof has a metal pipe chimney. The property also has a huge modern arena with wing of stalls, numerous small modern horse sheds, and other newer service buildings. In addition to the historic barn, other build structures on the property include a ranch house, several outbuildings that serve as administrative offices, an indoor arena, pole barn, outdoor arena, and multiple loafing sheds and segregated pastures for horse boarding and grazing. Jotham and his son True A. Smith were prominent ranchers where Cozy Point Ranch stands today. General Land Office records indicate that this was the homestead of True A. Smith, who settled on the land in June 1885. Smith received a patent for 154.75 acres of land in 1892, followed by a second patent in section 21 under the Desert Land Act in 1907. True was born it Colorado in 1864. His father; Jotham, was born in Maine and his mother was born in Iowa. According to the Rocky Mountain Sun (Oct. 3, 1885): The largest ranch, and perhaps the most profitable, is that of Jote Smith, at the mouth of the [Brush] Creek. Mr. Smith purchased this ranch in 1883, of several parties, and has over 300 acres of land. He has this year 90 acres of oats, of heavy yield, part of which will go 60 bushels to the acres. He will have between 3,500 and 4,000 bushes of oats from this field. This crop is worth $6,000 at least. He has a fine garden and has set out a number of fruit trees, some of which are doing well." On June 15, 1892, True married the daughter of another prominent ranching family along Woody Creek, the Bourgs who were from France. Together, True and Nettie lived on the ranch, referred to as Rathbone or Watson, which were two nearby stations along the Midland Railroad. Their marriage wasn't always perfect, as evidenced by an article in the August 3, 1898 Aspen Tribune: Mrs. True Smith of Watson is in the city for surgical treatment... Mrs. Smith received a wound from a pitchfork in a most unexpected and lamentable way. She was watching her husband at work in a field, he being on top of a haystack. After a time she sat down... to rest. Mr Smith, busy with his work, noted her disappearance and supposed she had gone to the house. When it came time to quit, he carelessly tossed his pitchfork to the ground .. a sharp cry from his wife warned him, however, that... the fork had struck her, one prong going through the flexor muscles of her leg below the knee..." True and Nettie had at least four children, the first being born in 1900. True also bred horses and was a member of the Roaring Fork Percheron Horse Breeding Association. An advertisement in the Aspen Daily Times from April 3, 1906 reads: "Wanted at once. A first class horseman to handle the Percheron stallion 'Boston' for the season 1906. None but a sober, competent man need apply. See True A. Smith, Rathbone." By 1930, True had sold the ranch and was living in Aspen with his wife, brother -in -law and two of his adult daughters. Both True and Nettie are buried in the Aspen Cemetery. True died in 1939 and Nettie passed away in 1956. Gladyce Hart Christiansen reported that the True Smith Ranch was noted for its big barn and that the True Smith family lived here for many years. She noted that the railroad stop at Shale Bluffs was called "Cozy Point," and that is how the ranch came to keep the name it has today. Ellamae Huffine Phillips, in the book Aspen, The Quiet Years is quoted as saying that Cozy Point got its name from a railroad tunnel that was located at the base of Shale Bluffs. "The boys would get their girlfriends and buggies... and get together and a bunch of them would go in that tunnel and smooch. They would drive their buggies in. That is how it got the name Cozy Point." 000002 Evidence for Inclusion in Historic Inventory To be included on the Pitkin County Historic Register, the property must be found to demonstrate a higher level of significance. That significance can be demonstrated by the use of the following criteria: 1. Importance of the historic theme to which the resource is related to the County's history. The property is significant for its association with the history of settlement and agriculture in Pitkin County, having been the homestead of True A. Smith and the site of a ranch operated by the Smith family for many years. The barn was a landmark in the area and is representative of barn construction during the early 20th century. 2. The number of other historic properties that this resource represents and how it is exemplary. Several ranch sites remain in the Roaring Fork Valley, but very few exist between Emma and Aspen. The Cozy Point barn is one of the only remaining historic barn in the upper valley that continues to be used for agricultural purposes. 3. The resource's level of integrity of location, setting, design, materials, workmanship, feeling and association. Cozy Point Ranch is unique in Pitkin County because it remains fully in agricultural use as a year -round working ranch and the upper valley's only public equestrian center. The barn is used primarily for Camp Cozy Point, an equestrian and basic horsemanship program for beginning and experienced riders. Horses are groomed and saddled in the barn, and stalls are available for animals that need extra attention. Two stalls were converted into an uninsulated arts and crafts room to supplement activities throughout the summer. One of the two large,outdoor arenas is located adjacent to the barn, as is the central gathering space, snack bar and restrooms. An indoor arena (85' x 235') was constructed in the early 1990's to allow for year -round equestrian activity. A pole barn and maintenance facility were also recently constructed to accommodate hay and equipment storage. The equestrian facilities can accommodate approximately 100 horses in 29 heated indoor stalls, 19 small paddocks, 4 larger shared paddocks (some with loafing sheds), and two large pastures. The inventory record suggests that the barn, constructed in approximately 1930, is the only historic building on the property with substantial historic integrity. The house, estimated to have been built in 1900, has undergone numerous architectural changes and has been deemed by the CHA to be lacking in historic integrity. Two cabins from a property on Cleveland Street were moved on to the site in c. 2005. The cabins, while maintaining a rustic /agricultural veneer, are not historic and do not contribute to the integrity of the site. 4. The qualities of singularity, such as rarity, uniqueness, and age. The barn's gable roof, overhanging eaves and two small cupolas differentiate it from other agricultural structures in Pitkin County. As such, it is a unique example of early settlement in the upper valley and a rare architectural treasure. 5. MEMORANDUM To: Suzanne Wolff Pitkin County Community Development Department From: Suzannah Reid Pitkin County Historic Preservation Officer Re: Cozy Point Ranch Barn Designation to Historic Register (CASE P038 -13; PID 2643- 212 -00 -851) Date: 5/30/13 The Cozy Point Ranch property is an active agricultural site that dates from the earliest settlement of the Roaring Fork Valley. The site contains numerous buildings, only three of which are eligible for designation to the Pitkin County Register. The oldest buildings on the site were included in the 1999 Historic Survey that was undertaken by the county. The survey reviewed two frame houses and the historic Barn. At the time of the survey several other buildings were existing on the site and several more have been added, including a large riding arena and stables. The historic Barn was built in 1930 and is one of a handful of large barns that remain in the Valley. The two frame houses are typical of the modest early ranch house common in the valley, however they lack some of the Victorian era stylistic elements also commonly seen. All are associated with the original settlement of this property and its operation as a ranch. The 1999 survey indicates that the ranch was originally established by Jotham Smith who settled on the land in 1885. True A. Smith, Jotham's son, operated the ranch until 1930 when the property was sold. According to newspaper accounts the ranch was very successful with 300 acres dedicated to both farming and livestock. According to the survey the houses were built in 1900. Employee house #1 is a one and one half story house with a gable roof and shed roof addition on the west side. Some I6P3 original windows remain, but the building has been heavily altered. Employee house #2 is a one story side gable house with a smaller side gable addition. None of the original windows or the original window pattern remain. Apparently both were heavily remodeled in 1983. The Barn is a two story building with a gable roof on the main section and a shed roof continuing the roof plane to the east. Most of the original openings appear to remain, though the actual window units may have been replaced. Large sliding doors are located on the north elevation and a large hayloft door dominate the fagade. Two small cupola vents are located on the main ridge. The Barn appears to be in near original condition. The majority of the development on the site is located on the north end, leaving a considerable portion of the site open for agricultural uses. This balances the new development and preserves the impression of the traditional ranch compound which is essential to the integrity of the Ranch theme. To be included on the Register the property must be found to demonstrate a higher level of significance. That significance can be demonstrated by use of the following criteria: 1. Importance of the historic theme to which the resource is related to the County's history. Ranching is the one of the most important themes in this part of the Roaring Fork Valley. The houses and Barn are indicative of the commitment that early settlers made to ranching in the valley. The fact that the complex continued to evolve over time is an important element of the ranching theme. 2. The number of other historic properties that this resource represents and how it is exemplary. Several ranch sites remain in the valley. They range from complete ranch compounds with house, barn and outbuildings to isolated houses or isolated barns. The two houses on the site are modest buildings and not particularly unique among the remaining ranch houses. The Barn, however, is an excellent example of the size and type of Barn found in the valley. Fewer than five large barns remain in this part of the valley. 3. The resource's level of integrity of location, setting, design, nhaterials, workmanship, feeling and association. There has been a considerable amount of development on the Cozy Point site resulting in a wide variety of agricultural and support buildings. Continued development is part of the ranching theme, but it also has the potential to diminish the original character of the site. In this case the size and modest character of the houses make them particularly vulnerable to the large scale development that surrounds them. As a result of this combined with the substantial alterations, the houses retain only a small amount of integrity. The Barn, fortunately, is not as heavily impacted by the new development. It remains in a prominent location on the site and is easily visible from both the highway and Juniper Hill Road. It is z smaller than the significant riding arena, but it is not obscured by it. In addition, the Barn has not been significantly altered, retaining its original form, materials, window and door pattern and use. The Barn retains a high level of integrity. 4. The qualities of singularity such as rarity, uniqueness, and age. The houses and Barn date from the early part of the 20' century and are part of a handful of ranch properties that remain in this part of the Roaring Fork Valley. The design of the Barn is singular among the remaining historic barns. S. Visual prominence. The site is located along highway 82 and is highly visible. The fact that a large part of the site remains agricultural land adds to the prominence and character of the site. 6. Role in community events and celebrations. n/a 7. If the work of a notable architect, builder or craftsman, how this property compares with the body of work produced by the individual or farm. n/a 8. If associated with a notable individual, how the property illustrates their contribution to the county, state or nation. This property is associated with the True Smith family, however the family seems to have sold the property at the time the Barn was built. Going forward additional research should be completed to determine the chain of ownership and the owner presumably responsible for the construction of the Barn. Since the applicant intends to move forward with a Historic Structure Assessment, this information should be made part of that document. The application is focused on the designation of the Barn, which is the most significant historic resource on the property. The houses are heavily altered and though they may not be eligible for the Register they should be placed on the Inventory for the purpose of recognizing them as historic. The Barn meets the criteria for designation and should be designated to the Register.
