RECITALS
Robert Lerhman ( "Applicant "), has applied to the Community Development Director of
Pitkin County, ( "Director "), pursuant to Section 3- 200 -080 of the Pitkin County Land Use
Code ( "Code "), to enlarge an existing building envelope by five feet to accommodate a
jutting eve.
The property is zoned R -30 and contains approximately 6.5 acres.
3. The property is 1300 Willoughby Way and is more specifically described in Attachment
"A„
The parcel received 1041 Hazard Review approval pursuant to Board of County
Commissioners Resolution No. 99 -94. The parcel also received Extension of Vested Rights
approval pursuant to Resolution 136 -2001.
The Director finds that the request is consistent with the requirements of the Land Use
Code.
APPROVED by the Director, subject to the following conditions:
The Applicant shall adhere to all material representations made during the application
process.
2. The Applicant shall comply with provisions of the BOCC Resolution No. 99 -94 and 136-
2001, unless otherwise replaced or amended by the conditions of this approval.
The Applicant shall prepare an amended 1041 Hazard Review Site Plan in accordance
with Land Use Code Sections 5 -70 -040, which shall depict the revised building envelope.
The site plan shall be submitted to the Community Development Department for approval
and recording, prior to submission of any future building permit applications.

REQUEST: The applicant is requesting to enlarge the existing building envelope by five feet to
accommodate an eave that juts out over the building envelope.

ZONING/LOT SIZE: R- 30/6.5 acres
BACKGROUND: The parcel received 1041 Hazard Review approval from the BOCC on April
28, 1999, pursuant to Resolution No. 99 -94. The original application was denied by the Hearing
Officer due to its rating as Severe Wildfire. The parcel most recently received an extension of
vested rights pursuant to Resolution No. 136 -2001.
REFERRAL COMMENTS:
• Vince Urbina, of the Colorado State Forest Service, felt that the proposed building
envelope expansion would not increase the wildfire hazard.
• Joanna Schaffner, Pitkin County Zoning Officer, had no comments on this application.
STAFF COMMENTS:
Minor Amendment to a Development Permit. Pursuant to Section 3- 200 -080 of the Land Use Code,
the Community Development Director may approve a minor amendment to a condition of a
development permit subject to compliance with the following standards.

A. The amendment must not change the use of the proposed development between residential,
commercial and tourist accommodation uses.
Response: The proposed amendment does not change the use of the proposed development.
B. The amendment must be consistent with action taken during the review of the original
development and does not constitute a new land development activity.
Response: The applicant is proposing the expansion of the existing building envelope five feet to
accommodate an eve of the house that juts out. The proposed envelope expansion does not
increase the wildfire hazard according to the Colorado State Forest Service representative.
C. The proposed activity does not:
T Change the basic character of the approved use of the land on which the activity
occurs including basic visual appearance and method of operation;
2. Increase off -site impacts in the surrounding neighborhood;
3. Endanger the public health, safety, or welfare;
d. Violate any land use Code Standard;
5. Substantially increase the need for on -site parking or utilities, or affect affordable
housing generation; and
6 Increase the floor area of the use by more than (2) percent or decrease the open
space on the site by more than three (3) percent.
Response: The proposed expansion of the existing building envelope does not change the basic
character of the approved use. The proposal will not endanger public health, safety or welfare nor
violate any known Code Standard. In addition, the expansion of the envelope is consistent with
1041 standards considered during original review. Finally, the proposal will not increase the need
for on site parking or affordable housing, or increase the floor area of the use.
RECOMMENDATION: Staff recommends that the Director approve the amendment for the
enlargement of the building envelope based on compliance with the standards noted above and
subject to the conditions of the attached Administrative Decision.

Dear Tamara:
Robert Lehrman ( "applicant ") owns a six and one -half acre,
irregularly shaped metes and bounds parcel located at 1300
Willoughby Way (Parcel ID # 2735 - 013 -00 -002) . Attachment 1 is a
copy of a vicinity map depicting the location of the subject site
at the very end of Willoughby Way. Specifically, the site is
located approximately 1.3 miles west of the Willoughby Way /Red
Mountain Road intersection. Willoughby Way is located .7 miles
north of the Mill Street /Main Street intersection in the City of
Aspen.
The applicant is represented by Davis Horn Incorporated in this
request for a Minor Amendment to a Development Permit. There is an
existing single- family residence located on the subject site which
will be demolished. The applicant is in the process of finalizing
building plans for a new single family dwelling unit and a
caretaker dwelling unit to be located on the site.
This applicant addresses the applicant's requests under the
following sub - headings.
Background

Land Use Approvals.
BACKGROUND
Since 1999, Pitkin County has granted three land use approvals for
the subject site. These land use approvals are summarized in this
section.

1041 Environmental Hazard Review Approval

On March 27, 1999 the Board of County Commissioners approved
Resolution 99 -94, a "Resolution of the Board of County
Commissioners of Pitkin County Colorado, Rescinding Hearing Officer
Determination NO. 99 -10 and Granting Approval of the Lange 1041
Hazard Review and Conceptual Submission" (see Attachment 2) .
Attachment 3 is a copy of the approved Lange 1041 Hazard Review
Site Plan.
The most significant issue in the 1041 Environmental Hazard Review
process was wildfire. The subject site is located in a severe
wildfire area. The original 1041 Hazard Review land use
application was denied because the entire subject site and
surrounding area is located in a severe wildfire area as determined
by the Colorado State Forest Service. Section 3 -80 -070 A.3. of the
Land Use Code requires the Hearing Officer to deny land use
requests for development on sites entirely within severe wildfire
areas. The Board of County Commissioners approved the 1041 review
land use application at a Takings Determination Hearing.
Caretaker Dwelling Unit Approval
Board of County Commissioners Resolution 99 -95 granted Approval to
the Chad and Karen Lange Caretaker Dwelling Unit. The Board of
County Commissioners granted this approval on April 28, 1999.
Extension of Vested Property Rights
Board of County Commissioners Resolution 136 -2001 granted the
applicant an Extension of Vested Property Rights.
EXISTING CONDITIONS & PROJECT DESCRIPTION
The subject site is zoned R -30 and is located at the western end of
Willoughby Way (see Attachment 1). The site is currently improved
with a single family residence. The applicant is proposing to
develop a single - family dwelling unit and detached caretaker
dwelling unit. The corner of the northwest eave of the proposed
house encroaches upon the approved building envelope. The
applicant is seeking a minor amendment to a development permit to
expand the building envelope by approximately five feet.
Attachment 4 depicts the Amended Lehrman 1041 Review Site Plan.
LAND USE APPROVALS
This section demonstrates compliance with the standards in Section
3- 200 -080, Minor Amendment to a Development Permit.

The amendment does not change the proposed use.
Section 3- 200 -080 B
The proposed amendment is generally consistent with action taken
during the land use review process. The applicant is requesting a
minor amendment to a development envelope. Land will not be
disturbed. The eave of the house will protrude no more than five
feet over the boundary of the approved envelope.
Section 3- 200 -080 C.1
There will not be a change in the character of the proposed land
use.
Section 3- 200 -080 C.2
The character of the proposed use will not change. The appearance
of the house will not be affected by the proposed amendment.
Section 3- 200 -080 C.3.
There will not be any affects on off -site impacts.
Section 3- 200 -080 C.4.
Land Use Code standards will not be violated. There will not be
any additional land disturbance.

There will not be any affect on parking or affordable housing.

SUMMARY
This land use application has demonstrated compliance with Code
standards for a minor amendment to a development permit.

I. APPLICANT has submitted to COUNTY an application for
(hereinafter, THE PROJECT).
2. APPLICANT understands and agrees that Pitkin County Ordinance No. 058 -2001 establishes a
fee structure for Planning applications and the payment of all processing fees is a condition precedent to a
determination of application completeness.
3. APPLICANT and COUNTY agree that because of the size, nature or scope of the proposed
project, it is not possible at this time to ascertain the full extent of the costs involved in processing the
application. APPLICANT and COUNTY further agree that it is in the interest of the parties for APPLICANT to
make payment of an initial deposit and to thereafter permit additional costs to be billed to APPLICANT.
APPLICANT agrees he will be benefited by retaining greater cash liquidity and will make additional payments
upon notification by the COUNTY when they are necessary as costs are incurred. COUNTY agrees it will be
benefited through the greater certainty of recovering its full costs to process APPLICANT's application.
4. COUNTY and APPLICANT further agree that it is impracticable for COUNTY staff to complete
processing or present sufficient information to the Planning Commission and/or Board of County
Commissioners to enable the Planning Commission and/or Board of County Commissioners to make legally
required findings for project approval, unless current billings are paid in full prior to decision.
5. Therefore, APPLICANT agrees that in consideration of the COUNTY's waiver of its right to
collect full fees prior to a determination of epplication completeness, APPLICANT shall pay an initial deposit in
