COMMERCIAL USE /SPECIAL EVENT PERMIT FOR SPECIAL EVENTS AT
REDSTONE CASTLE, June 1— OCTOBER 12, 2007

RECITALS
1. Pursuant.to Subsection 4- 30- 50(i), of the Pitkin County Land Use Code, the Community
Development Director of Pitkin County, Colorado ( "Director "), may approve a
Temporary Commercial Use /Special Event Permit for commercial activities or special
events.
2. Ralli Dimitrius (hereafter, the "Applicant") has applied to the Director for approval of a
Temporary Commercial Use /Special Event Permit to conduct tours and special events at
the Redstone Castle from June 1 — October 12, 2007.
3. The Castle previously received a permit to conduct tours and hold special events at
Redstone Castle in the Summer of 2003 and 2004. See BOCC Res. No. 055 -2003
(Reception No. 483974) and Administrative Decision No. 028 -2044.
4. The Director finds that, to the extent • applicable, the application complies with the
standards in Subsection 4- 30- 50(i), of the Land Use Code.
THE DIRECTOR HEREBY APPROVES the Temporary Commercial Use /Special
Event Permit for the Redstone Castle, subject to Applicant's compliance with each of the
following conditions:
Applicant shall adhere to all material representations made in, or in connection with, the
application.
2. Applicant shall only be entitled to conduct:
a. Catered special events (such as weddings and receptions) that result in no
more than 25 vehicles on the site, and no more than 100 people on the site, at
any one time; and
b. Tours of no more than 100 people on the site, and no more than 25 vehicles
on the site, at any one time.
c. There shall be no overnight lodging of guests.
Applicant shall post and comply with the 100 - person occupancy limit and shall place
approved fire extinguishers in places designated by the Carbondale & Rural Fire
Protection District.
4. Prior to the conduct of the first tour or event, Applicant shall contact Pitkin County
Environmental Health to determine the capacity of the Redstone Castle septic system. If
Environmental Health determines that the capacity of the system is inadequate, Applicant
shall be required to provide a sufficient number of portable toilets for its special events
and tours. Applicant shall also provide Environmental Health with records verifying that
the tanks for the septic system are being pumped regularly.

5. Applicant shall ensure that it has a current boiler inspection for each boiler in the
Redstone Castle boiler room and shall display a certificate of such inspections in the
boiler room.
6. All electrical work at the Redstone Castle shall be inspected and permitted by the Pitkin
County Building Department prior to the conduct of the first tour or event.
7. No cooking or other food preparation is permitted in the kitchen of the Redstone Castle.
8. Applicant will provide Pitkin County Risk Management with satisfactory evidence of
General Liability insurance, with an Each Occurrence limit of $1,000,000 and a General
Aggregate limit of $2,000,000, prior to the conduct of its first tour or special event.
9. Applicant shall not construct any temporary tents on the grounds of Redstone Castle
without obtaining any necessary Pitkin County Building Permits and consulting with the
Carbondale & Rural File Protection District.
10. Failure to comply with the conditions of approval may result in revocation of this permit.

RECITALS
1. Pursuant to Subsection 3- 200 -030 of the Pitkin County Land Use Code,
the Community Development Director of Pitkin County, Colorado
( "Director ") may approve a Temporary Commercial Use /Special Event
Permit for commercial activities or special events.
2. The Redstone Inn (hereafter, the "Applicant ") has applied to the Director
for approval of a Temporary Commercial Use /Special Event Permit to
conduct tours and special events (e.g., weddings) at Redstone Castle
from May 28 — October 12, 2004.
3. The Internal Revenue Service, U.S. Department of the Treasury, has
authorized Applicant to conduct operations at the Redstone Castle during
the Summer of 2004 under a Pitkin County Temporary Commercial
Use /Special Event Permit.
4. Applicant (together with EG &G Technical Services, representing the U.S.
Department of Treasury) previously received a permit to conduct tours and
hold special events at Redstone Castle in the Summer of 2003. See BOCC
Res. No. 055 -2003 (Reception No. 483974).
5. The Director finds that, to the extent applicable, the application complies
with the standards in Subsection 3- 200 -030 of the Land Use Code.

DATE: April 30, 2004
REQUEST: The applicant is requesting approval of a Temporary Commercial Use /Special
Event Permit in order to conduct tours and hold special events (e.g., weddings) at
Redstone Castle from May 28, 2004 — October 12, 2004.
APPLICANT: The Redstone Inn (hereafter, "Applicant ").
LOCATION: Redstone Castle.
BACKGROUND: Applicant (together with EG &G Technical Services, representing the
U.S. Dept. of Treasury) previously received a permit to conduct tours and hold special
events in the Summer of 2003. See BOCC Res. No. 055 -2003.
The U.S. Internal Revenue Service has confirmed that it authorizes use of the Redstone
Castle under a County Temporary Commercial Use /Special Event Permit during the
Summer of 2004.
REFERRAL COMMENTS: The Carbondale Rural Fire Protection District, Ellen Anderson,
Crystal River Caucus, Tony Fusaro, Joanna Schaffner, Redstone Historic Preservation
Commission, Tom Grady, Kris Jewkes, Bud Eylar, Suzannah Reid and Carla Block were
contacted on the application. Nancy Mackenzie also provided comments, per Carla
Block's request.
No comments were received from Tom Grady, Bud Eylar, Suzannah Reid, Tony Fusaro,
the Redstone Historic Preservation Commission, or the Crystal River Caucus.
Ron Leach, District Fire Chief, informed us, "The Carbondale & Rural Fire Protection
District approves of the Redstone Inn's application to renew the Redstone Castles' [sic]
special use permit with no changes [from last year]."
Ellen Anderson indicated she had no issues with the permit
The comments from Environmental Health concerning the septic system and food service
are incorporated in the Administrative Determination attached to this Memo.
Joanna Schaffner asked that we stress that electrical work must be inspected by the
County and permitted prior to the first event.
Kris Jewkes requested proof of insurance from Applicant, but did not feel that it was
necessary to have the County added as an Additional Insured on Applicant's policy.

STAFF COMMENTS:
Pursuant to Subsection 3- 200 -030 of the Land Use Code, Applicant must demonstrate that
adequate provisions have been made for all of the following:
1. Police supervision (if necessary);
2. Public parking;
3. Insurance;
4. Site set -up, maintenance and clean -up;
5. Emergency services; and
6. Safety of operations.
Additionally, temporary structures must conform to applicable building codes and other
County regulations. Each of these requirements is addressed, in turn, below.
Police Supervision: No special arrangements are necessary, given the nature of the
request.
Public Parking: Parking limitations are imposed under the attached Administrative
Determination. These are the same limitations imposed under the 2003 permit.
Insurance: Applicant is required to provide proof of insurance prior to the conduct of its
first tour or special event under the attached Administrative Determination.
Site Set -Up, Maintenance and Clean -Up: No special arrangements are deemed
necessary.
Emergency Services: No special provisions are necessary for emergency services,
given the nature of the request.
Safety of Operations: Conditions pertaining to maintenance of adequate sanitary facilities
and prohibiting food service operations using the Redstone Castle kitchen have been
included in the proposed Administrative Determination.
Conformance with Building Code: Compliance with Building Code requirements is
addressed in the proposed Administrative Determination.
RECOMMENDATION: Staff recommends that the Director approve the Temporary
Commercial Use /Special Event Permit application subject to Applicant's compliance with
each of the conditions in the attached Administrative Determination.

EH has had a concern about the adequacy of the septic and the previous owner (Hart) was supposed to
commit to hooking up to the Redstone Sanitation District. But I understand the situation with the Castle.
I think we must have them present records that they are pumping the tanks for their septic system on a
regular basis.. They should check with us to see what the capacity of there existing system is, and if
necessary, they must provide Porta - potties for special events.

I just reviewed the application and I have no problems with the Castle tours and special events. It is
VERY important that no cooking or food preparation of any kind go on in the kitchen at the Castle. It is
no longer a licensed facility.
Nancy may have some comments on the septic system, so I have copied her in.

Re: Temporary Commercial Use /Special Event Permit Application — Redstone
Inn Operations at Redstone Castle - 2004
Community Development has received a request from the Redstone Inn to renew the
permit it was issued last year to operate tours and hold special events at Redstone Castle. It
would like its new permit to extend from May 29 — October 12, 2004.
A copy of the BOCC Resolution that approved the 2003 permit is attached for your
information. The Redstone Inn is requesting that the conditions of approval remain
unchanged.
If you have any concerns or'issues you would like to raise in connection with
renewal of this permit, I would appreciate hearing from you by April 23, 2004.

On behalf of the Redstone Inn and the IRS, I am requesting the BOAC to
re -issue a Special Use permit to operate Redstone Castle on a limited basis
.Tune 28 thru October 12 for tours and special events (groups & weddings) as
they did for Summer 2004. This Special Use permit was issued by the BOAC in May 2003 for the
summer of 2004. 1 am asking for it to be extended for
another season with no changes. We have spoken with Ron Leach of Carbondale Rural Fire
Protection District and he has no problem with the limited uses as outlined in last year's permit.
